KatherineBurnstestifiedthatduringthelatehoursofApril18,1997,sheheardacarpullintoherdriveway.Shestatedthatshelookedoutthewindowandsawthecarsittinginthedrivewaywithitslightsonandthemotorrunning.Shesaidthatshewaitedapproximatelyfifteenminutesforsomeonetocometothedoorandthencalled911.Shetestifiedthatanofficerarrivedapproximatelyfifteenminuteslater.Shestatedthattheofficerhadtohelpthedefendantoutofthecar.Shetestifiedthatsheheardtheofficeraskthedefendantifheknewwherehewasandthedefendantreplied, No.Shesaidthatshehadnotinvitedthedefendantoranyoneelsetoherhome.Ms.Burnsbelievedthedefendantwasintoxicatedbecausetheofficerhadtohelpthedefendantoutofthecarandbecausethedefendantsspeechwasslurred. OfficerGeraldGibsonoftheHawkinsCountySheriffsDepartmenttestifiedthatherespondedtoMs.Burnscallatapproximately11:10p.m.Hesaidthatwhenhearrived,a1981goldToyotacarwassittinginthedrivewayoftheBurnsresidencewiththeemergencybrakeonandtheenginerunning.Hestatedthathewalkeduptothecarandsawthedefendantslumpedoverthesteeringwheel.Hesaidheknockedonthewindow,butthedefendantdidnotrespond.OfficerGibsontestifiedthathethenopenedthedoorandshookthedefendant,butthedefendantdidnot 706 respond.Hesaidthathereachedintothecar,turnedofftheignition,andturnedofftheheadlights.Hestatedthatthedefendantawoke,andheaskedhimtogetoutofthecar.OfficerGibsontestifiedthatthedefendantmumbled,grumbledandrefusedtogetoutofthecar.Hesaidthathehadtoreachintothecar,grabthedefendantbythearmandpullhimoutofthecar. OfficerGibsontestifiedthatoncethedefendantwasoutsidethecar,heaskedthedefendanthisnameandaskedforidentification.Hesaidthatthedefendantrefusedtotellhimhisname.Hetestifiedthatthedefendantwasunstableonhisfeetandcouldnotstandbyhimself.OfficerGibsontestifiedthatheaskedthedefendantifheknewwherehewas,andthedefendantrespondedthatheneededtospeaktoadetectivebecausehehadbeenkidnappedbythepeoplewhohadkilledamanandwomaninGreenevilleandhadgottenoutofjail.Hesaidthatthedefendanttoldhimthatthepeoplehadforcedhimtodrinkbloodandalcoholandtakepills.OfficerGibsonaskedthedefendanthowthemurderersgotoutofjailandkidnappedhim,andthedefendanthadnoresponse.Hestatedthatthedefendantknewthathewasinadrivewaybutdidnotknowwhoseanddidnotknowthenameoftheroad. OfficerGibsonstatedthathesmelledastrongodorofalcoholonthedefendant.Healsostatedthatthedefendantsspeechwasslurred,hiseyeswerebloodshot,andhishairandclotheswereindisarray.OfficerGibsontestifiedthatwhenheaskedthedefendanttowalktothepolicecar,ascufflebetweenhimandthedefendanttookplace.Hesaidthathethenarrestedthedefendantfordrivingundertheinfluenceandtookthedefendanttothesheriffsdepartment.Hestatedthathedidnotconductanyfieldsobrietytestsbecausethedefendantwasuncooperative.Officer 704  :  Gibsontestifiedthatwhentheyarrivedatthesheriffsdepartment,thedefendantrefusedtotakeabreathalyzertestandrefusedtosignformsreflectingthatherefused :   :  totakethetest.OfficerGibsontestifiedthattherewasnoindicationthatthedefendant :   :  hadbeenkidnapped. JasonBrake,formerlyajailerfortheHawkinsCountySheriffsDepartment,testifiedthatthedefendantwasunsteadyonhisfeetatthejail.Hesaidthathesmelledastrongodorofalcoholonthedefendantandthatthedefendantseyeswerebloodshotandhisspeechwasslurred.JailerBrakebelievedthatthedefendantwashighlyintoxicated.HesaidthatthedefendanttoldhimthatvampirealiensfromKentuckyhadabductedhimfromhishome,forcedhimtodrivehiscarforthem,andforcedhimtodrinkbloodbeforeleavinghimatanunknownresidence.Hestatedthatatthedefendantsrequest,hefiledacomplaintonthedefendantsbehalf.JailerBrakebelievedthedefendantsclaimstobeludicrous,andhesaidthatnoinvestigationofhisclaimstookplace. Thedefendanttestifiedthathehadnotdrunkanythingonthedayoftheoffenseandthathesmelledlikebeerbecausehehadbeenpickingupbeercansfrom8:00a.m.to7:00p.m.Hesaidthatwhenhereturnedhome,twomenwalkeduptohimandhisson,askedhissonforacigarette,pulledagunonthem,andsaid, Letsgo.HestatedthatthemenforcedhimandhissonintothedefendantscarandforcedhimtodrivetoMorristownandtobuybeerandliquor.Thedefendantsaidthatthemenforcedhimtodrinkbeer,takepills,anddrinksomethingthatwasred,althoughhewasunsurewhetheritwasblood.Thedefendantstatedthathewasafraidthatthemenwouldshoothimandhisson.Hesaidthathepulledintoadrivewayaftertellingthementhathischestwashurtingbecausehehadhighbloodpressure.Hetestifiedthatoneofthemenhithimintheheadwiththegun,causinghimtobecomeunconscious. 