Ðcourt€conducted€a€hearing.€€The€defendant€stipulated€to€the€probation€violation.€€The€trial€courtÐ $X" Ðordered€the€defendant€to€serve€90€days€in€the€Blount€County€Jail€and€to€serve€the€balance€of€hisÐ ô$D # Ðsentence€on€community€corrections.€€Ð à%0!$ ÐÌà  àà ` àThe€defendantððs€recalcitrant€behavior€did€not€abate,€and€on€May€30,€2001,€aÐ ¸'#& Ðcommunity€corrections€violation€warrant€was€issued.€€The€defendant€was€arrested€the€following€day,Ð ¤(ô#' Ðand€he€arranged€for€immediate€release€on€bond.€€A€hearing€on€the€violation€was€held€on€June€29,Ð )à$( Ð2001.€€As€before,€the€defendant€stipulated€to€the€violation.€€This€time,€the€trial€court€revoked€theÐ |*Ì%) Ðdefendantððs€probation€and€ordered€him€to€serve€the€original€sentence€minus€104€days€of€jail€credit.Ð h+¸&* Їà  àà ` àLess€than€two€months€later,€the€Tennessee€Board€of€Probation€and€Parole€issued€aÐ ° Ðð ðProbation€Certificateðð€releasing€the€defendant€effective€August€24,€2001,€with€conditions.€Ð œì ÐApproximately€four€months€later,€the€defendant€garnered€his€fourth€probation€violation€warrant.€€AÐ ˆØ Ðhearing€was€held€on€February€11,€2002,€for€which€a€transcript€was€prepared€and€filed€with€the€recordÐ tÄ Ðon€appeal.Ð `° ÐÌà  àà ` àAt€the€hearing,€Teresa€Captain,€a€probation€officer,€testified€that€she€was€responsibleÐ 8 ˆ Ðfor€supervising€the€release€of€the€defendant.€€After€reporting€to€Ms.€Captain€in€September€andÐ $ t ÐOctober,€the€defendant,€without€explanation,€failed€to€report€to€her€for€the€next€four€months.€€Ms.Ð  ` ÐCaptain€testified€that€the€defendant€made€only€one€payment€toward€his€supervision€fees€and€that€sheÐ ü L  Ðcould€only€verify€that€he€made€a€single€payment€of€$50€on€court€costs€and€fines.Ð è 8  ÐÌà  àà ` àThe€defendant€testified€that€after€he€was€released€on€August€24,€he€lived€for€a€shortÐ À  Ðtime€with€his€father,€but€then€he€moved€in€with€a€female€friend.€€He€said€that€just€before€Christmas,Ð ¬ü  Ðthey€were€evicted€and€that€since€that€time€he€has€had€no€place€to€live.€€The€defendant€was€not€at€thatÐ ˜è  Ðtime€working;€he€testified€that€he€had€been€working€at€Food€City€but€that€he€quit€that€job€for€betterÐ „Ô  Ðemployment€ð ðthat€didnððt€come€through.ðð€€The€defendantððs€explanation€for€not€contacting€hisÐ pÀ Ðprobation€supervisor€was€that€he€ð ðwasnððt€around€a€phone.ðð€€He€insisted€that€if€released€from€jail,€hisÐ \¬ Ðfather€would€allow€him€to€move€in€until€the€defendant€could€find€a€job€and€support€himself.€€WhenÐ H˜ Ðasked€why€the€court€should€continue€his€probation,€the€defendant€responded,€ð ðThis€time,€I€know€thatÐ 4„ Ðitððs€not€kidding€around€and€I€have€learned€this€time.€.€.€.€€And€Iððve€learned€that,€you€know,€I€need€toÐ  p Ðdo€what€needs€to€be€done€of€me€and€asked€of€me€rather€than€do€what€I€want€to€do.ðð€€The€defendantÐ  \ Ðasked€that€the€trial€court€consider€some€form€of€split€confinement.Ð øH ÐÌà  àà ` àAt€the€conclusion€of€the€hearing,€the€trial€court€found€that€based€on€the€record€up€toÐ Ð  Ðthat€point,€the€likelihood€of€rehabilitation€was€ð ðnon„existent.ðð€€Accordingly,€the€trial€court€revokedÐ ¼  Ðthe€defendantððs€probation€but€specified€that€the€defendant€would€be€eligible€for€work€release.€Ð ¨ø ÐMoreover,€the€trial€court€offered€the€defendant€an€incentive:€ð ð[Y]ouððll€have€an€opportunity€to€applyÐ ”ä Ðto€ð!ð€get€a€job,€apply€for€work€release,€and€then€if€you€can€work€and€follow€the€jail€rules€for€a€periodÐ €Ð Ðof€time,€then€Iððll€be€glad€to€entertain€a€ð!ð€listen€to€a€motion€to€get€back€out€and€go€back€on€probation.ððÐ l¼ ÐÌà  àà ` àThis€appeal€followed.Ð D!” ÐÌà  àà ` àOur€review€requires€us€to€visit€a€familiar€corner€of€the€law.€€When€a€trial€court€findsÐ #l!
