Apparently,basedupontheseprobationviolations,thetrialcourtorderedplacementoftheAppellant \ intheCommunityCorrectionsProgramonJanuary23,2003. H   OnOctober1,2003,thetrialcourtorderedthatacapiasissuefortheAppellantsarrest  p becausehe failedtocomplywiththeCommunityCorrectionsProgramby...OBTAININGNEW  \ ARRESTS[.]ArevocationhearingwasheldonNovember17,2003. H   ChrisJacksonoftheHamiltonCountyCommunityCorrectionsProgramtestifiedthatthe   AppellantfailedtoreportaJune24tharrestforresistingarrestandaSeptember9tharrestfordomestic   assault.AfterconfrontingtheAppellantaboutany contactwiththepolicehemayhavehad,the  AppellantadmittedtheJune24tharrest;however,theSeptember9tharrestwasneverreportedor  acknowledged.Atthehearing,theAppellantadmittedthathewasconvictedofresistingarrest,  resultinginasentenceof twopublicworkdaysandpaymentofafine.TheAppellantalso l admittedthathe [d]idntworkthetwoworkdays.Additionally,theAppellanttestifiedthathewas X  convictedofdomesticassaultandreceivedasentenceof11monthsand29days,whichwas D! suspendedafterserviceof30days.Hestatedthathe didfifteendaysandthatwasonthe9thof 0"  October. #l!   Followingthisproof,thetrialcourtrevokedtheAppellantscommunitycorrectionssentences $D # andorderedthattheremainderoftheAppellantsthreeyearsentencebeservedintheDepartment %0!$ ofCorrection.ThetrialcourtspecificallyfoundthattheAppellant hasviolatedtheCommunity &"% Correctionsbybeingconvictedofresisting,stop,frisk,halt,arrestorsearch,andforbeingconvicted '#& ofdomesticassaultandnotreportingeitherone.Thistimelyappealfollowed. Thus,inreviewingthetrialcourtsaction,itisourobligationtoexaminetherecordanddetermine   whetherthetrialcourtexercisedconscientiousjudgmentindeterminingthattherewassubstantial   evidencetoestablishthataviolationoccurred. p   Afterreview,wefindthattheproofpresentedclearlyestablishedtheAppellantdidinfact H violatehisBehavioralCommunityCorrectionsAgreementContract.ChrisJackson,theAppellants 4 caseofficer,testifiedthattheAppellantwasconvictedofresistingarrestandwassentencedto a  p couplepublicworkdays[.]Moreover,JacksontestifiedthattheAppellantdidnotreportthe  \ domesticassaultcharge.TheAppellantadmittedthathewasconvictedofresistingarrestand H domesticassault.However,heclaimedthatheshouldbegivenanotherchancebecause 4 8  Ireallydoneedone.Ireallydidnttrytocatchthesetwocharges.Ijustwenton   youknowwhatImsaying,becausemywitnessesthatIhadforthesetwocharges,  theydidntevenshowupthetwotimesIwenttocourtforthesetwocharges.Iknew  theJudgewouldhavethrownthemoutifmywitnesseswouldhavecame.   TheAppellanthasprovidednoevidenceinsupportofthiscontention.Additionally,theAppellant X  claimedthathedidnotreportthedomesticassaultchargebecausehe [f]orgotallaboutit.The D!
