Weaffirmthejudgmentofthetrialcourt.  OnMay7,1992,thepetitionerpledguiltytoattemptedseconddegreemurder.ThetrialcourtimposedaRangeII,twelveyearsentence.OnApril25,1995,thepetitionerfiledthispetitionforpostconvictionreliefalleging,amongotherthings,thathispleawasnotknowinglyandvoluntarilyenteredandthathiscounselwasineffective.Postconvictioncounselwasappointedandanamendedpetitionwasfiledonbehalfofthepetitioner.Attheconclusionoftheevidentiaryhearing,thetrialcourtdeterminedthatpetitionerhadbeenprovidedtheeffectiveassistanceofcounselandhadknowinglyandvoluntarilyenteredapleaofguilt.  Inorderforthepetitionertobegrantedreliefongroundsofineffectiveassistanceofcounsel,hemustestablishthattheadvicegivenortheservicesrenderedwasnotwithinthe"rangeofcompetencedemandedofattorneysincriminalcases"andthat,butforhiscounsel'sdeficientperformance,theresultofhistrialwouldhavebeendifferent.Baxterv.Rose,523S.W.2d930,936(Tenn.1975);Stricklandv.Washington,466U.S.668(1984).Thistwopartstandard,asitappliestoguiltypleas,ismetwhenthepetitionerestablishesthat,butforhiscounsel'serror,hewouldnothavepleadedguiltyandwouldhaveinsistedontrial.Hillv.Lockhart,474U.S.52,59(1985).  TheburdenisonthepetitionertoshowthattheevidenceϜpreponderatesagainstthefindingsofthetrialjudge.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978).Otherwise,thefindingsmadebythetrialcourtareconclusive.Gravesv.State,512S.W.2d603,604(Tenn.Crim.App.1973).  InBoykinv.Alabama,395U.S.238(1969),theSupremeCourtruledthattrialcourtsmustestablisharecordatthesubmissionhearingthatallguiltypleasareknowinglyandvoluntarilyentered.Inordertomeetconstitutionalstandards,thepleamustrepresent"avoluntaryandintelligentchoiceamongthealternativecoursesofaction[available]."NorthCarolinav.Alford,400U.S.25(1970);Clarkv.State,800S.W.2d500(Tenn.Crim.App.1990).  Attheevidentiaryhearing,thepetitionercomplainedthatthetrialjudgehadrepresentedthathissentencewouldbeservedinthecountyworkhouseratherthanthestatepenitentiary.Healsoinsistedthatthetrialjudgeshouldhavedismissedtheindictmentratherthangrantingasecondcontinuancewhenstatewitnessesfailedtoappearattrial.Hearguesthathistrialcounselwasineffectiveforfailingtoseekadismissal.  Therecordshowsthatthepetitionerhadpriorconvictionswhichhadresultedinperiodsofincarceration.In1964,thepetitionerreceivedafiveyearsentenceforfeloniousassault.In1971,thepetitionerreceivedconcurrentsentencesofthreeandtenyearsforfeloniousassaultandseconddegreemurder.  Attheevidentiaryhearing,thepetitioner'strialcounselrecalledthatthetrialjudgeallowedthedefendantaperiodoftimeafterhispleatoprovidecareforhismotherbeforereportingtoservehissentence.Whiletherecordindicatesthatthetrialjudgedidadvisethepetitionertoreporttoeitherthecountyworkhouseorthecourttobegintheserviceofhissentence,trialcounselexplainedthat"itwasneverpartofthepleaagreementthathewastoactuallyservehissentenceattheworkhouse,thatwouldhavebeenanimpossibility."Thepetitionerwastomerelysurrenderhimselfatalaterdatetothejailortothecourt.Trialcounselbelievedthepetitionerunderstoodthepleaandthatbecauseaselfdefensetheorywasnotviableinlightoffourstabwoundstothevictimandseveralstatewitnessesrefutingtheclaim,thepleaagreementwas"absolutely"advantageoustothepetitioner.  Thesubmissionhearingrecorddemonstratesthatthepetitionerrespondedintelligentlytoavarietyofquestionsimposedbythejudge.Thepetitionerclearlyacknowledgedthathispleawasfreeandvoluntaryandthathewillinglyacceptedthestate'soffertoreducethechargeinreturnfortheguiltyplea.  Inourview,thepetitioner'spleawasknowinglyandvoluntarilyentered.Moreover,thereisnoindicationthattrialcounselwasineffective.TrialcounseltestifiedthatshehadsoughtadismissalwhenthestatemovedtocontinuethecasefromitsoriginaltrialdateonFebruary6,1992.Thetrialcourtproperlydeniedthatmotion.Hadcounselinsistedonadismissalfordeprivationoftherighttoaspeedytrial,thatreliefwouldnothavebeenwarrantedunderthesecircumstances.ThecrimewascommittedinSeptemberof1991.ThepetitionerenteredaguiltypleaonhisscheduledtrialdateofMay7,1992.SeeBarkerv.Wingo,407U.S.514(1972);Statev.Bishop,493S.W.2d81(Tenn.1973).Fromallofthis,itappearsthattrialcounselperformedwithintheapplicablestandards.
