Ðher€offðð€and€attempted€to€leave.€€However,€Ms.€Johnson€called€out€to€the€defendant€forÐ <#Œ" Ðassistance.݃ÿÿ1|݌Р"$r# ÐŒÓ  ÓÓÓÝ  ÝÓ XÓÌÓ XÓÑ€ÑÓ  ÓThe€defendant€walked€over€and€he€and€the€victim€began€struggling€for€possession€of€theÐ î%>!% Ðcamera.€€According€to€the€victim,€the€defendant€took€the€camera€and€tossed€it€to€Ms.€Johnson.€Ð Ô&$"& ÐThe€victim€then€punched€the€defendant€in€the€head€and€the€two€men€began€fighting.€€TheyÐ º' #' Ðeventually€fought€their€way€through€a€set€of€double€glass€doors€and€into€the€foyer€of€the€bowlingÐ  (ð#( Ðalley.€€The€foyer€contained€a€set€of€double€glass€doors€leading€outside€the€bowling€alley€andÐ †)Ö$) Ðanother€set€leading€into€the€bowling€alley.€€There€was€also€a€pane€glass€window€on€each€side€ofÐ l*¼%* Ðthe€double€glass€doors.€€While€the€victim€and€the€defendant€were€in€the€foyer,€€Ms.€JohnsonÐ R+¢&+ Ðjumped€on€the€victimððs€back€and€began€clawing€him.€€Then,€according€to€the€victim,€Ms.Ð 8,ˆ', ÐÑÑâ âÑÈÑÑÑâ âÑ  ÑJohnson€and€the€defendant€simultaneously€pushed€him€backwards€through€one€of€the€pane€glassÐ ° Ðwindows,€and€he€landed€outside€on€the€sidewalk.€€As€a€result,€his€leg€was€cut€to€the€bone.€€TheÐ –æ Ðvictim€was€taken€by€ambulance€to€the€Maury€Regional€Hospital€where€immediate€surgery€wasÐ |Ì Ðperformed.€€He€suffered€permanent€nerve€damage€to€his€leg,€missed€six€(6)€weeks€of€work,€woreÐ b² Ðalley€and€ð ðslid€down€the€wall.ðð€€Jonathan€testified€that€the€defendant€went€through€the€glass€firstÐ <#Œ" Ðand€then€kicked€the€victim€back€inside.€€He€stated€that€he€and€Ms.€Johnsonððs€son,€Jesse,€alsoÐ "$r# Ðjoined€in€the€fight€by€hitting€and€kicking€the€victim.€€He€also€indicated€that€Ms.€Johnson€was€notÐ %X $ Ðinvolved€in€the€fight€but€tried€to€pull€the€two€boys€away€from€the€fight.€€He€observed€that€theÐ î%>!% Ðdefendant€sustained€a€couple€of€cuts€on€his€knee€and€elbow€as€a€result€of€the€fight.€€Ð Ô&$"& ÐÓ XÓÌÑ€!ÑÑ€"ÑÓ XÓÓK1ÜÜÜ4Œ ä <”ìDœôL¤ü!ü!°°°ŒX(#KÓJesse€Johnson,€Ms.€Johnsonððs€eleven„year„old€son,€testified€that€the€victim€and€his€wifeÐ  (ð#( Ðwalked€into€the€bowling€alley€and€began€taking€pictures.€€His€mother€attempted€to€grab€theÐ †)Ö$) Ðcamera,€and€the€victim€threw€her€down.€€Jesse€stated€that€the€defendant€and€the€victim€beganÐ l*¼%* Ðfighting.€€Jesse€also€admitted€that€he€kicked€the€victim.€€He€testified€that€both€men€went€throughÐ R+¢&+ Ða€glass€window,€and€the€victim€cut€his€leg.€€Jesse€did€not€know€who€went€through€the€glass€first.€Ð 8,ˆ', ÐÑ !"Ñâ  âÑÑÑÑâ ! âÑÑÑXÑâ "!âѰ°ÑÑX°Ñâ "âÑ  ÑÓ XÓÌÓ XÓMs.€Johnsonððs€twelve„year„old€son,€Hank€Johnson,€testified€that€he€also€saw€theÐ –æ Ðdefendant€and€the€victim€fighting€in€the€bowling€alley.€€However,€he€did€not€see€who€wentÐ |Ì Ðthrough€the€glass€window.€€Ms.€Johnsonððs€eleven„year„old€daughter,€Casey€Johnson,€testifiedÐ b² Ðthat€she€recalled€seeing€a€flash€and€her€mother€attempting€to€grab€a€camera€from€the€victim.