InSeptember1990,thedefendantwasconvicted,uponhisguiltypleas,oftwochargesofthesaleofcocaine.Hereceivedconcurrenteightyearsentencestobeservedonprobation.InOctober1992,thedefendantsprobationwasrevokedandhewasplacedinthecommunitycorrectionsprogram.Therecordreflectsthatonthesamedatehewassentencedforanothercocainesaleoffensetoeightyearsinthecommunitycorrectionsprogram.InJuly1994,thedefendantwaschargedinfourmorecocainerelatedcases,andpursuanttoanagreement,hewasconvicteduponhispleaofguiltytooneoffenseofsaleofaScheduleIIsubstanceandhereceivedatenyearsentenceconcurrentwithhisformersentences.Atthesametime,anorderwasenteredrevokinghiscommunitycorrectionssentencesandorderingthatthesentencesbeservedincustodyconcurrentlywiththenewtenyearsentence.InSeptember1995,thedefendantwasplacedonprobationbytheDepartmentofCorrectionpursuanttoitsbootcampprogram. OnMarch26,1996,aprobationviolationreport,affidavitandwarrantwerefiledallegingprobationviolationswithregardtotheDepartmentofCorrectionprobationorder.Theprobationofficer,GaryHammer,testifiedthatthegroundsforrevocationwerefailuretoreportandcurfewviolations.HesaidthatthedefendanthadnotreportedsinceMarch6,althoughhehadadvisedthedefendantnumeroustimesoftheobligationtoreport.Mr.Hammeralsotestifiedthatthedefendanthadan8:00p.m.curfewbutwasnotpresentathishomeonsixteenoccasionsinJanuary,February,MarchandAprilwhenhehadgonetothedefendantshome.Mr.Hammerstatedthatthedefendantsaidthatheoftenstoppedafterworkathisgrandmothershousetohavedinner. Thedefendanttestifiedthathecouldnotreportat6:00a.m.twiceaweekasrequiredbyMr.Hammerbecausehehadnopersonaltransportation.HesaidthathetoldMr.Hammerabouthisproblem,butMr.Hammersaidthathestillhadtoreport.Also,hewasnotabletobehomeby8:00p.m.becauseofwork.However,healsoacknowledgedthathehadgonetohisgrandmothershouse.Inrebuttal,Mr.Hammertestifiedthathewasawareofthedefendantsworkscheduleandnevercheckedhishomeuntil8:15p.m.orafterwards. Thetrialcourtnotedthedefendantshistoryinthesecases.Itfoundthatthedefendanthadviolatedtheconditionsofhisprobationrelativetothereportingandcurfewrequirements.Itconcludedthat,giventhedefendantshistory,theviolationconstitutedwillfuldisobediencetotheconditions.Itrevokedthedefendantsprobation. Thedefendantcontendsthathissubstantialcompliancewiththe importantthings,suchasnotusingorsellingdrugsandworking,warrantaconclusionthattheviolationsdidnotrisetothelevelofjustifyingfullrevocationofprobation. Itiswithinthetrialcourtsdiscretiontorevokethedefendantsprobationifitfindsbyapreponderanceoftheevidencethatthedefendanthasviolatedaconditionofthatprobation.T.C.A.4035310and311(d);Statev.Mitchell,810S.W.2d733,735(Tenn.Crim.App.1991).Foranappellatecourttofindanabuseofdiscretionandreverseatrialcourtsrevocationofprobation,itmustbedemonstratedthattherecordcontainsnosubstantialevidencetosupporttheconclusionofthetrialcourtthataviolationoftheconditionsofprobationhasoccurred.SeeStatev.Delp,614S.W.2d395,398(Tenn.Crim.App.1980). Inthepresentcase,thedefendantadmittedthathedidnotcomplywithalltheconditionsofhisprobation.Thetrialcourtattachedsignificancetothisbecauseofthedefendantspriorviolationsofearlierconditionsforreleaseinthecommunity.Suchwasjustifiedundertheevidence.Webelievethattherecordreflectsthatthetrialcourtmadeaconscientiousandintelligentjudgmenttorevokeprobationundertheevidence.SeeStatev.Harkins,811S.W.2d79,82(Tenn.1991).Thejudgmentofthetrialcourtisaffirmed.      ___________________________      JosephM.Tipton,JudgeCONCUR:_________________________JohnH.Peay,Judge_________________________DavidH.Welles,Judge
