ÐÌà  àIn€reviewing€the€transcript€of€the€evidentiary€hearing€conducted€in€this€post„convictionÐ ‹$Û# Ðmatter,€we€are€concerned€that€trial€counsel€did€so€little€to€confirm€independently€that€his€clientððsÐ t%Ä $ Ðdesire€to€plead€guilty€was€the€best€legal€course€of€action€to€take.€€Counsel€admitted€that€he€neverÐ ]&­!% Ðdeveloped€a€theory€of€defense.€€He€made€very€little€effort€to€test€the€overall€strength€of€the€StateððsÐ F'–"& Ðcase.€€He€determined€that€the€victim€was€a€ð ðprosecutorððs€dream,ðð€but€did€not€investigate€whether€Ð /(#' Ðthere€was€a€method€for€otherwise€attacking€the€Stateððs€case.€€Moreover,€although€the€DefendantÐ )h$( Ðadmitted€the€crimes€to€his€lawyer,€it€remains€the€Stateððs€burden€to€prove€its€case€beyond€a€reasonableÐ *Q%) Ðdoubt.€€A€defense€attorney€commits€no€ethical€breach€by€forcing€the€State€to€carry€its€burden€ofÐ ê*:&* Ðproof,€even€when€the€attorneyððs€client€has€admitted€participation€in€the€charged€crimes.€€It€appearsÐ Ó+#'+ Ðthat€trial€counsel€took€his€marching€orders€from€his€client,€rather€than€independently€determiningÐ ° Ðthe€best€course€of€action€for€his€client€to€take.€€It€is€a€lawyerððs€obligation€to€advise€his€or€her€clientÐ ™é Ðof€the€possible€avenues€available€and€the€likely€outcomes€of€each:€Counsel€admitted€that€he€neverÐ ‚Ò Ðadvised€his€client€that€a€trial€might€be€preferable.€€Counsel€simply€proceeded€with€trying€to€negotiateÐ k» Ða€plea,€even€when€the€State€proved€obstreperous€during€these€discussions.Ð T¤ ÐÌà  àNevertheless,€even€if€we€were€to€find€trial€counselððs€representation€to€be€deficient,€theÐ & v ÐDefendant€has€failed€to€establish€that,€but€for€his€attorneyððs€alleged€errors,€there€is€a€reasonableÐ  _ Ðprobability€that€he€would€have€insisted€on€going€to€trial.€€Counselððs€testimony,€which€the€trial€courtÐ ø H Ðaccredited,€was€consistent€and€emphatic€that€the€Defendant€did€not€want€to€go€to€trial€but€wantedÐ á 1  Ðto€plead€guilty.€€The€Defendant€has€introduced€no€proof€that,€but€for€his€attorneyððs€allegedlyÐ Ê   Ðdeficient€performance,€he€would€have€gone€to€trial.€€Indeed,€the€Defendant€does€not€even€make€thisÐ ³  Ðclaim€in€his€affidavit.€€Accordingly,€we€conclude€that€the€Defendant€has€failed€to€prove€by€clear€andÐ œì  Ðconvincing€evidence€that€he€was€prejudiced€by€his€attorneyððs€performance.€€The€Defendant€isÐ …Õ  Ðtherefore€entitled€to€no€relief€on€the€grounds€of€ineffective€assistance€of€counsel.Ð n¾  ÐÌà  àThe€Defendant€also€claims€that€he€did€not€enter€his€guilty€pleas€voluntarily€because€he€wasÐ @ Ðunder€medication€at€the€time€of€his€pleas.€€The€Defendant€introduced€proof€at€the€post„convictionÐ )y Ðhearing€that,€on€the€day€he€pled€guilty,€he€took€(under€custodial€supervision)€a€drug€called€Ô_ÔTrilafonÔ_Ô.€Ð b ÐAlso€admitted€at€the€hearing€was€an€excerpt€from€the€Physicianððs€Desk€Reference€website€statingÐ ûK Ðthat€ð ðÔ_ÔTrilafonÔ_Ô€is€used€to€treat€schizophrenia€and€to€control€severe€nausea€and€vomiting€in€adults.ðð€Ð ä4 ÐThe€excerpt€further€provides€that€one€of€the€possible€side„effects€of€Ô_ÔTrilafonÔ_Ô€is€ð ðconfusion.ðð€Ð Í ÐHowever,€the€Defendant€introduced€no€expert€testimony€as€to€why€he€was€taking€Ô_ÔTrilafonÔ_Ô€or€whatÐ ¶ Ðside„effects,€if€any,€the€drug€induced€in€him.€€The€Defendantððs€proof€that€his€plea€was€not€voluntaryÐ Ÿï Ðbecause€of€the€medication€he€took€on€the€day€of€his€plea€hearing€is€simply€not€sufficient€to€establishÐ ˆØ Ðthat€his€pleas€were€not€constitutionally€valid.€€This€issue€is€without€merit.Ð qÁ ÐÌà  àThe€Defendant€also€contends€that€his€pleas€were€not€voluntary€ð ðdue€to€the€ineffectivenessÐ C“ Ðof€his€trial€counsel.ðð€€We€find€this€assertion€to€be€without€merit.€€The€proof€at€the€post„convictionÐ ,| Ðhearing€established€that€the€Defendant€wanted€to€plead€guilty€and€did€not€want€to€go€to€trial.€€ThereÐ e Ðis€nothing€in€the€record€to€convince€us€that€the€Defendant€would€have€agreed€to€go€to€trial€even€ifÐ þN Ðhis€lawyer€had€advised€him€to€do€so.€€The€Defendantððs€real€complaint€is€that€his€sentence€is€too€long.€Ð ç 7 ÐHowever,€the€Defendant€pled€guilty€without€an€agreement€as€to€his€sentence€and€his€decision€toÐ Ð!   Ðplead€guilty€was€based€on€his€own€desire:€He€did€not€plead€guilty€because€his€lawyer€told€him€to.€Ð ¹" !
