àThe€defendant€was€convicted€of€two€counts€of€the€rape€of€a€child€and€twoÏcounts€of€aggravated€sexual€battery.€€He€was€sentenced€to€serve€23€years€on€eachÏrape€conviction€and€11€years€on€each€of€the€aggravated€sexual€battery€convictionsÏas€a€Range€1€offender.€€The€sentences€were€ordered€to€be€served€concurrently.Ìà àThe€defendant€raises€the€following€issues€on€appeal:ÌÓÓÌà0 àI.à àWhether€the€evidence€was€sufficient€for€any€rational€trier€of€fact€toÏconvict€defendant€beyond€a€reasonable€doubt€of€each€and€every€element€ofÏchild€rape€and€aggravated€sexual€battery.ÌÌà8 àII.à àWhether€the€trial€court€erred€by€denying€defendantððs€motion€toÏdismiss€when€the€state€failed€to€allege€the€required€element€of€òòmensÏreaóó€in€two€of€the€four€counts€of€the€indictment.ÌÌà8 àIII.à àWhether€the€trial€court€was€justified€in€sentencing€defendant€toÏserve€almost€the€maximum€sentence€for€each€charge€for€which€heÏwas€convicted.ÌÓÓÌà àThe€judgment€of€the€trial€court€is€affirmed.Ìà àThe€victim€in€this€case€lived€with€her€mother€and€the€defendant.€€The€motherÏwas€arrested€and€incarcerated€in€May€1993,€and€the€victim€and€the€defendantÏremained€in€the€home.Ìà àWe€need€not€go€into€explicit€detail€concerning€the€sordid€facts€in€this€case.€€ItÏis€enough€to€say€the€state€presented€sufficient€evidence€to€convict€the€defendant€ofÏthe€four€offenses€if€the€jury€believed€the€stateððs€witnesses.€€The€defendant€testifiedÏhe€did€not€commit€the€acts€alleged€in€the€indictment€and€testified€to€by€the€stateððsÏwitnesses.€€He€and€other€defense€witnesses€attacked€the€credibility€of€the€victimÏand€other€witnesses€who€testified€for€the€state.Ìà àThe€jury,€by€their€verdict,€and€the€trial€judge,€by€his€approval€thereof,€haveÏaccredited€the€stateððs€witnesses.€€The€defendant€asks€us€to€discredit€them€onÏappeal.ÌÑ ½ Ñà àAt€trial,€the€jury€resolves€conflict€in€the€testimony€of€witnesses€andÏdetermines€their€credibility.€€òòCabbage€v.€Stateóó,€571€S.W.2d€œ832€(Tenn.€1978).›€€OnÏappeal,€we€weigh€the€evidence€to€determine€if€it€is€sufficient€for€a€rational€trier€ofÏfact€to€find€guilt€beyond€a€reasonable€doubt.€€òòState€v.€Evansóó,€838€S.W.2d€185Ï(Tenn.€1992).€€We€have€weighed€the€evidence€in€this€case€in€the€context€requiredÍand€find€it€is€sufficient€for€a€rational€trier€of€fact€to€find€guilt€beyond€a€reasonableÏdoubt.Ìà àThe€defendant€contends€the€trial€judge€should€have€stricken€counts€3€and€4Ïof€the€indictment€because€they€failed€to€allege€any€òòmens€reaóó€requisite€for€theÏoffenses€of€aggravated€sexual€battery€contained€therein.€€The€defendant€cites€noÏcases€in€support€of€this€issue€but€insists€statutory€requirements€compel€a€dismissalÏof€the€charges.Ìà àThere€appears€to€be€two€significant€cases,€which€are€pending€review€by€theÏSupreme€Court,€dealing€with€this€œissue,€òòState›€v.€Hillóó,€C.C.A.€No.€01C01„9508„CC„00207€(Tenn.€Crim.€App.,€filed€at€Nashville,€June€29,€1996)€and€òòState€v.€Jamesóó,ÏC.C.A.€No.€01C01„0601„CR„00016€(Tenn.€Crim.€App.,€filed€at€Nashville,€May€27.Ï1997).Ìà àWe€adopt€and€set€out€herein€the€reasoning€of€the€Court€œof€Criminal€AppealsÏin›€òòJamesóó€on€the€issue:ÌÓÓÌà8 àAn€indictment€has€three€(3)€purposes€in€Tennessee;€namely,€(1)€toÏinform€the€defendant€of€the€precise€charges;€(2)€to€enable€the€trialÏcourt€upon€conviction€to€enter€an€appropriate€judgment€and€sentence,Ïand€(3)€to€protect€the€defendant€against€double€jeopardy.€€òòState€v.ÏTrustyóó,€919€S.W.2d€305,€309€(Tenn.€1996).€€The€facts€must€be€statedÏin€ordinary€and€concise€language€so€that€a€person€of€ð ðcommonÏunderstandingðð€will€know€what€is€intended.€€òòWarden€v.€Stateóó,€214ÏTenn.€391,€381€S.W.2d€244€(1964).Ìà8 àà àFurthermore,€in€òòCampbell€v.€Stateóó,€491€S.W.2d€359,€361€(Tenn.Ï1973)€(emphasis€supplied),€while€addressing€the€sufficiency€of€anÏindictment€charging€the€offense€of€murder,€our€Supreme€Court€statedÏthe€following:Ìà8 àà8 àà àð ðWhile€it€seems€clear€that€the€indictment€in€òòWittóóÏwas€insufficient€in€that€it€failed€to€charge€an€element,€thatÏthe€murder€was€committed€unlawfully,€in€either€theÏlanguage€of€the€statute€or€common€law€or€words€ofÍequivalent€import,€the€decision€is€confusing€because€ofÏthe€language,€`fatally€defective€in€omitting€the€chargeÏthat€the€offense€was€committed€feloniously€or€withÏmalice€aforethought;€and€containing€no€words€ofÏequivalent€import.