Thedefendant,afortyfiveyearoldmale,rapedhisthirteenyearolddaughter  XXXX  1      ׀onemorningafterhiswifehadleftforwork.Thevictimwasinbedwhenthe  Мdefendanttoldhertotakeoffherunderpants.Whensherefusedtoobey,heforcedherkneesstraightandpulledoffherunderpants.Heremovedhisclothingandsexuallypenetratedherforthirtyminutes.Hethentoldhertotakeashowerandprepareforschool.Thedefendantdrovehertoschool,whereshereportedtherape.  Thedefendantpledguilty,agreeingtoanegotiatedsentenceofeightyears.Thecauseproceededtoasentencinghearing,wherethedefendantrequestedcommunityreleaseinlieuofconfinement.Accordingtothedefendantstestimonyatthehearing,thedefendantdidnotremembertheexacteventsduringtherape,althoughhedidrecallpenetratingthevictim.Thedefendantwishedtomaintainafamilyrelationshipwithhiswifeandthevictimandstatedthatheshoulderedfullresponsibilityfortherape.Thedefendantalsoadmittedhavingalengthypriorrecord,beginningatageeighteenornineteen,althoughheclaimednottorememberallofhispastoffenses.Thedefendantdescribedhispresentmentalhealthas fairbecauseheallowedtherapetooccur,andhenotedthatbecauseoftherape,hewasattendingcounseling.Thepresentencereport 3*/ acknowledgesahistoryofdrugandalcoholuse,butthedefendantmaintainedhehadnotusedillegaldrugsineighteenyearsandhadnotdraunkalcoholheavilysincearound1981.Headmittedtopresentlyenjoyingacoldbeeronahotday,buthemaintainedthat abstinencewouldbenoproblemifthecourtsoordered.  Attheconclusionofthehearing,thetrialcourtacceptedtheStatesrecommendationofeightyears,whichwastheminimumsentencefortheoffense,butnotedthattheevidencecouldhavesupportedthreeenhancingfactors,includingthevictimsyoungage,theabuseofapositionoftrust,andthedefendantshistoryofcriminalconduct.Indeterminingwhetherthedefendantshouldbereleasedintothecommunityduringhiseightyearsentence,thetrialcourtnotedthattherewasnorestitutiontobemadeinthiscaseandthatconfinementwasnecessarytoprotectsocietyfromthedefendantandtoavoiddepreciatingtheoffense.Thetrialcourtalsorecognizedthatitshouldconsiderthedefendantspotentialforrehabilitation.Notingthattheoffensewastheforciblerapeofayoungchild,thetrialcourtstatedthatthedefendantwasnotanappropriatecandidateforanykindofreleaseandorderedthedefendanttoservehissentenceintheDepartmentofCorrection.Thedefendantnowappeals,arguingthatthetrialcourtimproperlyconsideredhiseligibilityforalternativesentencing.#XXXX挂#  SincethedefendantpledguiltytoaClassBfelony,hedidnotenjoythepresumptionofalternativesentencingunderT.C.A.4035102(6).WhilebothpartiesagreethatthedefendantisstatutorilyeligibleforprobationunderT.C.A.4035303(a)becausethesentenceimposedwaseightyears,theydisagreeastowhetherthedefendantisstatutorilyeligibleforcommunitycorrectionsunderT.C.A.񛀜 L6,2 4036106.  Section4036106(a)providesthatpersonsconvictedofcrimesagainstthe L6,2 personasprovidedintitle39,chapter13,parts15andpersonsconvictedofviolentfelonyoffensesarenoteligibleforcommunitycorrections.4036106(a)(2)(3).Becausethedefendantwasconvictedofrape,aviolentfelonyoffense,inviolationof3913503,heisnoteligibleforcommunitycorrectionsunder4036106(a).Thedefendantcontends,however,thatheiseligibleforcommunitycorrectionsunder4036106(c),whichprovides:8  Felonyoffendersnototherwiseeligibleundersubsection(a),andwhowouldbeusuallyconsideredunfitforprobationduetohistoriesofchronicalcohol,drugabuse,ormentalhealthproblems,butwhosespecialneedsaretreatableandcouldbeservedbestinthecommunityratherthaninacorrectionalinstitution,maybeconsideredeligibleforpunishmentinthecommunityundertheprovisionsofthischapter.  " " !Wedisagree.Therecordisdevoidofanyevidencethatthedefendantsuffersfrommentalhealthproblems,apartfromthedefendantspassingassessmentthatrapinghisdaughterhascausedhismentalhealthtobe fair.Thedefendantspriorcriminalrecordshowssomeillicitdruguseandalcoholabuseduringthe1970s.However,thedefendantexplicitlydeniedanyillegaldrugoralcoholuseinthepasteighteenyears.Hemaintainedthathequitdrinkingalcohol coldturkeyaround1981andnowonlydrinksacoldbeerinhotweather.Thedefendantalsoboastedthathehasabstainedfromalcoholforaslongassixyearsandthatfurtherabstinencewouldbe noproblemifthecourtsoordered.Giventhedefendantsadmissionsconcerninghisalcoholanddruguse(orlackthereof)andthelackofevidencethatthedefendantsuffersfrommentalhealthproblems,thedefendantdoesnothave specialneedsthatwouldqualifyhimforcommunitycorrectionsunder4036106(c).