€€SheÐ H˜ Ðthought€the€victim€might€have€pushed€her.€€Casey€then€saw€the€defendant€and€the€victimÐ . ~ Ðfighting.€€She€testified€she€did€not€see€them€go€through€the€glass€window,€but€saw€the€brokenÐ  d Ðglass€and€was€aware€the€victimððs€leg€was€cut.€€The€defendant€also€had€a€couple€of€scratches.Ð ú J ÐÓ XÓÌÓ XÓMs.€Johnson,€who€was€a€co„defendant€in€the€instant€case,€testified€that€on€June€19,€1999,Ð Æ   Ðaround€11:00€a.m.€or€12:00€p.m.,€she€spoke€with€the€defendantððs€son,€Jonathan,€on€her€cordlessÐ ¬ ü  Ðtelephone,€and€they€discussed€going€bowling€later€that€evening.€€Later€that€afternoon,€Ms.Ð ’â  ÐJohnson€sat€on€the€front€porch€and€discussed€the€plans€with€the€defendant€over€the€telephone.€Ð xÈ  ÐWhile€she€was€talking€to€the€defendant,€the€victim€was€outside€his€residence€shooting€guns.€€Ms.Ð ^®  ÐJohnson€testified€that€during€her€divorce€proceedings,€audiotapes€of€her€telephone€conversationsÐ D”  Ðwith€the€defendant€and€others€were€introduced.Ð *z  ÐÐ ` ÐLater€that€evening,€Ms.€Johnson€and€her€children€met€the€defendant€and€Jonathan€at€hisÐ öF Ðresidence.€€They€drove€her€Suburban€to€the€Krystal€restaurant€in€Columbia€and€then€drove€toÐ Ü, ÐParkway€Lanes€Bowling€Alley.€€Ms.€Johnson€testified€that€she€and€the€defendant€were€watchingÐ Â Ðthe€children€bowl€when€she€saw€a€flash.€€She€turned€around€and€saw€the€victim€with€a€camera.€Ð ¨ø ÐShe€walked€up€to€the€victim€and€tried€to€take€the€camera€from€him.€€The€victim€threw€her€downÐ ŽÞ Ðon€the€floor,€and€she€received€a€carpet€burn€on€her€knee.€€She€yelled€to€the€defendant,€and€heÐ tÄ Ðwalked€over€and€began€struggling€with€the€victim€for€possession€of€the€camera.€€The€victim€hitÐ Zª Ðthe€defendant€on€the€head,€and€the€two€men€began€fighting.€€They€struggled€with€one€anotherÐ @ Ðinto€the€foyer.€€Ms.€Johnson€testified€that€the€defendant€and€the€victim€both€went€through€a€glassÐ &v Ðwindow€in€the€foyer,€and€the€defendant€kicked€the€victim€back€inside€the€foyer.€€She€testifiedÐ  \ Ðthat€she€did€not€strike€the€victim€but€indicated€that€Jonathan€and€Jesse€had€joined€in€the€fight,€andÐ òB Ðthat€she€tried€to€pull€them€away.€Ð Ø( ÐÓ XÓÌÓ XÓÓE+Ü Ü4Œ ä <”ìDœôL¤ü!ÜÜÜŒXü!EÓOn€cross„examination,€Ms.€Johnson€admitted€that€she€had€entered€an€agreed€orderÐ ¤ô Ðprohibiting€her€from€being€around€the€defendant.€€She€stated€that€the€order€was€entered€on€JuneÐ Š Ú Ð15.€€However,€it€had€not€yet€been€filed€at€the€time€of€the€incident€at€the€bowling€alley.€Ð p!À  ÐAccording€to€Ms.€Johnson,€she€was€around€the€defendant€one€time€after€the€order€was€enteredÐ V"¦! Ðthe€victimððs€serious€injury.€€Although€the€defendant€did€not€intend€to€cause€serious€injury€to€theÐ . ~ Ðvictim,€his€conduct€could€reasonably€be€viewed€as€reckless.€€The€defendant€seems€to€be€arguingÐ  d Ðthat€because€the€victim€was€also€engaging€in€reckless€conduct,€the€defendant€cannot€be€heldÐ ú J Ðaccountable€for€causing€serious€bodily€injury€to€the€victim.