704 HesaidthathecouldnotrememberanythingfromthatpointuntilOfficerGibsonawakenedhim.Hestatedthathedidnotknowhowlonghehadbeenpassedoutorwherehewas.ThedefendanttestifiedthathetriedtotellOfficerGibsonwhathadhappened,butOfficerGibsonwouldnotlisten.HesaidthatOfficerGibsonwasconfusedaboutwhothedefendanthadsaidhadkidnappedhimandthathetriedtoexplain.Oncrossexamination,thedefendanttestifiedthatwhenhepulledintothedriveway,hissongotoutofthecarandranawayasthemenfiredshots.Hesaidthathedidnottellthepolicethathissonhadbeenkidnappedbecausehissonhadbeenabletoescape. ClaytonByington,thedefendantsson,testifiedthathecouldnotrememberwherehewasorwhetherhewaswiththedefendantonApril18,1997.Hesaidthathedidoesnotrememberanythingaboutthatday.Heconcededthathehaddiscussedthecasewiththedefenseattorneyandhadtoldhimastorysimilartothedefendantsversionofthefacts.Oncrossexamination,Mr.Byingtonadmittedthathehadnotbeenkidnapped.Hesaidthathehadtoldtheofficersthathewasnotgoingtolieforthedefendant.@ D I.SUFFICIENCYOFTHEEVIDENCE  (!$  ThedefendantcontendsthattheevidenceisinsufficienttosupporthisconvictioninthatthestatefailedtodisprovethetestimonyofthedefendantrecountinghowhehadbeenkidnappedandleftinMs.Burnsdriveway.Ourstandardofreviewwhenthesufficiencyoftheevidenceisquestionedonappealis"whether,afterviewingtheevidenceinthelightmostfavorabletotheprosecution,anyrationaltrieroffact (2 +. couldhavefoundtheessentialelementsofthecrimebeyondareasonabledoubt."Jacksonv.Virginia,443U.S.307,319,99S.Ct.2781,2789(1979).Thismeansthat 5.2 wedonotreweightheevidence,butpresumethatthejuryhasresolvedallconflictsin 704 thetestimonyanddrawnallreasonableinferencesfromtheevidenceinfavorofthestate.SeeStatev.Sheffield,676S.W.2d542,547(Tenn.1984);Statev.Cabbage, 42,+0 571S.W.2d832,835(Tenn.1978).Underthisstandard,weholdthattheevidenceissufficienttoconvictthedefendantofdrivingundertheinfluence,secondoffense. 706 @(((D II.SENTENCING    Thedefendantcontendsthatthetrialcourterredinitsapplicationofenhancementandmitigatingfactorsandthatthetrialcourtimposedanexcessivesentence.Healsoarguesthatthetrialcourterredbydenyingprobation.Thestaterespondsthatthetrialcourtproperlysentencedthedefendant.Weagree. Thepresentencereportreflectsthatthethenfortyfouryearolddefendantdroppedoutofhighschoolaftercompletingthetenthgrade.Thedefendanthasapriorcriminalhistoryconsistingofaconvictionfordrivingundertheinfluenceandfourconvictionsforpublicintoxication.Thedefendantreportedthathehadabusedalcoholforthirtyfouryears.Thepresentencereportreflectsthatthedefendantwasunemployedandwasdisabledduetoproblemswithhisheart,bloodpressureandnerves. Insentencingthedefendant,thetrialcourtconsideredthedefendantspriorcriminalhistory,notingthatthedefendanthadfourpriorconvictionsforpublicintoxication.SeeT.C.A.4035114(1).Itfoundnomitigatingfactorsapplicable.It #  saidthatenhancementfactor(1)wasgivengreaterweightbecauseitfoundthatthedefendantstestimonywasuntruthfulandthatthedefendanthadattemptedtohavehissontestifyfalsely.Thetrialcourtstatedthatitdeniedprobationbecauseofthedefendantspriorcriminalhistory,hishistoryofalcoholabuse,hispooremploymentrecord,andhisblatantlyfalsetestimony.Thecourtconsideredthesentencingpurposesandprinciples. Appellatereviewofsentencingisdenovoontherecordwitha 42,+0 presumptionthatthetrialcourtsdeterminationsarecorrect.T.C.A.4035401(d)and402(d).The presumptionofcorrectnesswhichaccompaniesthetrialcourtsactionisconditionedupontheaffirmativeshowingintherecordthatthetrialcourt 706  †TR[A' Legal[A' LegalA' LegalA' LegalT   †TR[A' Legal[A' LegalA' LegalA' LegalT  consideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.  Ashby,823S.W.2d166,169(Tenn.1991).AstheSentencingCommissionComments  toT.C.A.4035401(d)and402(d)note,theburdenisnowontheappealingpartytoshowthatthesentencingisimproper.Wenotethatthereisnopresumptiveminimumsentenceprovidedbylawformisdemeanorsentencing.See,e.g.,Statev.Creasy,885 80 S.W.2d829,832(Tenn.Crim.App.1994).However,thesentencemustcomplywiththemisdemeanorsentencingrequirementsoftheCriminalSentencingReformActof1989.SeeStatev.Palmer,902S.W.2d391,393(Tenn.1995).    Inthiscase,therecorddemonstratesthatthetrialcourtfollowedtherequirementsoftheSentencingActandexercisedsolidjudgmentinitsdeterminations.Thedefendanthasfailedtoshowthatthesentenceimposedbythetrialcourtisimproper.
