Nashville,TN.372011649OPINIONFILED:____________________ APPEALDISMISSED CURWOODWITTJUDGE̛̜@ OPINION` XX    Thepetitioner,RobertFinney,Jr.,appealspursuanttoRule3(b)oftheTennesseeRulesofAppellateProcedurefromtheDavidsonCountyCriminalCourtsallegeddismissalofhispetitionforpostconvictionrelief.Thepetitionerwasconvictedin1985offelonymurder,firstdegreeburglary,aggravatedassault,assaultwiththeintenttocommitfirstdegreemurder,andmaliciousshooting.Hereceivedalifesentenceforthemurderconvictionandfiveyearandtwoyearsentencesfortheotherconvictions.Allsentencesrunconcurrently. HisconvictionswereaffirmedondirectappealtothisCourt.Statev.RobertFinney,Jr.,No.86146III(Tenn.Crim.App.,Nashville,Dec.12,1986).FinneyfiledhisfirstpetitionforpostconvictionreliefonJanuary21,1993.Thetrialcourtfoundthatthepetitionwasbarredbystatuteoflimitationsanddismissedthepetition.ThiscourtaffirmedthedismissalinRobertFinney,Jr.v.State,No.01CO19309CR00313(Tenn.Crim.App.,Nashville,June28,1995). ThepetitionerfiledhissecondpostconvictionpetitiononJanuary3,1996,allegingthathisconvictionswereconstitutionallyinfirmbecausethejuryinstructiononreasonabledoubtcontainedlanguagefoundtobeunconstitutionalinRickmanv.Dutton,864F.Supp.686(M.D.Tenn.,1994).Theprosepetitionernowcontendsthatthetrialcourterredindenyinghimtheopportunitytoamendhispetitionandbydismissinghispetitionwithoutdeterminingtheissueonitsmerits. Wehavecarefullyexaminedtherecordonappealandfindthatwehavenojurisdictiontoconsidertheissuesappellanthasraised.Therefore,thisappealmustbedismissed. (    Therecordclearlyshowsthat,onMay28,1996,thepetitionerandhiscounselappearedinopencourt.DefensecounseladvisedthecourtthathehadexplainedtothepetitionerthattheholdinginRickmanv.Duttonwouldnotbeapplicabletohiscaseandthatthepetitionerwasgoing tostrikehispetition.ThetrialcourtthenaddressedthepetitionerdirectlyandexplainedthatthepetitionercouldfileanewpostconvictionpetitiononlyifnewevidencewerediscoveredoriftheSupremeCourtchangedtheconstitutionalityofsomelawrelevanttohisconvictions.Thetrialjudgethenasked, Well,Mr.Finney,doyouwanttowithdrawthispetition,then,anduhunderstandingthatifsomethingdevelopsyoucanalwaysfileagain.Apparentlythepetitionernoddedhisheadorgavesomeothersilentassentbecausethetrialjudgethensaid, Allright,andtheproceedingswereconcluded.Thestatevoicednoobjectiontothetrialcourtsaction.However,thetechnicalrecordcontainsnoorderdisposingofthepetition,throughwithdrawalorotherwise. ThenewPostConvictionProcedureAct,whichbecameeffectiveonMay10,1995,providesthat [t]hepetitionermaywithdrawapetitionatanytimepriortothehearingwithoutprejudicetoanyrighttorefile,butthewithdrawnpetitionshallnottollthestatuteoflimitationssetforthin4035202.Tenn.CodeAnn.4030209(c)(Supp.1996).Weareunabletodeterminefromtherecordthenatureoftheproceedingatwhichthetrialcourtgranteddefensecounselsmotiontowithdrawthepetition.However,itisclearthatthepetitionerassentedtothewithdrawalofthepetitionandthatthestatehadnoobjectiontoitswithdrawal. )   כ Thepetitionerappealstheallegeddismissalofhispostconvictionpetition;however,thereisnoorderorjudgmentwhichdismissesthepetition.Tenn.CodeAnn.section4030211(b)requiresthatthetrialcourtenterafinalorder [u]ponthefinaldispositionofevery[postconviction]petition....Tenn.CodeAnn.4030211(b)(Supp.1996).Thiswasnotdone.Thereforewecannotconcludethatanyfinaldispositionwasmade.Furthermore,thepetitionersrighttoappealfromthetrialcourtsdispositionofapostconvictionproceedingispredicatedupontheentryofanorderbythetrialcourt.Tenn.R.App.P.3(b).Intheabsenceofsuchanorder,thiscourthasnojurisdictiontoentertaintheappeal. +     Therefore,thisappealmustbedismissed.       __________________________     CURWOODWITT,Judge______________________________JOEG.RILEY,Judge______________________________JOSEPHH.WALKER,III,SpecialJudge
