àAppellant€Larry€Donald€Gunter€appeals€from€a€jury€verdict€rendered€on€AprilÏ12,€1995€in€the€Jefferson€County€Circuit€Court€finding€him€guilty€of€aggravatedÏassault.€€Appellant€pleaded€guilty€to€a€charge€of€driving€a€motor€vehicle€without€aÏvalid€operator's€license.€€As€a€Range€I€standard€offender,€Appellant€received€theÏfollowing€sentences:€€(1)€six€years€confinement€in€the€Tennessee€Department€ofÏCorrections€for€the€aggravated€assault;€and€(2)€a€concurrent€sentence€of€thirty€daysÏin€the€Jefferson€County€Jail,€on€the€conviction€for€driving€a€motor€vehicle€without€aÏvalid€operator's€license.€€On€April€24,€1995,€Appellant€filed€a€motion€for€new€trial.€ÏHowever,€the€trial€court€denied€this€motion€on€February€7,€1996.€€AppellantÏpresents€two€issues€for€consideration€on€this€direct€appeal:€€(1)€whether€theÏevidence€was€sufficient€as€a€matter€of€law€to€sustain€Appellant's€conviction€forÏaggravated€assault;€and€(2)€whether€the€trial€court€erred€in€denying€Appellant'sÏmotion€in€limine€to€prohibit€the€introduction€of€threats€allegedly€made€by€AppellantÏto€Melissa€Baker,€Appellant's€former€girlfriend,€when€the€victim€was€not€Ms.€Baker.Ìà àAfter€a€review€of€the€record,€we€affirm€the€judgment€of€the€trial€court.ÌÌà@ àò òI.€€FACTUAL€BACKGROUNDó óÌà àThe€proof€shows€that€on€August€24,€1994,€Appellant€arrived€at€work€atÏapproximately€3:45€P.M.€€Appellant's€shift€commenced€at€4:00€P.M.,€and€MelissaÏBaker's,€his€former€girlfriend,€shift€ended€at€4:30.× ƒ) ××  ×€€According€to€the€testimony€of€theÏvictim,€Ms.€Debbie€Quisenberry,€Appellant€arrived€early€in€order€to€talk€with€Ms.ÏBaker;€however,€Baker€was€reluctant€to€speak€with€him.€€Subsequently,€AppellantÏallegedly€began€to€cause€a€disturbance€by€pushing€Baker€and€by€threatening€to€killÏher€when€she€left€work.€€Because€Baker€feared€Appellant,€she€requested€that€Ms.ÏQuisenberry€follow€her€home.€€Shortly€after€leaving€work,€Baker€traveled€downÏNina€Road,€with€Quisenberry€following€her.€€Quisenberry€saw€Appellant€sitting€inÏhis€car,€alongside€Nina€Road,€with€his€motor€running.€€Immediately€afterÏQuisenberry's€van€passed€Appellant,€he€pulled€onto€the€road€behind€her.€ÏAppellant€then€accelerated€and€began€nudging€Quisenberry's€bumper€with€his€car.€ÏQuisenberry€testified€that€the€more€that€she€sped€up,€the€faster€Appellant€drove.€ÏAppellant€continued€to€drive€at€a€high€rate€of€speed,€pushing€the€victim's€car€withÏhis€bumper€until€she€ran€off€the€road.€€Quisenberry€applied€her€brakes€and€crossedÏthe€opposite€lane.€€The€victim's€van€then€flipped€three€times€and€ultimately€came€toÏrest€in€a€field.€€She€sustained€two€broken€ribs€and€a€badly€bruised€pelvis€and€back.Ìà àThe€prosecution€presented€the€testimony€of€Officer€Bud€McCoig.€€OfficerÏMcCoig€testified€that€Appellant's€left€front€parking€light€was€broken€and€that€heÏrecovered€from€along€the€roadside€pieces€of€plastic€from€the€housing€of€the€parkingÏlight.€€Additionally,€Officer€McCoig€stated€that€he€successfully€fit€together€the€brokenÏfragments€with€that€portion€of€the€housing€which€remained€on€Appellant's€vehicle.