ÐÌà  àPerry€testified€that€while€out€on€bond,€the€Defendant€came€to€her€home€in€June€or€July€2000Ð Ì&"% Ðto€pick€up€their€daughter.€€She€recalled€that€when€the€Defendant€arrived,€she€invited€him€into€herÐ ¸'#& Ðhome€because€their€daughter€was€eating.€€Perry€stated€that€the€Defendant€told€her€he€ð ðwanted€toÐ ¤(ô#' Ðtalk,ðð€and€she€responded,€ð ðNo€more€talking.€.€.€.€Itððs€completely€over.€€I€donððt€want€anything€to€doÐ )à$( Ðwith€you.ðð€€According€to€Perry,€the€Defendant€then€leaned€down€to€their€daughter,€who€was€fourÐ |*Ì%) Ðyears€old€at€the€time,€and€said,€ð ðDaddyððs€going€to€kill€himself€and€itððs€Mommyððs€fault.ðð€€Perry,€notÐ h+¸&* Ðtaking€the€Defendantððs€threats€seriously,€watched€the€Defendant€exit€through€her€back€door.€€ShortlyÐ ° Ðthereafter,€she€noticed€that€he€had€hung€himself€from€a€light€cord€on€the€deck.€€Perry€testified€thatÐ œì Ðshe€called€9„1„1,€went€outside,€cut€the€Defendant€down,€and€began€to€perform€CPR€on€theÐ ˆØ ÐDefendant.€€She€stated€that€the€Defendant€was€ð ðdeadðð€when€she€cut€him€down,€but€she€was€able€toÐ tÄ Ðresuscitate€him.Ð `° ÐÌà  àPerry€testified€that€two€mornings€later,€the€Defendant€again€appeared€at€her€door.€€€She€statedÐ 8 ˆ Ðthat€he€was€angry€because€she€had€ð ðcut€him€down.ðð€€She€testified€that€while€her€daughter€was€in€theÐ $ t Ðroom,€the€Defendant€told€her€that€ð ð[h]e€had€fulfilled€what€he€wanted€to€do€and€[she]€had€stoppedÐ  ` Ðhim,€and€that€next€time€he€did€this€he€would€take€more€people€with€him.ðð€€Perry€stated€that€she€thenÐ ü L  Ðcalled€the€police.Ð è 8  ÐÌà  àPerry€reported€that€her€daughter€had€been€traumatized€by€the€Defendantððs€suicide€attempt€andÐ À  Ðwas€undergoing€therapy.€€Perry€also€testified€that€she€was€having€nightmares€as€a€result€of€theÐ ¬ü  ÐDefendantððs€behavior,€that€she€would€not€go€to€the€back€of€her€house€after€the€suicide€attempt,€andÐ ˜è  Ðthat€she€was€frightened€of€the€Defendant.€€She€reported€that€the€Defendant€had€a€history€of€abusiveÐ „Ô  Ðbehavior€towards€her,€and€she€stated€that€she€had€previously€sought€protection€orders€against€him.€Ð pÀ ÐPerry€expressed€her€hope€that€the€Defendant€receive€the€maximum€sentence€possible€so€that€sheÐ \¬ Ðcould€feel€safe.€€Ð H˜ ÐÌà  àOn€cross„examination,€Perry€was€asked€whether€she€reconciled€with€the€Defendant€after€theÐ  p Ðcrimes€to€which€the€Defendant€had€pled€guilty.€€She€responded,€ð ðI€wouldnððt€actually€call€it€reconcile.€Ð  \ ÐI€kept€[the€Defendant]€close€to€me€because€nobody€in€the€police€department€could€seem€to€find€himÐ øH Ðafter€he€disappeared,€and€with€one€phone€call€I€managed€to€find€him€when€no€one€else€could.ðð€€PerryÐ ä4 Ðadmitted,€however,€that€several€months€later,€she€reconciled€with€the€Defendant€ð ð[o]ff€and€on,ðð€andÐ Ð  Ðat€one€point,€she€went€to€court€with€the€Defendant€to€help€him€with€the€charges€in€this€case.