àThe€appellant,€Roger€Lee€Fleenor,€appeals€the€sentence€imposed€by€theÏSullivan€County€Criminal€Court€upon€his€plea€of€guilty€to€the€offense€of€attempt€toÏcommit€aggravated€sexual€battery,€a€class€C€felony.€€Pursuant€to€a€negotiated€plea,Ïthe€appellant€received€a€sentence€of€eight€years€as€a€range€II€offender.€€TheÏmanner€of€service€of€the€sentence€was€submitted€to€the€trial€court€for€determination.€ÏFollowing€a€sentencing€hearing,€the€trial€court€denied€any€form€of€alternativeÏsentence€and€ordered€that€the€sentence€be€served€in€the€Department€of€Correction.€ÏThe€appellant€now€appeals€this€decision.ÌÌà àAfter€a€review€of€the€record,€we€affirm€the€decision€of€the€trial€court.€ÌÌÌà@ àò òBackgroundó óÌÌà àThe€appellantððs€conviction€stems€from€the€sexual€contact€of€his€seven€yearÏold€granddaughter.€€On€a€date€occurring€between€May€31,€1994,€and€August€31,Ï1994,€the€appellantððs€granddaughter€spent€the€night€alone€with€the€appellant€at€hisÏhouse.€€Early€the€following€morning,€she€went€into€her€grandfatherððs€bedroom€toÏsay€good€morning.€€The€appellant€pulled€his€granddaughter€onto€the€bed€andÏbegan€to€fondle€her€under€her€clothing.€€The€victim€eventually€told€her€mother,€whoÍreported€the€incident€to€law€enforcement€officials.€€On€March€21,€1995,€a€SullivanÏCounty€Grand€Jury€returned€a€presentment€against€the€appellant€charging€him€withÏone€count€of€aggravated€sexual€battery,€a€class€B€felony.€€òòSeeóó€Tenn.€Code€Ann.€ððÏ39„13„504(a)(4)€(1994€Supp.).€€On€April€15,€1995,€the€appellant,€pursuant€to€a€pleaÏagreement,€pled€guilty€to€the€lesser€offense€of€attempt€to€commit€aggravated€sexualÏbattery,€a€class€C€felony.ÌÌà àA€sentencing€hearing€was€held€on€June€26,€1996.€€The€proof€at€the€hearingÏrevealed€that€the€appellant,€age€54,€had€no€prior€criminal€history,€a€seventh€gradeÏeducation,€and€a€commendable€work€history€as€an€automobile€mechanic.€€TheÏappellant€stated€that€he€was€in€good€physical€and€mental€health€and€had€neverÏabused€either€alcohol€or€drugs.€€The€appellant€is€the€father€of€two€sons€and€threeÏdaughters,€all€presently€adults,€born€of€his€thirty€year€marriage€to€his€first€wife,ÏJuanita,€who€passed€away€in€1992.€€At€the€time€of€the€sentencing€hearing,€theÏappellant€was€married€to€his€second€wife,€Patsy.€€Various€witnesses€confirmed€theÏfact€that€the€appellant€is€well€respected€within€his€community€and€actively€involvedÏin€his€church.ÌÌà àDespite€his€many€commendable€traits€and€character€references,€theÏappellant€admitted€to€the€unlawful€sexual€contact€with€his€seven€year€oldÏgranddaughter.€€In€an€attempt€to€justify€his€conduct,€he€explained€that€the€victimÏbegan€ð ðrubbing€his€penis€and€kissing€on€him,€so€he€just€returned€her€love.ðð€€HeÍadded€that€this€conduct€occurred€on€one€other€occasion.€€The€appellant€alsoÏconfessed€to€other€similar€incidents€of€sexual€contact€involving€two€of€his€daughtersÏand€a€niece,€during€the€girlsðð€adolescence.€€In€a€victim€impact€statement€attached€toÏthe€presentence€report,€the€appellantððs€granddaughter€stated€that€she€is€ð ðafraid€ofÏPapaw€that€he€might€hurt€me€for€telling€mom.ðð€€The€victim€added€that€she€ð ðis€madÏbecause€he€said€I€led€him€on,ðð€and€wanted€the€appellant€to€ð ðgo€to€jail.ðð€€At€theÏsentencing€hearing,€the€mother€of€the€victim,€the€appellantððs€daughter,€testified€thatÏshe€had€forgiven€her€father€and€that€she€was€not€opposed€to€probation.ÌÌà àA€court€ordered€ð ðPsycho€Sexual€Evaluationðð€of€the€appellant€was€completedÏon€June€14,€1996,€by€a€private€non„profit€agency€to€determine€ð ðthe€least€restrictiveÏtreatment€setting€which€can€effectively€reduce€the€risk€of€further€sexual€acting€out.