Hawkins   ,wasconvictedofrapebyajuryverdictinthe    Shelby   CountyCriminalCourt.HewassentencedtoconfinementintheTennesseeDepartmentofCorrectionforeightyearsandonedayasaRangeIviolentoffender.Heappealsasofright,challengingboththeconvictionandsentence.Theappellantargues1)thattheevidenceattrialwasinsufficienttosupportarationalfindingofguiltbeyondareasonabledoubtand,2)thatthetrialcourterredinitsapplicationofcertainenhancementfactorsandinfailingtoconsideralternativesentencing.Weaffirmthejudgmentofthetrialcourt. Webeginwithabriefreviewoftheevidence.Thevictimtestifiedthatshewasdrivinghomewhenanunidentifiedmanflaggedherdowntohelptheappellant,whosetruckhadbrokendown.TheproblemwasXOXXXOapparently#XOXXXOU#XOXXXOa ,| defectivebattery.#XOXXXO#ԀAfterafailedattempttojumpstartthetruck,thevictimagreed H todrivetheappellanttohishomewherehesaidhecouldgetanotherbattery.Thevictimstatedthatuponreachingtheappellantshome,theappellanttriedtokissher.Sheresistedandastruggleensued,endingwiththeappellantdraggingher kickingandscreamingintohishouse.Neighborsoftheappellantcorroboratedthattheyhadheardawomansscreamscomingfromtheappellantshomeonthenightoftherape.  Thevictimtestifiedthat,onceinsidehishome,theappellantheldupabandannaandorderedhertosit.TheXOXXXOԀvictimaskedtousetherestroom,andthe $-t(- appellantpermittedherbutenteredtherestroomwithhertowatch.Hethenorderedhertoundressandtookhertoanotherroomwherehevaginallyrapedher.Healsodemandedoralsex,andthevictimcomplied.Inresponsetothedefensesquestionwhyshedidnotfightorstruggleduringtherape,thevictimstatedthatshewasafraidtheappellantwouldkillher.#XOXXXO#XOXXXOԀ#XOXXXO#XOXXXOԀShestatedthatshedid  6p17 notconsent.#XOXXXO#XOXXXO 95;  Immediatelyaftertherape,theappellanthuggedthevictimandtoldherhewassorry.Hethendrovethevictim,inhervehicle,toagasstationwherehestoppedandwentinside,leavingthevictimaloneinthevehicleforapproximatelyfivetotenminutes.Theappellantstatedthatheleftthevehiclerunningwiththekeysintheignition.Therewereotherpeoplearoundthestationandtheareawaswelllit.Thevictimdidnotattempttoescapeoraskforhelpbecause,shesaid,shewasafraidthattheappellantwouldkillorhurther.Theappellantthendrovethevictimbacktohistruck,switchedhisbatteryforhers,andlethergo. Afterreportingtheincidentsometwohourslater,thevictimwastakentotheMemphisSexualAssaultResourceCenterwhereshewasexamined.MargaretAiken,theexaminingnurse,testifiedthatshefoundscratchesonthevictimsupperleftarmandleftclavicle.Shealsofoundgenitaltraumaoftheposteriorfourchetteandanabrasionorscrapeofthatarea.Theseinjuries,Aikentestified,wereconsistentwithforcedpenetrationandarenotordinarilyassociatedwithconsensualsex.Whenpressed,however,Aikencouldnotruleoutthepossibilitythatsuchinjuriescouldresultfromconsensualsex.Aikensexaminationrevealednofurtherinjuries.Thevictim,however,testifiedthatshehadalsosustainedbruisesonherleg,chest,andarms;andthestateintroducedphotographsofthesebruisesthathadbeentakentwodaysaftertherape.#XlXXXl# -@),  Theappellantsversionofthefactswerethatalthoughhedidattempttohavesexwiththevictim,itwasconsensual.Heexplainedthescratchesonthevictimastheresultofherbecomingcaughtinhisclimbingrosebush.Heexplainedherscreamsastheresultofhisdogfrighteningthevictim.   @  0948  Theappellantfirstarguesthattheevidenceattrialwasinsufficienttojustifyarationaltrieroffactinconvictinghimofrape.XlXXXlԀWhenanappellant  challengesthesufficiencyoftheevidence,thisCourtmustdeterminewhether,afterviewingtheevidenceinalightmostfavorabletotheprosecution,anyrationaltrieroffactcouldhavefoundtheessentialelementsofacrimebeyondareasonabledoubt.SeeJacksonv.Virginia,443U.S.307,319(1979);Statev. `  Duncan,698    S.W.2d   63,67(Tenn.1985);Tenn.R. P 3913503.Cf.Statev.Smith,891    S.W.2d   922,930(Tenn.Crim.App.1994) 0 (notingthattheenhancementforpotentialbodilyinjuryshouldnotapplyabsentextraordinarycircumstancesinsentencingforaggravatedrape,asthatoffense @ alreadyreflectsstatutoryenhancement).Therecordreflectsthattheappellantstruggledwiththevictiminhercar,knockedherglassesoff,andphysicallydraggedherfromhervehicletohishouse.Thesefactsmanifestforceexceedingthatnecessarytocommitthecrimeofrapeasstatutorilydefined.Whilethisforcemayormaynothavethreatenedgreatbodilyinjury,itclearlypresented P(#& greatpotentialforbodilyinjury.Wethereforefindnoerrorintheapplicationof 0*%( thisenhancementfactor.