€€€€€€Ð ¼  ÐÌà  àPerry€specified€on€cross„examination€that€the€Defendant€assaulted€her€by€getting€on€top€ofÐ ”ä Ðher€on€the€ground€and€placing€his€hands€around€her€neck.€€She€reported€that€she€sustained€bruisesÐ €Ð Ðas€a€result€of€the€attack€and€that€on€the€following€day,€after€she€ð ðgot€[her]€kids€safe,ðð€she€went€to€theÐ l¼ Ðhospital.€€Perry€also€testified€that€on€a€previous€occasion,€the€Defendant€either€threw€her€onto€theÐ X ¨ Ðfloor€or€dropped€her,€causing€her€to€sprain€her€ankle.€€She€reported€that€on€other€occasions,€theÐ D!” ÐDefendant€had€bruised€her.€€Ð 0"€  ÐÌà  àPerry€stated€on€cross„examination€that€she€had€obtained€ð ð[q]uite€a€fewðð€orders€of€protectionÐ $X" Ðagainst€the€Defendant.€€She€admitted€that€in€one€of€the€orders€of€protection,€she€alleged€that€theÐ ô$D # ÐDefendant€had€abused€or€molested€her€son.€€She€further€testified€that€in€an€order€of€protection€thatÐ à%0!$ Ðwas€being€filed€at€the€time€of€the€hearing,€she€alleged€that€the€Defendant€had€molested€their€daughter.€Ð Ì&"% ÐÌÌà  àChris€Chambers,€a€member€of€the€Domestic€Violence€Task€Force€of€the€Hamilton€CountyÐ )à$( ÐSheriffððs€Department,€testified€that€he€was€involved€in€the€investigation€of€this€case€and€that€heÐ |*Ì%) Ðð ðactively€search[ed]ðð€for€the€Defendant€after€a€capias€was€issued€for€the€Defendantððs€arrest€followingÐ h+¸&* Ðincidents€involving€Pam€Perry.€€Chambers€recalled€that€during€this€time,€he€spoke€with€Perry€on€theÐ ° Ðphone€on€several€occasions€and€arranged€to€have€her€phone€calls€ð ðtracked.ðð€€According€to€Chambers,Ð œì ÐPerry€called€him€in€July€2000€and€told€him€that€she€could€provide€phone€numbers€that€ChambersÐ ˆØ Ðcould€use€to€reach€the€Defendant.€€Chambers€used€the€phone€numbers€to€try€to€locate€the€Defendant,Ð tÄ Ðbut€according€to€Chambers,€the€Defendant€was€ð ðelusive.ðð€€Chambers€testified,€however,€that€one€ofÐ `° Ðthe€phone€numbers,€which€belonged€to€a€woman,€eventually€led€him€to€the€Defendant.€€Ð L œ ÐÌà  àChambers€testified€that€when€he€went€to€the€womanððs€apartment,€he€knocked€on€the€door,Ð $ t Ðbut€received€no€answer.€€However,€as€he€began€to€leave,€the€door€opened,€and€Chambers€saw€theÐ  ` ÐDefendant€standing€in€the€doorway.€€Chambers€testified€that€he€pulled€his€gun€and€told€the€DefendantÐ ü L  Ðto€turn€around€and€place€his€hands€behind€his€back.€€Chambers€reported€that€as€he€began€to€placeÐ è 8  Ðhandcuffs€on€the€Defendant,€the€Defendant€ran€into€the€hallway.€€Chambers€testified€that€heÐ Ô$  Ðð ðtackledðð€the€Defendant,€but€the€Defendant€was€able€to€break€free€and€run€to€a€second„story€windowÐ À  Ðat€the€end€of€the€hall.