ThedriveroftheCamarostoppedthevehicleinthe L  middleofthestreetandthenspedfurtherdowntheroad. Asthedriverwasmakingarightturn,the 8  wheelsofthevehiclejumpedthecurbontothesidewalk.OfficerNewmanactivatedhisbluelights, $ t andthedriverofthevehiclepulledtothesideoftheroad. However,thedriverthenpulledback  ` ontotheroadandproceededacrossabridge. AsOfficerNewmanfollowedthecaracrossthebridge,  L  thedriverofthevehiclemadeobscenehandgesturesoutofthewindow. Finally,asthedriver  8  reachedtheothersideofthebridge,hepulledhisvehicletothesideoftheroadandstopped.  $    Attrial,thedriverofthevehiclewasidentifiedastheappellant. OfficerNewmantestified   thatasheapproachedthevehicle,henoticedanodorofalcohol. Astheappellantsteppedfromhis   vehicle,healmostfell.BecauseOfficerNewmancouldsmellalcohol emittingoffoftheappellant,   heaskedthedrivertoperformasobrietytest.Whentheappellantdidnotperformthesobrietytest   toOfficerNewmanssatisfaction,hearrestedtheappellantfordrivingundertheinfluence.  p   Whentheofficerhandcuffedhim,theappellantbecamethreateningandbelligerent. Officer \ Newmansearchedtheappellantforweaponsandfoundsomebrassknuckles,aswellaspepper H spray,intheappellantsfrontpocket. Theofficerthentransportedtheappellanttothecountyjail, 4 andduringtheride,theappellantthreatenedtheofficerfurther. Heinformedtheofficerthathe  p intendedtousethepeppersprayonthepolice.