€ÏThe€officer€explained€that€while€he€could€detect€no€damage€to€a€good€portion€of€theÏfront€of€appellant's€car,€there€was€a€scratch€on€the€rubber€pad€of€the€left€side€of€theÏvehicle's€bumper.Ìà àOn€direct€examination,€Appellant€testified€that€he€followed€Ms.€BakerÏbecause€he€desired€to€stop€her€and€to€speak€with€her€concerning€their€child.€ÏAppellant€stated€that€as€he€attempted€to€pass€Quisenberry,€she€abruptly€pulled€inÏfront€of€him€and€into€the€opposite€lane.€€Subsequently,€he€moved€back€into€theÏrighthand€lane€and€saw€Quisenberry's€van€turning€over.€€Appellant€denied€that€heÏhad€ever€intentionally€bumped€Quisenberry's€van€with€his€vehicle€and€averred€thatÏhe€was€not€even€sure€that€the€two€vehicles€had€ever€made€contact.€€On€cross„examination,€Appellant€testified€that€he€was€not€aware€that€Baker€traveled€on€NinaÏRoad€in€order€to€go€to€her€home.€€Moreover,€he€stated€that€it€was€a€coincidence€thatÏboth€he€and€Baker€were€on€Nina€Road€at€the€same€time.€€Finally,€Appellant€deniedÏever€threatening€and€shoving€Ms.€Baker€at€work€prior€to€the€incident.ÌÌà@ àò òII.€€SUFFICIENCY€OF€THE€EVIDENCEó óÌà àAppellant's€first€contention€on€this€direct€appeal€is€that€the€evidence€wasÏinsufficient€to€sustain€his€conviction€for€aggravated€assault.€€We€disagree.Ìà àThis€Court€is€obliged€to€review€challenges€to€the€sufficiency€of€the€convictingÏevidence€according€to€certain€well„settled€principles.€€A€verdict€of€guilty€by€the€jury,Ïapproved€by€the€trial€judge,€accredits€the€testimony€of€the€State's€witnesses€andÏresolves€all€conflicts€in€the€testimony€in€favor€of€the€State.€€òòState€v.€Cazesóó,€875ÏS.W.2d€253,€259€(Tenn.€1994);€òòState€v.€Harrisóó,€839€S.W.2d€54,€75€(Tenn.€1992).€ÏAlthough€an€accused€is€originally€cloaked€with€a€presumption€of€innocence,€a€juryÏverdict€removes€this€presumption€and€replaces€it€with€one€of€guilt.€€òòState€v.€Tuggleóó,Ï639€S.W.2d€913,€914€(Tenn.€1982).€€Hence,€on€appeal,€the€burden€of€proof€restsÏwith€Appellant€to€demonstrate€the€insufficiency€of€the€convicting€evidence.€€òòId.óó€€OnÏappeal,€"the€[S]tate€is€entitled€to€the€strongest€legitimate€view€of€the€evidence€asÏwell€as€all€reasonable€and€legitimate€inferences€that€may€be€drawn€therefrom."€€òòId.óóÏ(citing€òòState€v.€Cabbageóó,€571€S.W.2d€832,€835€(Tenn.€1978)).€€Where€theÏsufficiency€of€the€evidence€is€contested€on€appeal,€the€relevant€question€for€theÏreviewing€court€is€whether€any€rational€trier€of€fact€could€have€found€the€accusedÏguilty€of€every€element€of€the€offense€beyond€a€reasonable€doubt.€€òòHarrisóó,€839ÏS.W.2d€54,€75;€òòJackson€v.€Virginiaóó,€443€U.S.€307,€319,€99€S.Ct.€2781,€2789,€61ÏL.Ed.2d€560€(1979).€€In€conducting€our€evaluation€of€the€convicting€evidence,€thisÍCourt€is€precluded€from€reweighing€or€reconsidering€the€evidence.€€òòState€v.ÏMorganóó,€929€S.W.2d€380,€383€(Tenn.€Crim.€App.€1996);€òòState€v.€Matthewsóó,€805ÏS.W.2d€776,€779€(Tenn.€Crim.€App.€1990).€€Moreover,€this€Court€may€not€substituteÏits€own€inferences€"for€those€drawn€by€the€trier€of€fact€from€circumstantial€evidence."