ThedefendantcontendsthathecompliedwiththeonlyrequirementinRule35,byfilingthemotiontoreducewithinonehundredtwentydaysofhissentencing.Thestateagreeswiththedefendant,relyinguponpreviousopinionsbythiscourt.See,e.g.,Statev.LeonardAmbrose,No.89103III,WilliamsonCounty(Tenn.Crim.App.Dec.21,1989)(sentencemaybemodifiedunderRule35eventhoughdefendantisinthepenitentiary);Statev.Bilbrey,816S.W.2d71(Tenn.Crim.App.1991)(hearingonRule35motionoccurredmorethanonehundredtwentydaysaftersentencingwhenmotionwastimelyfiled).Thestatealsoagreeswiththedefendantthatthecaseshouldberemandedforthetrialcourttoexerciseitsdiscretiononthemeritsofthemotion. Preliminarily,wenotethattherecordonappealdoesnotincludeanyrelevantdocumentotherthanthemotionforreductionofsentencefiledAugust18,1994,thetrialcourtminutesandorderreflectingthatthecourtheldthatithadnoϜjurisdiction,andatenpagetranscriptofthehearingonthemotion,atwhichthetrialcourtandcounselforthepartiesdiscussedthemotionandtheissuesregardingϜjurisdiction.Atthehearing,theprosecutorstatedthatthedefendantwassentencedinMay1994totwelveyearsinthepenitentiaryrelativetoaggravatedrobbery.Also,thetrialcourtstatedthatthemotionwasfiledwithinonehundredandtwentydaysofthedefendantssentencing.However,thereisnojudgmentofconvictionorothercourtdocumentorexhibitintherecordshowingthesefacts. Ordinarily,argumentbycounseldoesnotconstituteevidence.See,e.g.,Delkv.State,590S.W.2d435,440(Tenn.1979).Thus,iftherecordinthepresentcaseweresoviewed,wewouldhavenoactualevidencethatthemotionwastimelyfiled.However,inthecontextoftherepresentationsmadebycounselatthehearing,itisapparentthatthepartieswerepresentingthemasuncontestedfactstothetrialcourt.Inthissense,thestatementsconstitutemorethanjustargument.Moreover,thetrialcourtsstatementthatthemotionwastimelyfiledrepresentsadeterminationthatwecantakeastrueabsenttherecordshowingtothecontrary.