€€Chambers€reported€that€the€Defendant€next€jumped€from€the€window,€rolledÐ ¬ü  Ðover,€stood€up,€and€then€continued€to€run.€He€stated€that€he€pursued€and€eventually€caught€theÐ ˜è  ÐDefendant.€€Chambers€testified€that€the€Defendant€broke€his€ankles€when€he€jumped€out€of€theÐ „Ô  Ðwindow.Ð pÀ ÐÌà  àChambers€testified€that€he€also€investigated€the€assault€and€aggravated€burglary€committedÐ H˜ Ðagainst€Perry.€€He€stated€that€he€examined€Perryððs€phone€lines.€€He€reported€that€he€also€noted€a€largeÐ 4„ Ðhole€in€the€wall€of€Perryððs€apartment€from€which€he€could€view€the€apartment€next€door,€which€wasÐ  p Ðvacant€at€the€time.€€Chambers€stated€that€he€ð ðinvestigate[d]€that€as€possibly€[the€Defendant]€beingÐ  \ Ðthere.ðð€€€€€€€€€€€€€€€€Ð øH ÐÌà  àWilliam€Cason,€a€family€violence€investigator€for€the€Walker€County,€Georgia€SheriffððsÐ Ð  ÐDepartment,€testified€that€he€first€became€familiar€with€the€Defendant€three€and€a€half€years€priorÐ ¼  Ðto€the€hearing.€€He€stated€that€at€that€time,€he€received€a€phone€call€from€an€attorney€representing€theÐ ¨ø ÐDefendantððs€former€spouse,€Pam€Perry,€whose€name€was€then€Pam€Haskett.€€At€the€attorneyððsÐ ”ä Ðrequest,€Cason€went€to€the€Haskett€residence€after€receiving€information€that€Pam€Haskett€wasÐ €Ð Ðð ðbeing€kept€from€leaving€the€residence€of€her€own€free€will.ðð€€Cason€stated€that€when€he€arrived€atÐ l¼ Ðthe€home,€there€were€ð ðindications€that€[the€Defendant]€was,€in€fact,€holding€her€there,€though€notÐ X ¨ Ðphysically,€more€psychologically€against€her€will.ðð€€Cason€stated€that€he€transported€Pam€HaskettÐ D!” Ðfrom€the€home,€and€they€then€went€to€pick€up€her€children.€€Cason€testified€that€while€they€were€inÐ 0"€  Ðthe€process€of€picking€up€one€of€the€children,€the€Defendant€drove€to€the€location€at€a€very€high€rateÐ #l! Ðof€speed,€jumped€out€of€his€car,€and€began€making€ð ðreal€random,€vague€.€.€.€threats,ðð€such€as€ð ðhe€wasÐ $X" Ðgoing€to€get€even€if€she€tried€to€take€her€child.ðð€€Cason€stated€that€he€drew€his€weapon€and€told€theÐ ô$D # ÐDefendant€ð ðif€he€took€another€step€he€was€going€to€make€a€mistake€he€would€regret.ððÐ à%0!$ ÐÌà  àCason€stated€that€he€had€also€attempted€to€serve€temporary€protective€orders€on€theÐ ¸'#& ÐDefendant.€€He€stated€that€on€the€last€occasion€when€he€tried€to€serve€a€protective€order€on€theÐ ¤(ô#' ÐDefendant,€he€went€to€the€home€of€the€Defendantððs€father.€€Cason€reported€that€when€he€reached€theÐ )à$( Ðâ âhouse,€there€were€no€tire€tracks€leading€to€or€from€the€house,€although€it€had€been€snowing.€€HeÐ |*Ì%) Ðstated,€ð ðI€have€every€reason€to€believe€[the€Defendant]€was€there€but€his€father€told€me€that€he€wasÐ ° Ðnot€there.