#XlXXXltS#Ԁ ,`'*  Finally,thetrialcourtappliedenhancementfactor(15)XlXXXl!#XlXXXlY#thattheappellant / +. abusedapositionofpublicorprivatetrust.SeeTenn.CodeAnn.4035 1-0 114(15).Theapplicationofthisfactorrequiresafinding,first,thattheappellantoccupiedapositionoftrustvisavisthevictimand,second,thattheappellantabusedthatpositioninamannerthatsignificantlyfacilitatedthecommissionoftheoffense.SeeStatev.Kissinger,922S.W.2d482,488(Tenn.1996).Thus, 0948 wemustfirstexaminewhethertheappellantformallyorinformallystoodinarelationshiptothevictimthatpromotedconfidence,reliability,orfaith.Seeid.󀀀  Thetrialcourtfoundsucharelationship,reasoningthatthevictimputherselfinthepositiontorenderaidbaseduponarelianceortrustevokedbytheappellantsappearanceofneed.WhilewemightliketoprotectandencouragetheactsofgoodSamaritans,wethinkthisapplicationisbroaderthanthedrafterofthestatuteintended. Withoutsoholding,wemightagreethatagoodSamaritanevokesthetrustandconfidenceofoneheorsheundertakestoaid,astheaidedpersonwouldtypicallybecome,tosomedegree,reliantuponthegoodSamaritan.But,itisdifficulttoseehowthereverseistrue.   Thatis,e E ven    ifagoodSamaritancreatesapositionoftrustwhenheorsheassumesthewelfareofanother,wedonotseehowtheaidedpersonpromotesalikereliance.Whetheroneoccupiesapositionoftrustisultimatelyafactspecificinquiry.Wesimplyfindnofactssupportingtheconclusionthattheappellantoccupiedsuchapositionastothevictim.Wethereforefindthatthetrialcourterredinimposingthisenhancement.  N  Astomitigatingfactors,thetrialcourtfirstfoundthattheappellantscriminalconductneithercausednorthreatenedseriousbodilyinjury. #  1      ׀SeeTenn. P(#& CodeAnn.4035113(1).Theonlybasisofferedbythetrialcourtfortheapplicationofthisfactorwasthatthevictimdidnotinfactsustainseriousbodilyharm.Becausethisfindingignoresthethreatofsuchharm,wefinditinsufficientforapplicationofthestatutoryfactor.  1-0    Seriousbodilyinjuryisdefinedto  includesubstantialmentalimpairment.   See  Tenn.     ci Asnotedabove, bodilyinjuryincludestheimpairmentofmentalfaculty.  See  Tenn. Code    Ann.  3911106( 34 2 ).    ThisCourthasrecognizedthatthe  psychologicalinjuriessufferedbyrapevictimsmayrisetothelevelnecessarytoenhanceasentenceforparticularlygreatpersonalinjury.SeeWilliams,920 P  S.W.2dat259;Tenn.CodeAnn.4035114(6).Itfollowsthat,whetheractualizedornot,thethreatofseriousbodilyharmisinherentintheoffenseofrape.Therefore,wefindthattheappellantsconductdidthreatenseriousbodilyharm;andthetrialcourterredinitsapplicationofthismitigatingfactor. Thetrialcourtalsofoundthattheappellantcommittedhisoffenseundersuchunusualcircumstancesthatitisunlikelythatasustainedintenttoviolatethelawmotivatedthecriminalconduct.SeeTenn.CodeAnn.4035113(11). P ThetrialcourtnotedthattheappellantXlXXXlhascommittednoothersubstantial 0 criminalviolationswithinthelastfifteenormore#XlXXXlh#years,hehasnohistoryof ` sexualmisconduct,andthereisnothingintherecordtosuggestapropensitytocommitsimilaroffensesinthefuture.Althoughthesefindingsmaybesomewhatsalutary,theydonotspeaktowhethertheappellanthadasustainedintenttoviolatethelawortoanyunusualcircumstanceofhiscrime.Whethertheappellantintendedfromtheoutsettorapethevictimwecannotknow.Wedoknowthatheattackedthevictiminhervehicle;draggedherintohishouse;escortedhertotherestroomandstayedtowatch;madeherdisrobe;andvaginallyandorallyrapedher.Weknowthatthissequenceofeventstookatleastthirtyminutes,duringwhichhehadseveralopportunitiestopauseandreflectonwhathewasdoing.And,weknowthattherewerenounusualcircumstancesthatmightexplain,ifnotexcuse,hisconduct.Giventhesefacts,wecannotagreethattheappellantlackedasustainedintenttoviolatethelaw. Theappellantarguesthatthetrialcourterredinnotmitigatinghissentencebasedonhisapologytothevictimimmediatelyfollowingtherape. 0948 This,heargues,demonstratedhisremorsebeforedetectionbytheauthorities.Thathesaidhewas sorryisnotaconsiderationforwhichthisCourtispreparedtomitigatetheappellantssentence.