ðð€€ÏResults€from€one€portion€of€the€evaluation€indicated€that€the€appellant€was€ð ðmostÏaroused€by€males€eight€years€old€followed€by€male€adults€then€males€four€yearsÏold€and€females€twelve€years€old.ðð€€However,€the€appellantððs€ð ðmost€intense€arousalÏresponseðð€was€to€ð ðfemales€twelve€years€old€followed€by€females€sixteen€years€old,Ïthen€adult€males€and€females.ðð€€On€the€Adler€Sexual€Interest€Inventory,€theÏappellant€revealed€that,€at€eight€or€nine€years€old,€he€had€been€anally€penetratedÏby€his€older€brother.€€The€appellant€admitted€to€exposing€himself,€over€a€period€ofÏfifteen€years,€to€female€adults€and€children,€to€sexually€touching€the€present€victimÏon€two€separate€occasions,€and€to€sexually€touching€two€of€his€daughters€and€aÏniece€on€numerous€occasions.€€ÌÌà àDuring€a€clinical€interview,€the€appellant€explained,€when€questioned€aboutÏhis€history€of€deviant€sexual€behavior,€that€he€ð ðdoes€not€believe€he€has€a€problem.ðð€ÏHe€blames€ð ðthe€Devil€for€exploiting€his€weakness.ðð€€ð ðThe€Devil€has€done€thisÏbecause€[he]€is€trying€to€live€his€life€for€God.ðð€€However,€antithetic€to€thisÏexplanation,€the€appellant€reported€that€he€molested€his€granddaughter€becauseÏð ðhe€had€lost€his€wife€and€had€no€companionship.ðð€€Furthermore,€the€appellantÏð ðdemonstrated€no€empathy€or€understanding€of€how€his€offense€has€hurt€his€victim.ðð€ÏBased€on€the€results€of€the€psychological€testing,€the€evaluation€team,€comprised€ofÏcounselors€and€therapists,€concluded€that€the€appellant€was€in€need€of€specializedÏsexual€offender€treatment,€that€he€is€a€ð ðvery€òòhigh€riskóó€to€continue€sexually€actingÏout,ðð€that€the€appellant€ð ðshould€not€have€òòanyóó€contact€with€minor€children,ðð€and€thatÏthe€appellant€ð ðis€considered€to€be€a€moderate€òòrisk€to€reoffendóó€given€his€number€ofÏvictims€and€paraphilias€[sic],€his€defensiveness,€unwillingness€to€acceptÏresponsibility€for€his€sexual€offending,€and€inability€to€honestly€disclose€sexualÏoffensive€behavior.ðð× àIn€his€only€issue,€the€appellant€contends€that€the€trial€court€erred€by€imposingÏa€sentence€of€total€incarceration.€€When€the€manner€of€service€of€a€sentence€isÏchallenged€on€appeal,€this€court€must€conduct€a€òòde€novoóó€review€with€considerationÏof€the€evidence€received€at€the€sentencing€hearing,€the€presentence€report,€theÏprinciples€of€sentencing€and€arguments€as€to€sentencing€alternatives,€the€natureÏand€characteristics€of€the€criminal€conduct€involved,€any€statutory€mitigating€orÏenhancement€factors,€any€statement€that€the€defendant€made€on€his€own€behalf,Ïand€the€potential€or€lack€of€potential€for€rehabilitation€or€treatment.€€Tenn.€CodeÏAnn.€ðð€40„35„102,€„103,€„210;€òòseeóó€òòState€v.€Smithóó,€735€€S.W.2d€859,€863€(Tenn.ÏCrim.€App.€1987).€€Although€a€òòde€novoóó€review€is€conducted€by€this€court,€the€trialÏcourtððs€determination€is€presumed€correct€on€appeal,€conditioned€upon€anÏaffirmative€showing€in€the€record€that€the€trial€court€properly€considered€relevantÏsentencing€principles.€€Tenn.€Code€Ann.€ðð€40„35„401(d)€(1990);€òòState€v.€Ashbyóó,Ï823€€S.W.2d€166,€169€(Tenn.€1991).€€In€the€present€case,€the€trial€court€properlyÏconsidered€such€principles.€€The€presumption€of€correctness€applies.€€Moreover,Ïthe€appellant€bears€the€burden€of€showing€that€the€sentence€imposed€by€the€trialÏcourt€is€improper.€€òòSeeóó€€Tenn.€Code€Ann.€ðð€40„35„210(b)(3)€(1990).ÌÌà@ àò òA.