OnNovember4,1994,thepetitionerenteredpleasofguiltytorecklessϜendangermentandtofourmisdemeanors.ThecontrollingsentencewasatwoyearsentenceintheTennesseeDepartmentofCorrectionsconcurrentwithasentencetobereceivedintheUnitedStatesDistrictCourt.Thereafter,thepetitionerwassentencedto57monthsforthefederalcrime,butforreasonswhicharenotexplainedintherecord,thatsentencewasconsecutivetothestatesentence.Itappearsthateffortsweremadeinthestatecourttoallowthestatesentencetobeservedconcurrentlywiththefederalsentence,butthoseeffortswereunsuccessful.Therecordreflectsthefollowingsequenceofevents: November4,1994,guiltypleaandentryofjudgment; August7,1995,entryofamendedjudgmentforrecklessendangerment ,   ; July22,1996,petitionforpostconvictionrelieffiled; July23,1996,entryofordersettingasidejudgment .   כ; August5,1996,entryofnewjudgment; February21,1997,orderdenyingthepetitionforpostconvictionrelief. Thegroundforthepetitionforpostconvictionreliefwasineffectiveassistanceofcounsel.ThepetitionercontendsitwasthefaultofhistrialcounselthattheϜstatesentenceandfederalsentencewereconsecutiveratherthanconcurrent.Thetrialcourtdismissedthepetitionwithoutanevidentiaryhearingandfoundthatthepetitionerstrialattorneywasnotineffective. InthisCourt,thepetitionercontendsthattherecordestablishesthathistrialcounselwasineffectiveoralternatively,themattershouldberemandedfor̜anevidentiaryhearing.Ontheotherhand,theStatecontendsthatthepetitionforpostconvictionreliefisbarredbythestatuteofthelimitations. Wefindthatthepetitionisbarredbythestatuteoflimitations./ư̈̀ OnNovember4,1994,whenthepetitionerenteredpleasofguilty,thestatuteoflimitationsapplicabletopostconvictionproceedingswasthreeyears.T.C.A,4030102(Repealed1995).In1995,thelegislaturereducedthestatutoryperiodforfilingpostconvictionpetitionsfromthreeyearstooneyear.T.C.A.4030202(a).Thenew1995PostConvictionActgovernsthispetitionandallpetitionsfiledafterMay10,1995.Thus,thepetitionerhaduntilMay10,1996tofilethispetition.ItwasnotfileduntilJuly22,1996. ThepetitionerarguesthathehadoneyearfromAugust7,1995,thedateofentryoftheamendedjudgment,tofilethepetition.TheStatearguesthatexceptforclericalmistakes,thetrialcourthadnojurisdictiontoamendthejudgment,andtheϜamendmentwasanullity. Asageneralrule,atrialcourtsjudgmentbecomesfinal30daysafteritsentryunlessatimelynoticeofappealoraspecifiedposttrialmotionisfiled.Statev.Moore,814S.W.2d381,382(Tenn.Crim.App.1991);Statev.Pendergrass,937S.W.2d834,837(Tenn.1996).Theauthorityofatrialcourttoruleonmotionsinalawsuitexpires30daysaftertheentryofjudgment.Statev.Lock,839S.W.2d436,439(Tenn.Crim.App.1992).Onceatrialcourtlosesjurisdiction,itgenerallyhasnopowertoamenditsjudgment.Moore,914S.W.2d382;Pendergrass,937S.W.2d.,at837.Indeed,itiswellsettledthatajudgmentbeyondthejurisdictionofacourtisvoid.Brownv.Brown,198Tenn.600,281S.W.2d492,497(1955);Pendergrass,937S.W.2d,at837. UnderRule36,T.R.Cr.P.,atrialcourtretainslimitedjurisdictiontocorrectclericalmistakesinjudgmentsanderrorsarisingfromoversightoromission.Id.However,thatisnottosaythatthecorrectionofaclericalmistakeconfersjurisdictionwhereitdidnototherwiseexist.InPendergrass,thedefendantwasindictedforthesaleofdrugs.Shemovedtosuppresstheitemsseizedinthesearchofherresidenceonconstitutionalgrounds.Hermotionwasoverruled,andshethenenteredapleaofguiltyintendingtoreservetherighttoappealacertifiedquestionoflawthatwasdispositiveofthecase.However,thecertifiedquestionwasnotinsertedintothejudgment.Morethan30daysafterthejudgmentbecamefinal,thetrialcourtenteredanamendedjudgmentcertifyingthequestionoflaw.TheSupremeCourtheldthattheamendedorderwasnotthemerecorrectionofaclericalerror,butratheranattempttoconferjurisdictionontheCourtofAppealstohearthecertifiedquestionoflaw.TheCourtheldthatthe X trialcourtlostjurisdictionofthecase30daysaftertheentryoftheinitialjudgmentandhadnoauthoritytoentertheamendedjudgment. TheholdinginPendergrassisdispositiveofthiscase.
