H   LieutenantTomLanefromtheDicksonCountyJailtestifiedthatheoversawjailoperations.   HeacknowledgedthatonJuly13,1999,hetookcustodyofanenvelopethatcontainedagreenpill   andaletter.Hesaidthathewasfamiliarwiththedefendantshandwritingandthatthedefendant  wrotetheletter.HesaidthatonJuly17,jailofficerssearchedtheDicksonCountyJailwithadrug  dogbutfoundnodrugs.Hesaidthatthedefendantscellmate,JodieCole,toldjailofficersthatthe  defendanthadgivenMr.Coledrugstoholdduringthesearch.Anincidentreportthenwas l introducedintoevidence.Accordingtothereport,JodieColeaccusedthedefendantofassaulting X  himafterthepillsMr.Colehadbeenholdingforthedefendantturnedupmissing.LieutenantLane D! saidthatitwaseasyforinmatestohidedrugsandthatinmatescouldholdmedicineintheirmouths 0"  withoutswallowingit.HesaidthatthedefendanthadnorighttohaveClonazepaminhisjailcell #l! onJuly13. $X"   Oncrossexamination,LieutenantLanetestifiedthathehadnoknowledgeofthedefendant %0!$ notswallowingClonazepampillsandthatheneversawthedefendantpassClonazepamtoanother &"% inmate.Hesaidthatalthoughthedefendanthadthenickname Baldhead,thedefendanthadnever '#& senthimanycorrespondencesignedwiththatnameor BH.Heacknowledgedthatheneverasked (#' thedistrictattorneytoprosecuteRebeccaJacksonorRonaldHasleyforpassingClonazepam. )$(   |*%)   ThedefensecalledCaptainMackBruce,theChiefJailerattheDicksonCountySheriffs   Department,whotestifiedthatfromApriltoAugust1999,anursewasnotonstafftodispense  medicinetojailinmates.Hesaidhehadnoknowledgeofthedefendantholdingapillinhismouth  andnotswallowingit.Hesaidthatduringasearchofthejailcells,hedidnotfindanydrugsthat t couldbeattributedtothedefendant. `   Oncrossexamination,CaptainBrucetestifiedthathewasfamiliarwiththedefendants 8  handwritingandthatthedefendantwrotetheJuly13letter.Heacknowledgedthattherewereplenty $ t ofplaceswhereaninmatecouldhidedrugsandthatitwasnotunusualnottofinddrugsonan  ` inmateduringasearch.Hesaidthatwhengivinginmatestheirmedication,jailerofficersfollowed  L  aprescriptionsdirectionsbutthatanofficercouldnotforceaninmatetotakethemedicine.He  8  acknowledgedthathehadknowninmatestoholdpillsintheirmouthsandnotswallowthem.The $  juryfoundthedefendantguiltyofpossessionofacontrolledsubstancewithintenttodeliver.     Thedefendantcontendsthatthetrialcourterredbyfailingtoinstructthejuryonthelesser   includedoffensesofsimplepossessionandcasualexchange.Thestaterespondsthatalthough   simplepossessionandcasualexchangearelesserincludedoffensesofpossessionwithattemptto p deliver,theevidenceinthiscasedidnotsupportinstructionsastothoseoffenses.Weconcludethat \ thetrialcourtshouldhaveinstructedthejuryastothelesserincludedoffenseofsimplepossession. AccordingtoTenn.CodeAnn.3917417(a)(4),itisanoffenseforadefendantknowingly ` topossess acontrolledsubstancewithintentto...deliver...suchcontrolledsubstance.Simple L  possessionandcasualexchangearesetforthinthesamestatute,whichprovidesthatitisanoffense 8   forapersontoknowinglypossessorcasuallyexchangeacontrolledsubstanceunlessthesubstance $ t wasobtaineddirectlyfrom,orpursuantto,avalidprescription.Tenn.CodeAnn.39-17-418(a).  `   Underpart(a)oftheBurnstest,simplepossessionisalesserincludedoffenseofpossession  8  withintenttodeliver.Therefore,usingtherationaleinAllen,weconcludethatthetrialcourtshould $  haveinstructedthejuryonsimplepossession.PursuanttoTenn.CodeAnn.4018110(a)   (amended2001),ineffectatthetimeoftrial,thetrialcourtwasobligatedtoinstructthejuryeven   withoutrequest.Moreover,suchaninstructionwastheconstitutionalrightofthedefendant.See   Ely,48S.W.3dat727.     