JamesCobble,anofficerwiththeMorristownPoliceDepartment,wascalledtothescene. t Thereheobservedthatbothvehicleshadsustainedextensivedamage.Afterinterviewingseveral ` witnesses,OfficerCobbledeterminedthattheappellantwasdrivinghisvehicleatthetimeofhis L  accident,eventhoughhedidnotpersonallyobservetheappellantdriving.OfficeCobblealsosaw 8  theappellantswifeseatedinthepassengerseatwithherfeetonthestreet.Theappellantsfour $ t yearoldsonwhowasalsointhecaratthetimeoftheaccidentwasinjured.Afterspeakingwiththe  ` appellantasecondtime,OfficerCobblenoticedanodorofalcoholandthattheappellantseyeshad  L  aglassyappearance.Officercobblealsonotedthatthedefendantsspeechwasalsoslurred.The  8  officerthenadministeredseveralfieldsobrietytests,allofwhichtheappellantfailed.Theofficer $  thenarrestedtheappellantandtransportedhimtotheMorristownPoliceDepartmentwherehe   administeredaBreathalyzertest.Thetestresultsindicatedthattheappellanthadabloodalcohol   levelof.10%.     Theappellanttestifiedthatonthedayoftheaccidentheworkeduntilnoonandthenleftwith p hisbrother.Hestatedthattheystoppedandpurchasedasliceofpizzaanda22ouncebeerandthen \ drovetotheirmothershousewheretheappellantremaineduntilhiswifearrived. H   Theappellantswife,RhondaGrooms,testifiedthatshe,notthedefendant,wasdrivingthe  p vehicleonthedayoftheaccident.Shestatedthatshepickedhersonandhusbandupathermother  \ inlawshouseandthathersonwassittinginthefrontseatofthevehicleandthattheappellantwas H inthebackseatonthedriversside.TheappellantstatedthathiswifethendrovetoCVStodrop 4 offaprescription.Heclaimsthatastheydrovedowntheroad,Ms.Boydpulledoutinfrontofthem.   Theappellantstatedthathissonwasinjuredduringtheaccidentbythelidoftheairbagandthathis   wifewasalsoinjuredbytheairbag.HealsotestifiedthatMs.Boydwastalkingonhercellphone  atthetimeoftheaccident.Ms.Groomstestifiedthatshetriedtotalktotheofficerbutwastoldby  theofficerthathewasntallowedtotakestatements.Theappellantsmother,HelenGrooms,also  testifiedthatRhondaGroomswasdrivingwhenthefamilyleftherhome. l   TheappellantclaimsthathetoldOfficerCobblethatMs.Boydpulledoutinfrontofhim.
