àLawrence€Loveless,€a€registered€nurse€employed€by€the€Cannon€County€Sheriff's€Department,Ð xÈ ×€€The€Appellantððs€use€of€his€medication€was€sporadic.€€He€would€often€refuse€to€take€theÐ Zª Ðmedication€for€"a€week€or€two€at€a€time."€€The€Appellantððs€refusals€to€be€medicated€coincided€withÐ @ Ðhis€scheduled€court€appearances.€€Additionally,€due€to€the€Appellant's€complaints€of€urinaryÐ &v Ðretention,€the€medications€were€often€changed.€€€Ð  \ Ðâ âÐ òB Ðà  àGerald€Ô_ÔMeltonÔ_Ô,€the€Public€Defender€for€the€Sixteenth€Judicial€District,€testified€that€he€wasÐ ° Ðâ âappointed€to€represent€the€Appellant€on€the€indicted€charges.€€Mr.€Ô_ÔMeltonÔ_Ô€stated€that€nothing€in€hisÐ –æ Ðnotes€made€during€his€representation€of€the€Appellant€reflected€that€the€Appellant€did€not€understandÐ |Ì Ðwhat€was€going€on.€€During€one€conversation,€however,€counsel€recalled€that€the€Appellant€advisedÐ b² Ðhim€that€"he€had€been€on€different€medications€at€some€point€in€time."€€Mr.€Ô_ÔMeltonÔ_Ô€admitted€that€heÐ H˜ Ðnever€asked€jail€personnel€whether€the€Appellant€was€in€fact€taking€any€medication.€€Concerned,Ð . ~ Ðhowever,€about€the€Appellant's€behavior€at€the€time€of€his€arrest€and€the€Appellantððs€self„reports,€Mr.Ð  d ÐÔ_ÔMeltonÔ_Ô€obtained€an€order€to€have€the€Appellant€evaluated€regarding€his€competency€to€stand€trial.€Ð ú J ÐIn€February€1998,€the€Appellant€was€evaluated€at€the€Guidance€Center.€€The€evaluation€revealed€thatÐ à 0 Ðthe€Appellant€was€competent€to€stand€trial,€that€he€could€understand€the€nature€of€the€charges€andÐ Æ   Ðthe€relative€roles€of€those€who€would€participate€in€the€case,€and€that€the€defense€of€insanity€couldÐ ¬ ü  Ðnot€be€supported.€€Moreover,€counsel€had€no€indication€during€his€conferences€with€the€AppellantÐ ’â  Ðthat€the€Appellant's€competency€was€in€question.€€Indeed,€during€conferences€with€counsel,€theÐ xÈ  ÐAppellant€clearly€recited€the€facts€regarding€his€charges€in€a€consistent€manner.€€The€Appellant'sÐ ^®  Ðrecitation€of€the€facts€never€altered.€€The€Appellant€indicated€that€he€understood€the€nature€of€theÐ D”  Ðcharges€against€him€and€the€penalties€that€he€might€receive.€€Moreover,€the€Appellant€activelyÐ *z  Ðparticipated€in€the€negotiation€process€regarding€plea€offers€with€the€State.׃×Ý ƒ #ÃÝòòÚ  Ú5Ú  ÚóóÝ  Ý×  ×€€Mr.€Ô_ÔMeltonÔ_Ô€concludedÐ ` Ðthat€"[he]€never€had€any€reason€to€doubt€[the€Appellant's]€ability€to€assist€me€in€his€representation.ððÐ öF ÐÌà  àTom€Woodson,€a€pharmacist,€testified€as€an€expert€on€behalf€of€the€Appellant€regarding€theÐ Â Ðuse€of€drugs€and€their€effects€on€the€human€body.€€Mr.€Woodson€explained€that€Ô_ÔParoxetineÔ_Ô,€alsoÐ ¨ø Ðknown€as€Ô_ÔPaxilÔ_Ô,€is€ð ðan€antidepressant€used€to€treat€depression,€obsessive€compulsive€disorder€andÐ ŽÞ Ðpanic€disorder.ðð€€Ô_ÔParoxetineÔ_Ô€"would€actually€free€up€serotonin€in€the€body.€€Serotonin€works€as€aÐ tÄ Ðmediator€of€sleep,€helps€in€sensory€perception,€and€actually€promotes€an€overall€feeling€of€well„beingÐ Zª Ðin€a€person."€€Mr.€Woodson€further€stated€that€someone€under€the€prescription€of€Ô_ÔParoxetineÔ_Ô€ð ðmayÐ @ Ðexperience€excitability€or€sedation.ðð€€€An€individual€sporadically€using€Ô_ÔParoxetineÔ_Ô€ð ðwould€notÐ &v Ðreceive€the€optimal€effect€of€the€drug€and€would€probably€lapse€back€in€the€baseline.ðð€€The€purposeÐ  \ Ðbehind€the€drug€is€to€ð ðenhance€the€feeling€of€well„being€in€the€patient.ðð€€Ô_ÔRisperidoneÔ_Ô€is€used€as€anÐ òB Ðanti„psychotic€to€treat€the€symptoms€of€schizophrenia.€€Like€Ô_ÔParoxetineÔ_Ô,€this€drug€also€ð ðworks€toÐ Ø( Ðenhance€a€person's€sense€of€well€being€and€should€be€taken€on€a€regular€basis.ðð€€Mr.