€€Presumption€Favoring€Alternative€Sentenceó óÌà àThe€appellant€first€challenges€the€trial€courtððs€decision€that€he€is€not€entitledÏto€the€statutory€presumption€that€he€is€a€favorable€candidate€for€alternativeÍsentencing.€€To€be€eligible€for€the€statutory€presumption,€three€requirements€mustÏbe€met.€€The€appellant€must€be€convicted€of€a€class€C,€D,€or€E€felony.€€Tenn.€CodeÏAnn.€ðð€40„35„102(6)€(1994€Supp.).€€He€must€be€sentenced€as€a€mitigated€orÏstandard€offender.€€òòIdóó.€€And,€the€defendant€must€not€fall€within€the€parameters€ofÏTenn.€Code€Ann.€ðð€40„35„102(5),€i.e.,€the€defendant€cannot€have€a€criminal€historyÏevincing€either€a€ð ðclear€disregard€for€the€laws€and€morals€of€societyðð€or€ð ðfailure€ofÏpast€efforts€at€rehabilitation.ðð€€òòIdóó.€€The€appellantððs€agreement€permitted€him€to€pleadÏguilty€to€the€lesser€offense€of€attempt€to€commit€aggravated€sexual€battery,€a€classÏC€felony.€€In€exchange€for€his€conviction€of€a€lesser€offense,€he€agreed€toÏclassification€as€a€range€II€offender,€even€though€he€had€no€prior€criminalÏconvictions.€The€appellant€claims€that,€contrary€to€his€plea€agreement,€he€is,€in€fact,Ïa€standard€offender.€€ÌÌà àWe€are€not€persuaded€by€the€appellantððs€argument€that€he€should€beÏpermitted€to€receive€the€benefit€of€the€bargain€he€has€chosen€while€rejecting€thatÏpart€which€displeases€him.€€Recently,€our€supreme€court€acknowledged€theÏlongstanding€principle€that€ð ða€defendant€can€waive€the€range€classification€as€partÏof€a€negotiated€guilty€plea,€to€sentences€in€cases€arising€under€the€new€Act.ðð€€òòStateÏv.€Hicksóó,€945€€S.W.2d€706,€708€(Tenn.€1997).€€The€court€held€that€such€a€sentenceÏis€valid€€"when€imposed€as€a€result€of€a€plea€bargain€agreement€entered€voluntarilyÏand€knowingly."€€òòIdóó.€€The€court€added€that,€"where€the€parties€negotiate€in€goodÏfaith€and€there€are€no€allegations€of€fraud€or€misfeasance,€the€parties€areÍprecluded€from€attacking€on€appeal€the€agreed€range€imposed€by€the€trial€court."€ÏòòIdóó.€at€708.€€Thus,€the€appellant's€knowing€and€voluntary€guilty€plea,€absent€anyÏevidence€of€fraud€or€bad€faith€on€behalf€of€the€State,€waived€any€right€of€theÏappellant€to€later€challenge€the€legality€of€the€sentence€imposed€by€the€trial€court.€ÏIn€other€words,€once€the€appellant€agreed€to€be€classified€as€a€range€II€offender,€heÏbecame€a€range€II€offender€for€all€purposes,€including€alternative€sentencing.€ÏHence,€as€a€range€II€offender,€the€appellant€is€not€presumed€to€be€a€favorableÏcandidate€for€alternative€sentencing.€€€òòSee,€e.g.óó,€òòState€v.€Grigsbyóó,€No.€02C01„9507„CR„00184€(Tenn.€Crim.€App.€at€Jackson,€Jan.€15,€1997);€òòState€v.€Wellsóó,€No.€03C01„9512„CC„00385€(Tenn.€Crim.€App.€at€Knoxville,€Nov.€27,€1996);€òòState€v.€Armstrongóó,ÏNo.€01C01„9503„CC„00097€(Tenn.€Crim.€App.€at€Nashville,€Nov.€16,€1995).€€ThisÏcontention€is€without€merit.ÌÌà@ àò òB.€€Denial€of€Alternative€Sentenceó óÌà à€Although€the€trial€court€strongly€accredited€the€appellantððs€lack€of€a€criminalÏrecord€and€the€appellantððs€favorable€employment€and€social€history,€the€court,€inÏdenying€any€form€of€alternative€sentencing,€found€that€the€results€of€theÏpsychological€report,€i.e.,€the€appellantððs€risk€of€reoffending,€his€long€history€of€thisÏtype€of€conduct,€his€unwillingness€to€accept€responsibility€for€his€conduct,€and€hisÏinability€to€honestly€disclose€his€sexual€offensive€behavior,€overwhelminglyÏindicate€that€ð ð[c]onfinement€is€necessary€to€protect€society€by€restraining€aÏdefendant€who€has€a€long€history€of€criminal€conduct.ðð€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„103(1)(A)€(1990).€€ÌÌà
