TheDefendantsmurderconvictionwasforthekillingofatwoyearoldchild,whodiedafteraseverebeating.TheDefendantgaveastatementinwhichheadmittedthathehadbeatenthechildbecauseshehadurinatedonthecouch. Atthepostconvictionhearing,theDefendantandoneofhistwotriallawyerstestified.TheDefendantclaimedthathehadpleadedguiltybecausehewas scaredand confused.Hetestifiedthatthepolicehadthreatenedhimintogivingtwostatements,thatthepolicehadthen changedhisstatementstoappearasconfessions,andthathehadbeenseverelybeatenbyjailinmatesafewdaysafterhavinggivenhissecondstatement.Hepleadedguiltyapproximatelyoneyearlaterbut tooktheguiltypleabecause[he]wasscaredandconfused.Headmittedthathehadknownhewasfacingthedeathpenaltyifhewenttotrial.Hefurthertestifiedthathislegalrepresentationwasineffectiveduetoinadequateinvestigation,inadequatecommunication,insufficientzealousness,misinformation,failuretomoveforchangeofvenue,andfailuretoprepareadefensestrategy. LeadcounselfortheDefendantattrialtestifiedthatsheandanotherlawyerfromthepublicdefendersofficehadbeenassignedtothecase,aswellastwoinvestigators.Shetestifiedthatshehadfiledthirtysixmotions,includingamotiontosuppresstheDefendantsstatements.Themotiontosuppresswasdenied.Sheexplainedthatshehadconcludedachangeofvenuewouldnotnecessarilybeinherclientsbestinterest.HerrecordsreflectedtwentyjailvisitsaswellasadditionalphonecallsandcorrespondencewiththeDefendant.Sheexplainedthat,underthefactsofthecase, TherewasnotmuchstrategythatcouldbeϜhad,andthatshehadadvisedherclient totrytoenteraplearatherthantogototrial,becausetheywereseekingthedeathpenaltyagainsthim.   Inarulingfromthebench,thetrialcourtfoundtheDefendant notverycredible...intermsofhisassertionsandthat performanceofcounselwasadequateandreasonableunderthecircumstances.Weagree.Inthispostconvictionreliefproceeding,theDefendanthadtheburdenofprovingtheallegationsinhispetitionbyapreponderanceoftheevidence.McBeev.State,655S.W.2d191,195(Tenn.Crim.App.1983).Furthermore,thefactualfindingsofϜatrialcourtafteranevidentiaryhearing areconclusiveonappealunlesstheevidencepreponderatesagainstthejudgment.Statev.Buford,666S.W.2d473,475(Tenn.Crim.App.1983).Inthiscase,uponourreviewoftheevidentiaryhearingaswellasthetranscriptsfromtheguiltypleaandmotiontosuppress,theϜDefendanthassimplyfailedtocarryhisburdenofproofastobothofhisallegedgroundsforrelief.Thejudgmentbelowisaccordinglyaffirmed.          ____________________________       DAVIDH.WELLES,JUDGE̜CONCUR:̜_________________________̜PAULG.SUMMERS,JUDGE_________________________̜JOEG.RILEY,JUDGE
