Thedefendantwasarrestedfordrivingwhileintoxicated(DUI)onFebruary20,1994.Whileatthepolicestation,herefusedtotakeabloodorbreathalcoholtesteventhoughtheofficeradvisedhimofthepossibleconsequencesofrefusal.TheDUIchargewasfirsttriedinthegeneralsessionscourtandresultedinaguiltyverdict.Ondenovoappealbeforethetrialjudgeinthecircuitcourt,thedefendantwasfoundnotguiltyofDUI.Thetrialjudgedid,however,enteranorderfindingthedefendantinviolationoftheimpliedconsentlawandsuspendedhisdriver'slicenseforsixmonths.Thedefendantfiledamotioninarrestofjudgment,claimingthatthestatefailedtogivehimnoticeofintenttosuspendhislicenseforviolationoftheimpliedconsentlaw.Inresponse,thestatearguedthattheaffidavitontheDUIarrestwarrant,providingthatthedefendantrefusedthetestafterbeingwarnedoftheconsequences,servedaspropernotice.Thetrialjudgedeniedrelief.  Thedefendantcontendsthatthestatefailedtogivehimpropernoticeofintenttosuspendhisdriver'slicenseandthatthecircuitcourthadnojurisdictiontofindanyviolationoftheimpliedconsentlawbecausetheissuewasnotraisedinthedenovoappeal.Thestateconcedesthatthedefendantneverreceivedpropernoticeofintenttosuspendthedefendant'slicenseandthereforetheconvictionisinvalid.  Section5510406oftheTennesseeCodeAnnotatedgiveslawenforcementofficialstherighttorequireabloodorbreathalcoholtesttoanyonearrestedfordrivingundertheinfluence.Ifadefendantfailstosubmittosuchatestafterbeinginformedofthepotentialconsequencesofarefusal,thestatemaytakeactiontosuspendthedefendant'sdriver'slicenseforsixmonths. N   כTenn.CodeAnn.5510406(a)(3).Subsection(a)(3)statesthatthedeterminationofaviolationoftheimpliedconsentlawshallbemadeatthesametimeandbythesamecourtthatdisposesoftheoriginalarrestingoffense;however,thecodeclearlystatesthatviolationoftheimpliedconsentlawisnotacriminaloffense.Id.  Tenn.CodeAnn.5510406(c)providesasfollows:8 8 Priortosuspendingthelicenseofanypersonasauthorizedinthissection,thedepartmentshallnotifythelicenseeinwritingoftheproposedsuspension,anduponrequest,shallaffordthepersonanopportunityforahearing....Here,thedefendantwasnotgivennoticethatthestateintendedtosuspendhislicense.Whilethefactualsummaryinthearrestwarrantmayhavenotedthedefendant'srefusaltosubmittothetest,thestat% I utedefiningpropernoticeclearlystatesthatthestate"shallnotifythelicenseeinwritingoftheproposedsuspension."Alessernoticeoftheviolationisnotsufficientundertheplainreadingofthestatute.  Therecordisvoidofanynoticegiventothedefendantthatthestateintendedtosuspendhislicenseforviolationoftheimpliedconsentlaw.Thegeneralsessionscourtlimiteditsrulingasfollows:"Afterreviewofalltheevidenceandtheargumentsofcounsel,thecourtisoftheopinionthatthedefendantisguiltyofdrivingundertheinfluence."Implicitinthisrulingisthatthestatedidnotpursuetheissueofviolationofimpliedconsentduringitsoriginalprosecutionofthedefendant.Thesefactssupportthestate'sconcessionthatthedefendantdidnotreceivepropernoticeofapendingdriver'slicensesuspensionunderTenn.CodeAnn.5510406(c).Becausethedefendantneverreceivedsufficientnoticeoftheintenttosuspend,theissueofwhetherthecircuitcourthadjurisdictionovertheimpliedconsentviolationismoot.
