Intheabsenceofanadequaterecordonappeal,thiscourtmustpresumethatthetrialcourtsrulingsweresupportedbysufficientevidence.Oody,823S.W.2dat559.̜  Also,wehavenobasisfordeterminingthatthetrialcourterredindismissingthepetitionwithoutappointmentofcounselandahearing.TheHabeasCorpusActrequiresthecourttoreviewthepetitionanddismissitandrefusetoissuethewritunlessitindicatesthepetitioner'sconvictionmaybevoid.SeeTenn.CodeAnn.2921101,109(1980).Ifthewritisrefusedbasedonthefailureofthepetitiontoraiseacognizableclaimforrelief,anyneedforahearingisobviouslypretermittedbecausethereisnojusticiableissuebeforethecourt.SeeStateexrel.Byrdv.Bomar,214Tenn.476,381S.W.2d280(1963).Moreover,thereisnorequirementintheHabeasCorpusActthatapetitionerbeaffordedappointedcounselortheopportunitytoamendthepetition.SeegenerallyTenn.CodeAnn.2921101to130(1980andSupp.1996).Thus,thetrialcourtdidnoterrsimplybecauseitdidnotallowahearing,appointmentofcounselandanopportunityforamendmentofthepetition.