Underpart(a)oftheBurnstest,weconcludethatcasualexchangeisnotalesserincluded \ offenseofpossessionwithintenttodeliverbecauseitcontainstheadditionalelementofan H exchange.Andwedonotbelievethatcasualexchangeisalesserincludedoffenseunderpart(b) 4 ofBurns.SeegenerallyStatev.GradyPaulGatlin,No.M200002356CCAR3CD,Marshall  p County(Tenn.Crim.App.Sept.25,2001)(Witt,J.,concurringanddissenting,andRiley,J.,  \ dissenting)(concludingthatcasualexchangeisnotalesserincludedoffenseofpossessionwith H intenttosell).Therefore,weconcludethatthetrialcourtdidnoterrbyfailingtochargethejuryon 4 casualexchangeasanoffense.     Nevertheless,webelievethatthetrialcourtshouldhaveinstructedthejuryastothecasual  exchangeinferencesetforthinTenn.CodeAnn.3917419,whichprovides:  8  8`   Itmaybeinferredfromcircumstancesindicatingacasualexchange l amongindividualsofasmallamountofacontrolledsubstanceor X  substancesthatthecontrolledsubstanceorsubstancessoexchanged D! werepossessednotwiththepurposeofsellingorotherwise 0"  dispensinginviolationoftheprovisionsof3917417(a).Such #l! inferencesshallbetransmittedtothejurybythetrialjudgescharge, $X" andthejurywillconsidersuchinferencesalongwiththenatureofthe $D # substancepossessedwhenaffixingthepenalty.%0!$` x` x Althoughthetrialcourtstatedthattheletterprovedthatthedefendantwasusingthepillstoruna '#& businessandthatthedefendantsoldthepilltoMs.Jacksonaspartofthebusiness,webelievethe (#' lettercontainsstatementsindicatingacasualexchange.Forexample,intheletter,thedefendanttold )$( Ms.Jacksonthathewasrunningabusinesswiththepillsbutthat you[wont]beforgotten.In |*%) addition,althoughthedefendantaskedMs.Jacksontosendhimapackofcigarettes,hethenstated, h+&*  [But]thisrighthereisbecauseIsaidIwasgoingtohookyouupsohereitis.Moreover,thefact  thatthedefendantmayhaveexchangedthepillforunderwearorcigarettes,doesnotprecludea  casualexchange.SeeStatev.Copeland,983S.W.2d703,708(Tenn.Crim.App.1998)(holdingthat  acasualexchange contemplatesaspontaneouspassingofasmallamountofdrugs,forinstance,at t aparty,andmoneymaybeinvolved).Webelievethatthejurycouldhavereasonablyinferredfrom ` thesestatementsthatthedefendantandMs.Jacksonwerefriends,thathissendingherthepillonJuly L  13wasnotapartofhisbusiness,andthathedidnothavethefeloniousintenttodeliverit. 8    Ifthejuryweretomakeaninferenceofcasualexchange,thedefendantwouldonlybesubject  ` toaconvictionforsimplepossession.Weconcludethatunderthecircumstancesandasrequired  L  byTenn.CodeAnn.3917119,thetrialcourtshouldhaveinstructedthejuryastothecasual  8  exchangeinference,regardlessofnorequestbeingmade. $    Wealsobelievethattheevidencepotentiallybringsintoplaythevalidprescriptionexception   totheoffenseofsimplepossession.Aspreviouslystated,Tenn.CodeAnn.3917418(a)provides   avalidprescriptionexceptionbywhichadefendanthavingavalidprescriptionforthepossessedor   exchangeddrugcannotbeconvictedofthoseoffenses.Inthepresentcase,apharmacisttestifiedthat p thedefendantobtainedClonazepampursuanttoaprescription.Thestateacknowledgedthatthe \ defendanthadaprescription.Theprescriptionexceptionisapplicable whentheprescriptionis H issuedbyalicensedpractitioner,actingingoodfaithandinaccordwithacceptedmedicalstandards 4 andwhenthepersonobtainingtheprescriptionisalsoactingingoodfaithandisfreefromfraud,  p deceitormisrepresentation.Statev.Sanderson,550S.W.2d236,239(Tenn.1977);seealsoTenn.  \ CodeAnn.3911202(providingthatthedefendanthastheburdenofprovinganexceptionbya H preponderanceoftheevidence).Inthisrespect,proofbyapreponderanceoftheevidencethatthe 4 defendantpossessedavalidprescriptionforClonazepamwouldexoneratehimifthecasualexchange   inferenceweremade.     Giventherelationshipoftheoffenseofsimplepossessionandthecasualexchangeinference,  wecannotsayundertheevidenceinthiscasethatthefailuretoinstructthejuryregardingtheoffense  andinferencewasharmlessbeyondareasonabledoubt.Accordingly,wereversethejudgmentof l convictionandremandthecaseforanewtrial.
