Ðdefendant€testified€that€after€the€incident,€he€was€treated€at€the€hospital€for€his€injuries.€€He€said€thatÐ °"  Ðhe€and€his€father€then€went€to€Virginia.€€Ð  #ð! ÐÌà  àThe€defendantððs€father,€Lester€A.€Giles,€Jr.,€corroborated€the€defendantððs€testimony.€€Mr.Ð €%Ð # ÐGiles€testified€that€when€he€went€down€to€the€parking€lot€to€check€on€his€son,€who€had€already€beenÐ p&À!$ Ðinjured,€Susan€Dodge€and€apparently€others€were€screaming€ð ðBaby€raper.ðð€€Mr.€Caylor€told€Mr.Ð `'°"% ÐGiles,€ð ðIððll€kill€you[,]€too.ðð€€Further,€Mr.€Giles€testified€that€he€and€his€son€had€been€to€the€Bi„Lo€Ð P( #& Ðgrocery€store€the€previous€day€and,€as€they€reached€the€store€entrance,€a€black€car€driven€by€Mr.Ð ° ÐCaylor€stopped€beside€them.€€Ms.€Dodge,€the€passenger€in€the€car,€rolled€down€her€window,Ð  ð Ðð ðholleredðð€at€them,€ð ðAre€you€nervous€yet?ðð€and€then€began€laughing€as€she€rolled€up€the€windowÐ à Ðand€the€car€drove€off.Ð €Ð Ѐ€ò òó óÐ pÀ Ðà  àThe€trial€court€noted€the€divergent€testimony€but,€unfortunately,€did€not€make€a€credibilityÐ ` ° Ðdetermination.€€Essentially,€it€concluded€that€whether€the€defendantððs€testimony€or€Ms.€DodgeððsÐ P   Ðtestimony€was€believed,€the€evidence€showed€that€the€defendant€made€contact€with€the€victimððsÐ @  Ðfamily€in€violation€of€the€probation€order.€€The€court€noted€that,€with€respect€to€the€defendantððsÐ 0 € Ðtestimony,€the€defendant€should€not€have€left€his€hotel€room€and€hit€Mr.€Caylor.€€With€respect€to€Ms.Ð  p  ÐDodgeððs€testimony,€the€court€noted€that€the€defendant€should€not€have€approached€Ms.€Dodge€andÐ `  ÐMr.€Caylor€at€the€restaurant.Ð P  ÐÌà  àThe€decision€to€revoke€probation€is€within€the€discretion€of€the€trial€court.€€òòSeeóó€òòState€v.€Grearóó,Ð à0  Ð568€S.W.2d€285,€286€(Tenn.€1978).€€Upon€revoking€probation,€the€trial€court€has€the€discretion€toÐ Ð  Ðorder€the€original€sentence€to€be€served.€€òòSeeóó€Tenn.€Code€Ann.€ðððð€40„35„310,€„311(d).ò òó ó€€An€abuse€ofÐ À Ðdiscretion€may€be€found€only€if€the€record€contains€no€substantial€evidence€to€support€the€conclusionÐ ° Ðof€the€trial€court.€€òòSeeóó€òòState€v.€Harkinsóó,€811€S.W.2d€79,€82€(Tenn.€1991).€€Ð  ð Ðà  àÌà  àWith€respect€to€the€defendantððs€testimony,€the€trial€court€stated€that€revocation€was€properÐ €Ð Ðbecause€the€defendant€ð ðwent€over€and€hit€Don€Caylor€when€he€got€mad€at€him€down€there.ðð€Ð pÀ ÐHowever,€the€defendantððs€testimony€shows€that€when€he€went€downstairs€to€check€on€his€car,€Mr.Ð `° ÐCaylor,€who€did€not€testify,€threw€a€shot€glass€at€him.€€When€the€defendant€tried€to€go€upstairs€to€callÐ P  Ðthe€police,€Mr.€Caylor€prevented€him€from€leaving€and€raised€his€fists.€€The€defendantððs€testimonyÐ @ Ðshows€that€his€striking€Mr.€Caylor€was€not€out€of€anger€but€rather€necessity.€€Although€we€agree€withÐ 0€ Ðthe€trial€court€that€it€may€have€been€wiser€for€the€defendant€to€have€remained€in€his€hotel€roomÐ  p Ðinstead€of€going€outside,€we€believe€that€the€defendantððs€purpose€was€to€check€on€his€car,€which€heÐ ` Ðhad€a€right€to€do,€and€that€he€could€have€done€so€without€having€contact€with€the€victimððs€family.€Ð P ÐWe€do€not€believe€that€the€defendantððs€attempts€to€defend€himself€in€the€midst€of€an€attack€constituteÐ ð@ Ðthe€type€of€contact€sufficient€to€justify€a€probation€revocation.Ð à0 ÐÌà  àIf€€Ms.€Dodgeððs€testimony€is€believed,€the€defendant€approached€her€and€began€yelling€at€her.€Ð À! ÐMr.€Caylor€then€yelled€at€the€defendant,€the€defendant€approached,€and€a€fight€ensued.€€We€agreeÐ °"  Ðthat€approaching€and€yelling€at€Ms.€Dodge€was€inappropriate,€although€we€note€that€she€was€notÐ  #ð!