€€However,€regardless€of€the€victimððsÐ à 0 Ðequally€reckless€conduct,€the€evidence€established€that€the€defendant€engaged€in€recklessÐ Æ   Ðconduct,€i.e.€fighting€near€a€pane€glass€window,€and€such€reckless€conduct€caused€serious€bodilyÐ ¬ ü  Ðinjury€to€the€victim.€€The€jury€was€instructed€on€the€issue€of€self-defense€and€defense€of€a€thirdÐ ’â  Ðperson€and€obviously€rejected€those€theories.€This€issue€is€without€merit.Ð xÈ  ÐÐ ^®  ÐòòÓ XÓóóII.€€òòJudicial€DiversionÐ D”  ÐÌóóÓ XryÓThe€defendant€next€asserts€that€the€trial€court€erroneously€denied€his€request€for€judicialÐ ` Ðdiversion.€€Judicial€diversion€allows€a€defendant€who€meets€certain€eligibility€criteria€to€beÐ öF Ðplaced€on€probation€and€subsequently€have€the€charges€dismissed,€if€the€probationary€period€isÐ Ü, Ðcompleted€successfully.€Tenn.€Code€Ann.€ðð€40„35„313.€€Tennessee€Code€Annotated€section€Ð  Ð40-35-313(a)(1)(A)€provides€that€a€defendant€is€eligible€for€judicial€diversion€if€he€or€she€(a)€ð ðisÐ ¨ø Ðfound€guilty€or€pleads€guilty€to€.€.€.€a€Class€C,€D€or€E€felony,ðð€(b)€has€not€previously€beenÐ ŽÞ Ðconvicted€of€a€felony,€and€(c)€consents€to€the€deferment€of€proceedings€and€placement€onÐ tÄ ðthere€were€two€men€engaged€in€this€fight,€and€either€one€of€them€could€haveÐ . ~ Ðhad€their€leg€cut€by€this€window.ðð€€The€trial€court€also€found€that€the€circumstances€of€theÐ  d Ðoffense€were€so€unusual€as€to€be€unlikely€to€be€repeated.€€In€addition,€the€trial€court€found€thatÐ ú J Ðthe€defendant€had€six€years€of€regular€employment€prior€to€his€conviction.€€Finally,€the€trial€courtÐ à 0 Ðrecognized€that€defendant€ð ðwas€committing€adultery,€and€thatððs€maybe€an€immoral€act€but€it€wasÐ Æ   Ðnot€an€illegal€act.€€It€wasnððt€even€in€violation€of€the€Williamson€County€[divorce]€court€order.ððÐ ¬ ü  ЀÌà àI€think€the€Court€will€grant€[judicial€diversion]€some€day,€andÐ Zª Ðmaybe€grant€it€even€on€a€crime€involving€violence,€when€the€CourtÐ @ Ðfinds€that€the€victim€was€sufficiently€involved€in€the€provocationÐ &v Ðas€existed€in€this€case.Ð \` x` x Ðà  àÌà  àà8 ` à€€€€€And€I€do€regret€that€[the€defendant]€may€lose€his€long„termÐ Ø( ’â  Ðintentionally€or€knowingly.€€Ð xÈ  ÐÌà  àThere€is€no€proof€contained€in€the€record€that€the€trial€court€considered€the€requiredÐ D”  Ðfactors€for€determining€whether€a€defendant€should€be€placed€on€judicial€diversion.€WeÐ *z  Ðacknowledge€the€trial€courtððs€finding€that€the€defendant€was€having€an€affair€with€a€marriedÐ ` Ðwoman€while€a€court€order€was€in€place€that€prohibited€her€from€having€contact€with€theÐ öF Ðdefendant.€€However,€we€also€recognize,€as€did€the€trial€court,€that€the€defendant€was€not€underÐ Ü, Ðsuch€court€order€and€therefore,€did€not€violate€it.€€As€such,€we€find€the€defendantððs€conduct€doesÐ Â