ðð€€Ð œì Ðâ âÌà  àFinally,€Cason€testified€that€he€was€investigating€the€Defendant€concerning€the€allegedÐ tÄ Ðmolestation€of€Pam€Perryððs€oldest€child.€€He€reported€that€he€also€planned€to€begin€investigating€theÐ `° Ðalleged€molestation€of€Perryððs€daughter.€€€€Ð L œ ÐÌà  àSandra€Caldwell,€an€employee€of€the€Board€of€Probation€and€Paroles€for€the€State€ofÐ $ t ÐTennessee,€testified€that€she€prepared€the€presentence€report€in€this€case.€€She€stated€that€on€JanuaryÐ  ` Ð31,€2001,€she€interviewed€the€Defendant.€€According€to€Caldwell,€the€Defendant€accepted€noÐ ü L  Ðresponsibility€for€his€actions€and€instead€told€her€that€ð ðthis€was€the€result€of€his€ex„wife€beingÐ è 8  Ðvindictive.ðð€€Ð Ô$  ÐÌà  àShelba€Haskett,€the€Defendantððs€mother,€testified€that€she€recalled€the€incidents€leading€toÐ ¬ü  Ðthe€Defendantððs€arrest€in€this€case.€€She€stated€that€after€the€incidents,€Perry€visited€her€home€aÐ ˜è  Ðcouple€of€times€and€also€called€her€home.€€Ms.€Haskett€further€testified€that€during€April€and€MayÐ „Ô  Ðof€1999,€Perry€brought€her€car€to€the€Haskett€home,€and€the€Defendant€put€brakes€on€the€car.€Ð pÀ ÐAccording€to€Ms.€Haskett,€Perry€did€not€appear€to€be€afraid€of€the€Defendant€at€any€time€during€thisÐ \¬ Ðperiod.€€In€addition,€she€testified€that€when€the€Defendant€did€not€call€Perry,€Perry€called€theÐ H˜ ÐDefendant.€€Haskett€stated,€ð ðI€just€thought€they€had€gotten€back€together€again€and€thatððs€the€way€itÐ 4„ Ðappeared€to€me.€€Seemed€like€things€were€working€out.ðð€€Ð  p ÐÌà  àThe€Defendant€testified€that€he€was€thirty„four€years€old€at€the€time€of€the€hearing.€€He€statedÐ øH Ðthat€he€had€been€working€in€pest€control€for€two€years€prior€to€breaking€his€ankles.€€He€explained€thatÐ ä4 Ðat€the€time€of€the€hearing,€he€had€two€broken€ankles,€one€ð ðcrushedðð€foot,€and€six€injured€vertebrasÐ Ð  Ðin€his€spine.€€He€also€reported€that€he€had€undergone€one€surgery€and€expected€to€undergo€three€moreÐ ¼  Ðsurgeries.€€He€stated€that€he€had€been€in€a€wheelchair€and€that€he€had€been€incarcerated€for€overÐ ¨ø Ðseven€months.€€€Ð ”ä ÐÌà  àThe€Defendant€testified€that€he€was€married€to€Pam€Perry€from€1995€until€1998.€€He€reportedÐ l¼ Ðthat€they€had€one€child€together.€€The€Defendant€testified€that€although€he€was€a€Georgia€resident,Ð X ¨ Ðhe€planned€to€move€to€Nashville€with€his€new€girlfriend€and€work€in€ð ðsalesðð€upon€his€release.€€HeÐ D!” Ðstated€that€he€wished€to€ð ðget[]€awayðð€from€Perry€because€she€is€a€ð ðdangerous€woman.ðð€€HeÐ 0"€  Ðexplained,€ð ð[S]he€initiates€the€phone€calls€for€us€to€get€back€together€and€we€do€reconcile,€and€whenÐ #l! Ðshe€calls€it€quits,€she€donððt€know€how€to€say,€Well,€itððs€over€with.€€She€wants€to€call€the€law€and€getÐ $X" Ðthe€law€involved€to€put€a€stop€to€the€relationship,€and€thatððs€happened€every€single€time€that€we€haveÐ ô$D # Ðreconciled.