Atthepostconvictionhearing,petitionerindicatedthathistrialcounselmetwithhimfour(4)orfive(5)timeswhenhewasgoingthroughcourt.Accordingtopetitioner,trialcounselalsometwithpetitioner'sparentsandfamilymembers.Althoughheindicatedthathedidnotunderstandallthetimethethingsthattrialcounselwastellinghim,hedidremembertheguiltypleahearing.Herememberedthejudgeexplainingtohimhisrights.Herememberedthejudgetellinghimhehadtherighttoassistanceofcounselandthathehadtherighttocrossexaminethewitnessesthatthestatewouldcalltotestifyagainsthim.Healsorememberedreadingthisinformationbutindicatedthathedidnotunderstanditwhenhereadit.Helaterindicatedthathecouldnotrememberwhetherthejudgehadadvisedhimofhisrights.Hethoughthecouldremembertrialcounseltalkingtohimabouthavingparticularwitnesseswhowouldtestifyifhewenttotrial.Hedidnotrecallwhetherornothistrialcounseltalkedtohimconcerningwhetherornothewouldtestify.Hedidrememberpleadingguiltytofour(4)countsofrape.Headmittedhavingoralsexwithhissix(6)yearolddaughterandadvisedthejudgeaccordingly 844: athisguiltypleahearing.Heunderstoodfromtalkingtotrialcounselthathewas 844: goingtogeteight(8)yearsoneachcountandthatitwouldbeuptoJudgeWallaceastowhetherornothewouldserveallthoseeight(8)yearsatonetimeorwhether 844: theywouldbestackedontopofeachother.Heindicated,however,thathethoughthewasgoingtohaveaneffectiveeight(8)yearsentence.Hiscomplaintatthepostconvictionhearingwasthathegottoomuchtime.Itappearsatthepostconvictionhearingthattheamountoftimetowhichhewassentencedwashisonlycomplaint. ` Trialcounsel,AllenBeard,indicatedthathewasanexperiencedlawyerincriminaldefenseworkinsexcrimeswhileintheservice.Thiscase,however,washisfirstmajorcriminalcaseafterbeingdischargedfromtheservice.Hewasadvisedbypetitioner'sfamilythatpetitionerwaseitherretardedorborderlineretarded.Herequestedanevaluation.Theevaluatingpsychiatristindicatedthatpetitionerwasborderlinebutwasnotincompetenttostandtrial.Petitionerwaschargedwithtwentyseven(27)countsofaggravatedrape.Henegotiatedapleaforfour(4)countsofrapewiththejudgedeterminingwhetherornotthesentencesweretorunconcurrently,consecutivelyortobeprobated.Trialcounselindicatedthathediscussedthisdispositionofthevariouscaseswithpetitionerandhisfamily.HeindicatedthatatthesametimeMr.Hall'sfamilyalsotriedtoexplaintohimwhatwasgoingon.Trialcounselwasprettysatisfiedthatpetitionerhadanunderstandingoftheeight(8)yearsentencesandhisfamilyunderstoodperfectly.Hisplanofdefensewastowardmitigationofsentencingashewassatisfiedthattherewas"liability."Hefeltliketheeffectivesentencewouldprobablybeeight(8)tosixteen(16)yearsalthoughheindicatedthatheadvisedpetitionerthathecouldbelookingatthirtytwo(32)yearsasarealisticpossibility. ` Whenquestionedastowhetherornotheshouldhavepursuedamotionto 0948 suppressthathehadfiled,heindicatedthathewouldprobablypursuethemotion.Hefeltasifitwereprettystrong.HeindicatedthatatsomepointduringquestioningthatMr.Hallhadrequestedanattorney.HelaterindicatedthatatthepointwhentherequestwasmadetherewasprobablyenoughontherecordthatMr.Hallwasdamaged.Therewascertainlyadangerofconvictioneveniftheyhadstoppedthequestioningatthatpoint.Hisonlyotheroptionotherthanthepleabargainwouldhavebeentogototrialwheretherewasasubstantialliabilityorexposuretohisclient.HefeltlikeMr.Hallknewtheoptionsaswellashecould.HealsoindicatedthatalotoftimesMr.Hallwouldsurpriseyouwithwhatheknewandothertimesyoumightthinkhewouldknownothing. ` Afterpetitionerwassentencedtoconsecutiveeight(8)yearsentences,hefiledaRule31motiontoreconsideratwhichtimethetrialcourtheardprooffromanotherpsychiatrist.Theprooffromtheotherpsychiatrist,however,wasnotinthepostconvictionrecord.Thecourtthereafterdeniedthepetitionindicatingthattrialcounselhaddoneagoodjobinthatthesituationwasmitigatedgreatlybecausepetitionerhadoriginallybeenchargedwithtwentyseven(27)countsofaggravatedrapeandenteredapleatofour(4)countsofrapewithanagreedeight(8)yearsentenceoneachcount.@xx( CONCLUSION 0*%(   ` Althoughtherewereseveralissuesraisedintheoriginalpetitionforpostconvictionrelief,theonlyissueraisedonappealisineffectiveassistanceofcounselregardingthepleaofguiltyofpetitioner.Anyotherissuesraisedintheoriginalpetitionwerenotbriefedorarguedonappealandare,therefore,waived.Theessenceoftheissueraisedonappealcentersaroundwhetherornotpetitionerunderstoodhisrightsatthetimeofenteringhispleaofguilty.Theproofinthepostconvictionrecordisclearthattrialcounselfeltthattherewasmajorexposurefor 0948 ?[  ?[  ?[  petitionerifhewenttotrialandwasconvicted.Itisalsoclearthattrialcounselfelttherewasagravedangerofconviction.Trialcounsel,therefore,negotiatedapleabargainagreementatareducedcharge.Petitionerwasindictedontwentyseven(27)countsofaggravatedrape.Thepleabargainagreementwasforapleaofguiltytofour(4)countsofrapewithanagreedeight(8)yearsentenceoneachcount.Thecourtwastodeterminewhetherthesentencesweretorunconcurrentlyorconsecutivelyortobeprobated.Therecordisclearthatpetitionerwasadvisedofthepossibilityofaneffectivethirtytwo(32)yearsentence.Althoughthereisnorecordoftheguiltypleahearing,petitioneradmitsthathewasadvisedbythetrialjudgeofhisconstitutionalrighttotrial,counselandconfrontationofwitnesses.Theonlyrealissueiswhetherornotpetitionerwascapableofunderstandinghisrights.TheonlyevidencebeforethisCourtisthatalthoughpetitionerwasborderlineretardedwithaneffectiveI.Q.of72,hewascompetenttostandtrial.Thisinformationalsowastheonlyevidencebeforethetrialcourtatthetimethecourtacceptedtheguiltyplea. ` Fromareviewofthepostconvictionrecord,thepetitionerhasfailedtocarryhisburdenofprovingthathisattorney'sperformancewasdeficientorthatanysuchdeficientperformanceresultedinprejudicetothedefendantsoastodeprivehimofafairtrial.Petitionerhasfurtherfailedtoshowthatthereisareasonableprobabilitythat,butforcounsel'serrors,hewouldnothavepleadedguiltyandwouldhaveinsistedongoingtotrial.Infact,theevidencebeforeusstronglysuggeststhatthepetitionerhadadmittedthefactstantamounttoaggravatedrapeandthathewassubjecttoapossiblesentencetotalingmorethan1,000yearshadhegonetotrial.@a