€ÏòòMatthewsóó,€805€S.W.2d€776,€779.€€Finally,€òòTenn.€R.€App.€P.óó€13(e)€provides,€"FindingsÏof€guilt€in€criminal€actions€whether€by€the€trial€court€or€jury€shall€be€set€aside€if€theÏevidence€is€insufficient€to€support€the€findings€by€the€trier€of€fact€of€guilt€beyond€aÏreasonable€doubt."€€òòSee€also€Matthewsóó,€805€S.W.2d€776,€780.Ìà àWe€stated€in€òòMatthewsóó€that€"A€criminal€offense€may€be€establishedÏexclusively€by€circumstantial€evidence.€€However,€before€an€accused€may€beÏconvicted€of€a€criminal€offense€based€upon€circumstantial€evidence€alone,€the€factsÏand€circumstances€`must€be€so€strong€and€cogent€as€to€exclude€every€otherÏreasonable€hypothesis€save€the€guilt€of€the€defendant.'"€€805€S.W.2d€776,€779„80Ï(quoting€òòState€v.€Crawfordóó,€470€S.W.2d€610,€612€(Tenn.€1971)).Ìà à€Tenn.€Code€Ann.€ðð€39„13„101€provides€in€pertinent€part:€€"A€person€commitsÏassault€who:Ìà à(1)€Intentionally,€knowingly€or€recklessly€causes€bodily€injury€to€another;Ìà à(2)€Intentionally€or€knowingly€causes€another€to€reasonably€fear€imminentÏbodily€injury."€òòId.óó€€Tenn.€Code€Ann.€ðð€39„13„102(a)€provides€that€"A€person€commitsÏaggravated€assault€who:Ìà à(1)€Intentionally€or€knowingly€commits€an€assault€as€defined€in€39„13„101Ïand€(A)€Causes€serious€bodily€injury€to€another;€or€(B)€Uses€or€displays€a€deadlyÏweapon.€€òòId.óó€€"Serious€bodily€injury"€is€defined€in€Tenn.€Code€Ann.€ðð€39„11„106(34)Ïas€"bodily€injury€which€involves:€€(A)€A€substantial€risk€of€death;€(B)€ExtremeÏphysical€pain.€.€.€."€€Tenn.€Code€Ann.€ðð€39„11„106(34).€€Thus,€the€State€wasÏrequired€to€prove€each€and€every€element€of€the€offense€beyond€a€reasonableÏdoubt.Ìà àAppellant€was€originally€charged€with€having€committed€this€aggravatedÏassault€in€two€different€ways,€i.e.,€he€caused€serious€bodily€injury€to€Ms.ÏQuisenberry,€and€he€caused€Ms.€Quisenberry€to€reasonably€fear€death.€€AlthoughÏthe€trial€court€found€that€these€two€offenses€were€merged,€the€proof€shows€not€onlyÏserious€bodily€injury€to€Ms.€Quisenberry€but€also€that€she€was€placed€in€reasonableÏfear€of€death.Ìà àViewing€the€evidence€in€light€of€the€above„stated€criteria,€we€hold€that€aÏrational€trier€of€fact€could€have€concluded€beyond€a€reasonable€doubt€thatÏAppellant€committed€aggravated€assault.€€First,€the€jury€heard€the€compellingÏtestimony€of€Debbie€Quisenberry,€the€victim.€€She€testified€that€on€August€24,€1994,Ïshe€heard€Appellant€tell€Baker€that€"he€was€going€to€kill€her€when€she€left€work€thatÏday,€he€would€be€waiting€on€her€when€she€got€off€work."€€Quisenberry€furtherÏexplained€that€after€Appellant€had€threatened€Baker's€life,€Baker€askedÍQuisenberry€to€follow€her€home€upon€the€completion€of€their€shift.€€Upon€leavingÏLeSportsac€that€afternoon€at€approximately€4:00€P.M.,€Quisenberry€followed€BakerÏas€the€two€vehicles€traveled€along€Nina€Road€toward€White€Pine.€€As€sheÏapproached€White€Pine,€Quisenberry€noticed€that€Appellant€"was€sitting€on€the€sideÏof€the€road€in€his€car€with€it€started."