ðð€€The€Defendant€claimed€that€he€had€ð ðbeat€protective€ordersðð€on€appeal€for€these€reasons.€Ð à%0!$ ÐHe€also€maintained€that€Perry€asked€a€judge€to€drop€the€first€two€protective€orders€that€the€judge€hadÐ Ì&"% Ðgranted.€€The€Defendant€stated,€ð ð[S]heððs€used€the€law€and€used€the€law€.€.€.€and€abused€the€law€to€herÐ ¸'#& Ð.€.€.€convenience.ðð€€Ð ¤(ô#' ÐÌà  àThe€Defendant€explained€that€he€pled€guilty€to€the€charges€in€this€case€because€he€had€enteredÐ |*Ì%) ÐPerryððs€home€without€her€permission.€€He€maintained€that€he€and€Perry€were€dating€at€the€time€andÐ h+¸&* Ðthat€he€went€into€her€home€to€see€who€was€inside€the€residence.€€However,€he€also€testified€that€PerryÐ ° Ðhad€told€him€to€ð ðwatchðð€her€apartment€because€she€was€afraid€that€her€first€former€husband€had€hiredÐ œì Ða€private€investigator€to€watch€her.€€With€regard€to€the€crimes€in€this€case,€the€Defendant€reportedÐ ˆØ Ðthat€as€he€was€watching€Perryððs€apartment,€a€car€pulled€up,€and€people€entered€the€apartment.€€TheÐ tÄ ÐDefendant€testified€that€he€wanted€to€know€what€was€happening,€so€he€approached€Perry€as€sheÐ `° Ðexited€her€apartment.€€He€maintained€that€she€stopped,€and€they€ð ðcollided€head„on.ðð€€He€deniedÐ L œ Ðputting€his€hands€around€her€neck.€€The€Defendant€stated€that€he€then€left,€telling€Perry,€ð ðIððm€doneÐ 8 ˆ Ðwith€it,€thatððs€it,€Iððm€through€with€it.ðð€€He€claimed€that€his€next€contact€was€with€Chris€ChambersÐ $ t Ðwhen€he€ð ðturned€[him]self€in.ðð€€The€Defendant€reported€that€three€months€later,€Perry€contacted€him,Ð  ` Ðand€they€subsequently€reconciled.€€€Ð ü L  ÐÌà  àThe€Defendant€insisted€that€he€had€never€harmed€Perry€and€that€he€had€never€threatened€her.€Ð Ô$  ÐHowever,€he€admitted€that€on€one€occasion€when€he€and€Perry€were€drinking,€he€picked€her€up€whileÐ À  Ðthey€were€walking€into€their€bedroom€and€dropped€her.€€He€stated€that€at€the€time,€they€had€beenÐ ¬ü  Ðarguing€for€five€to€ten€minutes.€€He€stated€that€when€he€dropped€Perry,€she€ð ðbruised€her€sprainedÐ ˜è  Ðankle.ððÐ „Ô  ÐÌà  àWith€regard€to€his€suicide€attempt,€the€Defendant€testified€that€he€was€depressed€and€hadÐ \¬ Ðbeen€taking€Prozac€for€his€depression.€€He€stated,€ð ðI€have€found€out€that€the€drug€Prozac€causes€that.ðð€Ð H˜ ÐHe€admitted€that€he€hung€himself€while€his€daughter€was€inside€her€home.€€He€recalled€that€prior€toÐ 4„ Ðattempting€suicide,€he€kissed€his€daughter€and€told€her€that€he€loved€her;€he€could€not€recall€whetherÐ  p Ðhe€told€her€what€he€planned€to€do.€€The€Defendant€denied€threatening€to€take€others€with€him€on€hisÐ  \ Ðnext€suicide€attempt.