ðð€€òòIt€is€clear,€however,€that€had€theÏindictment€used€the€words€`feloniouslyðð€or€óó`unlawfullyðð,€itÏwould€have€been€sufficient.ððÌœ›à8 àBy€containing€the€words€found€in€the€language€of€the€statutes€onÏaggravated€rape€and€aggravated€sexual€battery,€the€indictment€atÏissue€sufficiently€apprised€James€of€the€offenses€charged.€€TheÏcharges€were€stated€in€ordinary€and€concise€language€so€that€aÏperson€of€common€understanding€would€know€what€was€intended.Ìà8 àà àFor€the€above€reasons€we€decline€to€follow€òòHillóó€and€find€thisÏindictment€was€sufficient€to€charge€the€offenses€of€aggravated€rapeÏand€aggravated€sexual€battery.ÌÓ  ÓC.ÌÓ  Óà8 àà àFurthermore,€òòHillóó€has€no€application€to€those€counts€of€theÏindictment€charging€the€offense€of€aggravated€sexual€battery.€€òòHillóóÏdealt€only€with€the€charge€of€aggravated€rape.Ìà8 àà àAggravated€sexual€battery€as€defined€in€T.C.A.€ðð€39„13„504€isÏð ðunlawful€sexual€contactðð€with€a€victim€ð ðless€than€thirteen€(13)€years€ofÏage.ðð€€T.C.A.€ðð€39„13„501(6)€defines€ð ðsexual€contactðð€as€the€Ìà8 àà8 àð ð.€.€.€òòintentionalóó€touching€of€the€victimððs,€the€defendantððsÏor€any€other€personððs€intimate€parts,€or€the€òòintentionalóóÏtouching€of€the€clothing€covering€the€immediate€area€ofÏthe€victimððs,€the€defendantððs,€or€any€other€personððsÏintimate€parts,€if€that€òòintentionalóó€touching€can€beÏreasonably€construed€as€being€for€the€purpose€of€sexualÏarousal€or€gratification€(emphasis€added).ððÌà8 àTherefore,€the€mental€element€of€ð ðintentionalðð€is€included€in€theÏdefinition€of€ð ðsexual€contactðð€and€is€impliedly€included€within€theÏindictment.€€By€statutory€definition€the€only€way€one€can€have€ð ðsexualÏcontactðð€is€by€the€ð ðintentional€touching€.€.€.€for€the€purpose€of€sexualÏarousal€or€gratification.ðð€€òòId.óóÌà8 àà àWe€therefore€conclude€that€òòHillóó€is€distinguishable€as€to€thoseÏcounts€charging€aggravated€sexual€battery.ÌÓÓÌà àà àThe€defendant€claims€the€trial€judge€erred€in€œsentencing›€theÏdefendant€to€23€years€on€œeach›€rape€conviction€and€11€years€on€œeach›€aggravatedÍœsexual€battery›€œconviction.€€At€the€time€of€the€offense,€the›€presumptive€sentence€forÏthe€rape€of€a€child€œwas›€œ15›€years,€œand›€it€œwas€8›€years€for€aggravated€sexual€battery.Ìà àThe€record€in€this€case€shows€the€defendant€has€a€history€of€previousÏconvictions€including€several€burglaries€and€various€alcohol„related€crimes€plus€aÏconviction€for€escape.€€The€trial€judge€applied€this€enhancing€factor€to€all€of€theÏoffenses.Ìà àThe€record€shows€the€personal€injuries€inflicted€on€the€victim€were€great.€ÏThe€victim€had€undergone€and,€at€the€time€of€sentencing,€was€still€undergoingÏextensive€Ñ ° Ñpsychological€treatment€as€a€result€of€the€trauma€inflicted€upon€her€by€theÏdefendantððs€conduct.Ìà àThe€trial€court€found€the€enhancing€factors€that€the€offenses€involved€a€victimÏand€were€done€to€gratify€the€defendantððs€desire€for€pleasure€or€excitement€to€beÏapplicable€to€the€charges€of€rape.€€Further,€the€record€shows,€and€the€trial€courtÏœfound,›€the€defendant€violated€a€position€of€trust€at€the€time€of€the€offense,€becauseÏhe€stood€in€the€position€of€òòlocus€parentisóó€to€the€victim.Ìà àThe€defendant€presented€few€mitigating€factors,€if€any.Ìà àPreviously,€the€defendant€argued€the€trial€court€should€consider€that€he€hadÏbeen€an€alcoholic€and€abused€child€and€that€he€was€now€attempting€to€reform€hisÏlife.Ìà àWe€review€the€sentencing€proceeding€òòde€novoóó€upon€the€record€with€aÏpresumption€of€correctness,€T.C.A.€ðð€40„35„401,€conditioned€upon€a€showing€theÏtrial€court€has€considered€all€the€principles€of€sentencing€and€circumstances€andÏfacts€in€the€case.€€òòState€v.€Ashbyóó,€823€S.W.2d€166€(Tenn.€1991).€€The€defendantÍmust€show€the€sentence€is€improper.€€òòState€v.€Gregoryóó,€862€S.W.2d€574€(Tenn.ÏCrim.€App.€1993).Ìà