€WoodsonÐ ¾ Ðexplained€that€ð ðextensive€use€of€Ô_ÔRisperidoneÔ_Ô€could€result€in€symptoms€similar€to€those€occurring€inÐ ¤ô Ðpatients€with€Parkinson's€Disease.ðð€€€€Woodson€testified€that€Ô_ÔParoxetineÔ_Ô€and€Ô_ÔRisperidoneÔ_Ô€wereÐ Š Ú Ðcommonly€taken€simultaneously€and€that€a€person€taking€both€prescriptions€ð ÐÌà  àThe€written€statement€of€Esther€Lack,€Chief€Jailer€for€Cannon€County,€was€admitted€intoÐ "$r# Ðevidence€by€stipulation.€€€Ms.€Lackððs€statement€provided€that,€during€the€Appellantððs€period€ofÐ %X $ Ðconfinement,€she€observed€what€she€considered€as€unusual€behavior,€specifically€that€the€AppellantÐ ° Ðtalked€to€himself,€that€he€talked€to€his€dead€mother,€that€he€pulled€out€his€hair,€and€generally,€she€wasÐ –æ Ðof€the€opinion,€that€ð ðhe€had€gone€off€the€deep€end.ððÐ |Ì ÐÌà  àThe€Appellant,€regarding€his€overall€health€in€1997„1998,€testified€that€he€was€"in€pretty€badÐ H˜ Ðshape€because€[he€didn't]€remember."€€The€Appellant€explained€that€because€he€was€on€medicationÐ . ~ Ðduring€this€period€of€time€he€could€not€recall€meeting€with€defense€counsel.€€Although€he€could€notÐ  d Ðenumerate€the€specific€medications€that€he€was€prescribed,€he€testified€that€the€medication€resultedÐ ú J Ðin€his€loss€of€memory.€€In€fact,€the€Appellant€maintained€that€he€could€not€recall€any€specificsÐ à 0 Ðconcerning€the€preparation€of€his€case€and€his€resulting€guilty€pleas.€€The€Appellant€stated,€ð ðI€wouldÐ Æ   Ðlike€the€opportunity€to€start€over€where€Iððm€aware€of€whatððs€going€on€and€be€able€to€make€a€rationalÐ ¬ ü  Ðdecision€about€my€life.ðð€€In€response€to€questioning€by€the€court,€the€Appellant€admitted€that,€withinÐ ’â  Ðthe€three„day€period€prior€to€his€arrest,€he€ingested€ð ðÔ_ÔXanaxÔ_Ô,€I€had€a€hit€of€blotter,€hit€of€microdot,€IÐ xÈ  Ðtook€it.ðð€€He€also€conceded€that€he€had€ingested€a€bottle€of€pills€which€he€had€taken€from€his€wife,Ð ^®  Ðalthough€he€did€not€know€what€they€were.€€The€Appellant€stated€that,€after€taking€the€pills,€he€didÐ D”  Ðnot€know€where€he€was€until€he€ð ðwoke€up€strapped€downðð€at€the€Mental€Health€Center€in€Nashville.€Ð *z  ÐHe€recalled€that€this€was€shortly€after€his€arrest.€€The€Appellant€stated€that€he€had€only€vagueÐ ` Ðrecollections€of€the€year€spent€in€confinement€prior€to€his€guilty€plea.€Ð öF ÐÌà  àIn€denying€the€Appellant€relief,€the€post„conviction€court€found€in€its€written€order:Ð Â Ðà8  àMr.€Floydððs€assertion€that€his€plea€was€involuntary€because€of€the€medication€that€heÐ ¨ø Ðwas€taking€is€also€dismissed.€€The€Petitioner€in€a€Post€Conviction€Relief€Petition€hasÐ ŽÞ Ðthe€burden€of€establishing€his€assertions€by€clear€and€convincing€evidence.€€This€isÐ tÄ Ðnot€done€by€Mr.€Floyd.€€The€only€proof€that€Mr.€Floyd€advances€is€that€he€does€notÐ Zª Ðremember€the€events€up€to€the€plea.€€The€record€and€evidence€show€that€a€mentalÐ @ Ðevaluation€was€completed€February€3,€1998,€and€that€the€plea€was€entered€on€AprilÐ &v Ð28,€1998.€€The€report€of€the€mental€evaluation€.€.€.€determined€that€the€Defendant€wasÐ  \ Ðð ðcapable€of€defending€himself€in€a€court€of€law€and€that€he€understands€the€chargesÐ òB Ðpending€against€him€and€the€consequences€of€those€charges.ðð€€This€report€furtherÐ Ø( Ðadvises€that€the€Defendant€ð ðcan€advise€and€participate€in€his€own€defense.ðð€€TheÐ ¾ Ðmedical€records€of€the€Cannon€County€Jail€.€.€.€evidence€that€upon€Mr.€Floydððs€arrestÐ ¤ô Ðin€May€of€1997,€that€he€exhibited€certain€antisocial€behavior€which€was€explained€byÐ Š Ú Ðhis€arrest€on€these€serious€charges€and€his€admitted€Ô_ÔoverdosageÔ_Ô€of€prescription€drugsÐ p!À  Ðshortly€before€that€arrest.€€This€record€demonstrates€that€some€dosages€of€Ô_ÔParoxetineÔ_ÔÐ V"¦!