€€Ð øH ÐÌà  àWith€regard€to€his€criminal€record,€the€Defendant€admitted€that€a€warrant€was€outstandingÐ Ð  Ðagainst€him€in€Florida€for€resisting€a€ð ðstop€and€frisk,ðð€and€he€explained€that€he€did€not€show€up€inÐ ¼  Ðcourt€for€the€charge€because€he€had€ð ðnever€been€back€down€to€.€.€.€Florida.ðð€€He€also€admitted€thatÐ ¨ø Ðin€1992,€he€was€charged€with€several€crimes,€including€aggravated€assault,€interference€withÐ ”ä Ðgovernment€property,€and€a€drug„related€charge,€but€he€maintained€that€all€of€the€crimes€occurredÐ €Ð Ðð ðat€the€same€time.ðð€€He€stated€that€for€his€convictions€from€1992,€he€served€several€months€in€jailÐ l¼ Ðand€received€five€years€probation.€€He€denied€ever€violating€probation.€€The€Defendant€also€admittedÐ X ¨ Ðthat€he€was€convicted€three€times€in€1991€for€writing€bad€checks;€he€stated€that€he€served€no€timeÐ D!” Ðfor€the€convictions€and€had€paid€all€restitution€resulting€from€the€crimes.€€The€Defendant€maintainedÐ 0"€  Ðthat€he€ð ðhadnððt€been€in€any€trouble€since€ðð93.ðð€€Ð #l! Ðenhancement€factors€(4),€(8)€and€(11)€to€the€Defendantððs€conviction€for€aggravated€burglary.€Ð $X" ÐEnhancement€factor€(3)€requires€that€the€offense€involve€more€than€one€victim.€€òòSeeóó€òòid.óó€ðð€40„35„Ð ô$D # Ð114(3).€€Enhancement€factor€(4)€states€that€ð ð[a]€victim€of€the€offense€was€particularly€vulnerableÐ à%0!$ Ðbecause€of€ageÔ#†X!XXX!þ¡#ÔÔ‡X!XXX!Ô€.€.€.€.ðð€€òòId.óó€ðð€40„35„114(4).€€Ô#†X!XXX!ئ#ÔÔ‡X!XXX!ÔThe€trial€court€based€its€application€of€these€factors€on€theÐ Ì&"% Ðpresence€of€the€Defendantððs€four„year„old€daughter€when€the€Defendant€committed€the€aggravatedÐ ¸'#& Ðburglary€of€his€former€wifeððs€residence€and€when€the€Defendant€assaulted€his€former€wife.€€TheÐ ¤(ô#' Ðindictment€in€this€case€specifically€charged€the€Defendant€with€aggravated€assault€against€his€formerÐ )à$( Ðwife,€Pam€Perry.€€The€Tennessee€Supreme€Court€has€stated€that€there€cannot€be€multiple€victims€forÐ |*Ì%) Ðan€offense€committed€against€a€specific,€named€victim.€€òòSeeóó€òòImfeldóó,€70€S.W.3d€at€705„706.€€BecauseÐ h+¸&* Ðthe€four„year„old€daughter€was€not€a€victim€of€the€assault,€she€was€not€a€ð ðparticularly€vulnerableððÐ ° Ðvictim.€€Thus,€factors€(3)€and€(4)€were€erroneously€applied€to€the€assault€conviction.€€Ð œì ÐÌà  àHowever,€we€have€concluded€that€the€trial€court€did€not€err€by€applying€enhancement€factorÐ tÄ Ð(3)€to€the€Defendantððs€conviction€for€aggravated€burglary.€€The€Defendantððs€four„year„old€daughterÐ `° Ðwas€a€resident€of€the€apartment€and€present€at€the€time€that€the€Defendant€committed€the€aggravatedÐ L œ Ðburglary€of€the€apartment.€€The€apartment€was€the€habitat€of€both€Pam€Perry,€(the€DefendantððsÐ 8 ˆ Ðformer€wife)€and€the€Defendantððs€four„year„old€daughter.€€Thus,€the€aggravated€burglary€offenseÐ $ t Ðinvolved€more€than€one€victim€so€enhancement€factor€(3)€was€applicable€to€that€offense.