BACKGROUND <     ` OnMarch15,1995,theappellantfiledapetitionforpostconvictionreliefinthe   UnicoiCountyCriminalCourt.InJune,1991,theappellantwasfoundguiltyoffirstdegreemurderandrecklessendangermentwithadeadlyweapon.Theappellantwassentencedtolifeinprisonforthemurderchargeandtotwoyearsimprisonmentfortherecklessendangermentwithadeadlyweaponcharge.Inhispetition,theappellantallegedineffectiveassistanceofcounselatboththetrialandappellatelevels.Shortlyaftertheappellantspetitionwasfiled,thePublicDefendersofficewasappointedtorepresenttheappellantduetoindigence.TherecordreflectstwoamendmentstothepostconvictionpetitionwerefiledbythePublicDefender.Forvariousreasons,thepetitionwascontinuedtoOctober,1997. ` OnSeptember23,1997,KennethF.Irvine,Jr.,Esq.filedanentryofappearanceinbehalfoftheappellant.OnOctober17,1997,thetrialcourtconductedahearingontheappellantsrequestforsubstitutionofcounselandacontinuance.Mr.Irvineappearedatthehearing.Duringthediscussionwithcounsel,thetrialcourtexpresseditsconcernovertheinabilitytodisposeofthecause.Mr.Irvineadvisedthetrialcourtthattheappellantwasstillincarcerated,buttheappellantsfamilywaswillingtopayhisfee,andhewouldbereadytodisposeofthepetitionwithinthirtydays.ThetrialcourtdeterminedthatthePublicDefenderhadinvestedapproximately25hoursinitsrepresentationoftheappellant |948 atarateof$40perhour.Thetrialcourtdeterminedthattheappellantsrepresentationcostthetaxpayersinexcessof$1,000. ` Itisclearfromtherecordthatthetrialcourtwasirritatedwiththeappellantsfamilysuddenlycomingforthwiththefundstopayprivatecounselatsuchlatedate.Thetrialcourtpermittedthesubstitutionofcounselwiththerequirementthattheappellantsfamilypay$500tothePublicDefendersfund.Thetrialcourtcitednoauthorityforitsruling.AnorderwasenteredonNovember7,1997,reflectingtheconditionalgrantoftheappellantsrequestforsubstitutionofcounselandresettingthecaseforDecember9,1997todetermineifthefamilyhadpaidthe$500.
