TheAppellanthaspreviouslypresentedapetitionforpostconvictionrelieftothetrialcourt,whichwasdenied.Heunsuccessfullyappealedthisdenialtoourcourt.DarnellGentryv.State,No.02C019304CC00052,GibsonCounty(Tenn.Crim.App.,Jackson,filedJun.29,1994).TheissueinthecasesubjudicewasarguedintheAppellantspostconvictionappeal.ThiscourtheldthatAppellantssentencewasnotanillegalsentence.OursupremecourtdeniedtheAppellantsapplicationtoappealthisdecisiononOctober3,1994. Whenanissueisdeterminedinapriorappealinthesamecase,thedecisionbecomesthelawofthecase,precludingtheissuesrelitigation,solongasthepriordecisionisnotclearlyerroneous.Statev.Delk,692S.W.2d431,438(Tenn.Crim.App.1985). Weagreewiththepriorholdingofthiscourt.Thiscourtstated:    `    Inhisfinalissue,appellantcontendsthathissentenceof40yearsisanillegalsentencebecauseitisoutsidetherangeofpunishmentforaRangeIoffenderconvictedofaClassAfelony.ThepresentcaseissimilartothatofStatev.Terry,755S.W.2d854(Tenn.Crim.App.1988),inwhichthedefendantwassentencedto10yearsasaRangeIoffenderforkidnapping.Atthattime,aRangeIoffendercouldreceive2to6yearsfortheoffenseofkidnapping.ThisCourtheldthatthe10yearsentence,whichwaswithinthepossiblestatutorypenaltyforkidnappingwasnotillegal.Wefurtherheldthatanyirregularityastoclassificationorreleaseeligibilitywaswaivedbyaknowingandvoluntarypleaofguilty.Terry,755S.W.2dat855. Inthepresentcase,appellantenteredintoapleabargainagreementfora40yearsentenceasaRangeIoffender.SeconddegreemurderisaClassAoffenseandthepossiblerangeofpunishmentis15to60years.T.C.A.4035111(b)(1).RangeIforaClassAoffenseis15to25years.T.C.A.4035112(a)(1).AsinTerry,thesentenceappellantreceivedisnotillegal,butrather,fallswithinthepermissiblestatutoryrangeofpunishment.Furthermore,anyirregularityastoclassificationwaswaivedbyappellantsguiltyplea.Thisissueiswithoutmerit.       Gentry,No.02C019304CC00052,slip.op.at67.Thiscourtspriordecisionisnotclearlyerroneousasitissupportedbypriorcourtdecisions.