€€We€believeÐ  ` Ðthat€this€case€is€more€akin€to€the€multiple€victims€scenario€in€òòState€v€Lewisóó,€44€S.W.3d€501,€507„08Ð ü L  Ð(Tenn.€2001),€which€involved€the€crime€of€aggravated€arson,€rather€than€òòImfeldóó,€which€involvedÐ è 8  Ðseveral€aggravated€assault€offenses,€each€of€which€was€committed€against€a€specific,€named€victim.€Ð Ô$  ÐIn€òòLewisóó,€a€ð ðvictimðð€is€defined,€for€purposes€of€enhancement€factor€(3),Ô#†X!XXX!F§#ÔÔ‡X!XXX!Ô€as€a€€person€(or€entity)€whoÐ À  Ðis€ð ðinjured,€killed,€had€property€stolen,€or€had€property€destroyed€by€the€perpetrator€of€the€crime.ðð€Ð ¬ü  ÐòòId.óó€at€508,€(quoting€òòState€v.€Rainesóó,€882€S.W.2d€376,€384€(Tenn.€Crim.€App.€1994)).€€That€definitionÐ ˜è  Ðwould€not€include€the€four„year„old€daughter€in€this€case.€€However,€we€note€that€it€is€quite€possibleÐ „Ô  Ðfor€an€aggravated€burglary€to€occur€without€any€victim€being€injured,€killed,€or€having€any€propertyÐ pÀ Ðstolen€or€destroyed,€but€the€inhabitants€of€the€burglarized€habitation€are€clearly€victims€of€the€crime.€Ð \¬ ÐTherefore,€we€do€not€interpret€the€òòLewisóó€definition€of€ð ðvictimðð€as€being€all„inclusive.€€Under€theÐ H˜ Ðfacts€of€this€case,€with€the€four„year„old€daughter€being€an€inhabitant€of€the€apartment,€andÐ 4„ Ðparticularly€since€she€was€present€when€the€aggravated€burglary€occurred,€we€believe€that€the€trialÐ  p Ðcourt€properly€applied€enhancement€factor€(3)€to€the€Defendantððs€sentence€for€aggravated€burglary.Ð  \ ÐÌà  àHaving€concluded€that€the€Defendantððs€four„year„old€daughter€was€a€victim€in€the€aggravatedÐ ä4 Ðburglary€case,€we€must€now€review€the€trial€courtððs€application€of€enhancement€factor€(4)€to€theÐ Ð  Ðaggravated€burglary€conviction.€€As€previously€noted,€enhancement€factor€(4)€states€that€ð ð[a]€victimÐ ¼  Ðof€the€offense€was€particularly€vulnerable€because€of€age€.€.€.€.ðð€€Tenn.€Code€Ann.€ðð€40„35„114(4).€Ð ¨ø ÐWhether€a€victim€is€ð ðparticularly€vulnerableðð€for€purposes€of€enhancement€factor€(4)€is€a€factualÐ ”ä Ðissue€to€be€resolved€by€the€trier€of€fact€on€a€case€by€case€basis.€€òòState€v.€Adamsóó,€864€S.W.2d€31,€35Ð €Ð Ð(Tenn.€1993).€€The€application€of€enhancement€factor€(4)€would€be€appropriate€in€this€case€if€theÐ l¼ Ðfacts€show€that€the€Defendantððs€daughterððs€age€had€some€bearing€on€or€some€logical€connection€toÐ X ¨ Ðð ðan€inability€to€resist€the€crime,€summon€help,€or€testify€at€a€later€date.ðð€€òòPooleóó,€945€S.W.2d€at€96.€Ð D!” ÐA€victimððs€youth€does€not€necessarily€equate€with€vulnerability.€€òòId.óó€€The€State€is€required€to€presentÐ 0"€  Ðevidence€in€addition€to€the€victimððs€age€to€establish€particular€vulnerability;€however,€that€evidenceÐ #l!