€€She€stated€that€she€could€discern€thatÏAppellant's€car€engine€was€running€because€she€could€see€the€exhaust€emittingÏfrom€its€rear.€€Appellant€pulled€out€behind€Quisenberry€and€pushed€her€van€with€hisÏcar.€€As€Quisenberry€accelerated,€Appellant€simultaneously€increased€his€speedÏand€continued€to€push€her€van€until€she€ran€off€the€road€and€flipped€her€van.€€SheÏtold€the€jury€that€when€Appellant€bumped€her€car,€"I€thought€I€was€going€to€die."€€AsÏa€result€of€the€wreck,€Quisenberry€sustained€two€fractured€ribs€and€a€badly€bruisedÏpelvis€and€back.Ìà àIt€was€the€jury's€prerogative€to€reject€Appellant's€version€of€events€in€favor€ofÏMs.€Quisenberry's.€€It€apparently€did€so.€€That€testimony€shows€that€AppellantÏintentionally€caused€Ms.€Quisenberry€to€wreck€and€that,€as€a€result€thereof,€she€wasÏput€at€substantial€risk€of€death€and€sustained€serious€bodily€injury.€€Tenn.€CodeÏAnn.€ðð€39„13„102(a).€€Thus€the€verdict€is€amply€supported€by€the€evidence.ÌÌÇà@ àò òIII.€€MOTION€IN€LIMINEó óÌà àAppellant€next€argues€that€the€trial€court€improperly€denied€his€motion€inÏlimine€to€prohibit€the€introduction€of€threats€allegedly€made€by€Appellant€to€MelissaÏBaker.€€We€do€not€agree.Ìà àIn€his€pretrial€motion€in€limine,€Appellant€sought€to€exclude€testimony€thatÏAppellant€allegedly€had€threatened€to€kill€his€former€girlfriend,€Melissa€Baker.€ÏAppellant€argues€that€because€the€threats€were€made€to€one€other€than€the€victim,Ïthey€were€irrelevant€and€should,€therefore,€be€excluded.€€However,€the€trial€courtÏdenied€the€motion€in€limine,€explaining€that€these€alleged€threats€were€relevantÏand€were€admissible€pursuant€to€òòTenn.€R.€Evid.óó€404(b),€as€they€were€probative€onÏthe€issue€of€Appellant's€intent€and€his€motive€to€commit€the€offense.Ìà àThe€Tennessee€Rules€of€Evidence€embody,€and€our€courts€traditionally€haveÏacknowledged,€a€policy€of€liberality€in€the€admission€of€evidence€in€both€criminalÏand€civil€cases.€€òòState€v.€Robinsonóó,€930€S.W.2d€78,€84€(Tenn.€Crim.€App.€1995);ÏòòState€v.€Banksóó,€564€S.W.2d€947,€949€(Tenn.€1978).€€To€be€admissible,€evidenceÏmust€satisfy€the€threshold€determination€of€relevancy€mandated€by€Tenn.€R.€Evid.Ï401.€€Rule€401€defines€"relevant€evidence"€as€being€"evidence€having€anyÏtendency€to€make€the€existence€of€any€fact€that€is€of€consequence€to€theÏdetermination€of€the€action€more€probable€or€less€probable€than€it€would€be€withoutÏthe€evidence."€€òòTenn.€R.€Evid.óó€401.€€The€decision€of€whether€or€not€profferedÍevidence€is€relevant€rests€with€the€sound€discretion€of€the€trial€court,€and€the€trialÏcourt's€decision€will€not€be€reversed€on€appeal€absent€a€clear€showing€of€an€abuseÏof€that€discretion.€€òòState€v.€Forbesóó,€918€S.W.2d€431,€449€(Tenn.€Crim.€App.€1995).ÏòòSee€State€v.€McCaryóó,€922€S.W.2d€511,€515€(Tenn.€1996).€€In€òòForbesóó,€this€CourtÏadmonished€trial€courts€to€"state€on€the€record€the€reasons€for€admitting€orÏexcluding€evidence€on€relevancy€grounds"€in€order€to€expedite€appellate€review.€Ï918€S.W.2d€431,€449.Ìà
