Theappellantpledguiltytopossessionofover70poundsofmarijuana.Underspecialconditions,thejudgmentstates [t]heCourtsrulingsonpretrialmotionsarecetified[sic]forappealasdispositive.ItisunderstoodthatthedefendantwillfileanoticeofappealandreceiveahearingonthemeritsoftheappealintheCourtofCriminalAppeals.Thejudgmentissignedbythetrialjudgeandbytheattorneyforthestate.Therearetwopretrialorders.Oneorderoverrulesamotiontoinquirewhethercircumstancesexistwhichwouldcreatetheappearancethatthecourtwasnotimpartial,andtheotherorderdeniestheappellantsmotiontosuppress.Nospecificissuesregardingthesuppressionaresetforthintheorder.  InStatev.Preston,759S.W.2d647(Tenn.1988),ourSupremeCourtheld:8 Regardlessofwhathasappearedinpriorpetitions,orders,colloquyinopencourtorotherwise,thefinalorderorjudgmentfromwhichthetimebeginstoruntopursueaT.R.A.P.3appealmustcontainastatementofthedispositivecertifiedquestionoflawreservedbydefendantforappellatereviewandthequestionoflawmustbestatedsoastoclearlyidentifythescopeandthelimitsofthelegalissuereserved.Id.at650.Seealso,Statev.Pendergrass,937S.W.2d834,83738(Tenn.1996).ItappearsthatourSupremeCourtrelaxedthePrestonrequirementstosomeextentbyallowingacertifiedquestiontobeincorporatedinanindependentdocument.SeeStatev.Irwin,962S.W.2d477,479(Tenn.1998).  Initsmotiontodismiss,thestatecontendsthattheappellanthasfailedtocomplywithanyoftherequirementssetforthinPreston.ThisconclusorystatementisϜoverbroad.Itisclearthatthepretrialorderswereincorporatedinthejudgmentandthatthetrialcourtandtheattorneyforthestate,bytheirsignatures,consentedtothereservationoftheissuesraisedinthoseordersandbelievedtheissuestobedispositiveofthecase.However,a questionoflawmustbestatedsoastoclearlyidentifythescopeandthelimitsofthelegalissuereserved.Preston,759S.W.2d647,650.Here,theissuesarenotclearlystatedinthejudgmentorinthepretrialorders.Moreover,weareunabletodeterminehowtheissueofwhetherthetrialcourterredbydenyingamotiontorecusehimselfinthiscasecouldbedispositive.
