ŠThe€Petitioner€testified€that€the€indictment€indicated€that€the€offense€occurred€at€12:30€a.m.€Š $X" ŠAccording€to€the€Petitioner,€he€was€with€Bailey€at€the€time€when€the€offense€allegedly€occurred.€€HeŠ ō$D # Šstated€that€he€informed€counsel€that€he€was€with€Bailey€from€5:00€p.m.€on€the€December€11,€1996ņņóóŠ ą%0!$ Šuntil€9:00€or€10:00€a.m.€the€next€day.€€The€Petitioner€acknowledged€that€Wanda€Poole€was€also€hisŠ Ģ&"% Šgirlfriend€at€the€time.€Š ø'#& Їą  ąThe€Petitioner€maintained€that€counsel€never€discussed€the€elements€of€a€defense€of€alibi€withŠ ° Šhim€and€that€counsel€never€put€on€a€defense€of€alibi€at€his€trial.€€The€Petitioner€acknowledged€thatŠ œģ Šhe€did€not€tell€the€trial€court€that€he€had€an€alibi€because€he€expected€that€counsel,€to€whom€he€hadŠ ˆŲ Šgiven€the€names€of€witnesses,€would€present€that€defense€for€him.€€He€stated€that€he€also€informedŠ tÄ Šcounsel€that€Wanda€Poole€was€using€drugs€and€that€there€was€a€possible€connection€between€her€andŠ `° Šthe€victims.€€However,€the€Petitioner€testified€that€he€did€not€believe€that€counsel€interviewed€Poole.€Š L œ ŠHe€also€maintained€that€counsel€did€not€interview€his€mother€or€Bailey.€€Š 8 ˆ ŠĢą  ąThe€Petitioner€acknowledged€that€he€walked€out€during€one€of€his€discussions€with€counsel.€Š  ` ŠAccording€to€the€Petitioner,€he€asked€counsel€what€type€of€defense€counsel€was€going€to€try€toŠ ü L  Šestablish,€and€counsel€responded€that€š š[the€Petitioner]€didnššt€have€a€defense.šš€€The€PetitionerŠ č 8  Štestified€that€he€told€counsel€that€there€was€š šno€usešš€having€counsel€as€his€attorney€and€walked€backŠ Ō$  Što€his€cell€at€the€Criminal€Justice€Center.€€The€Petitioner€testified€that€a€security€guard,€who€was€inŠ Ą  Šthe€room€during€the€conversation,€could€hear€everything€he€said€to€counsel,€so€he€did€not€feelŠ ¬ü  Šcomfortable€talking€freely€with€counsel.€€The€Petitioner€testified€that€he€conveyed€his€concerns€aboutŠ ˜č  Šthe€security€guard€to€counsel,€but€he€was€not€sure€if€counsel€took€any€steps€to€remedy€the€problem.€Š „Ō  ŠHe€stated€that€all€of€the€meetings€with€counsel€took€place€in€the€same€location€with€guards€present.€Š pĄ ŠĢą  ąOn€cross„examination,€the€Petitioner€stated€that€Wanda€Poole€did€not€testify€at€his€trial.€Š H˜ ŠWhen€asked€if€Poole€could€be€located€at€that€time,€he€responded€that€he€š šguess[ed]€not.šš€€He€statedŠ 4„ Šthat€Poole€was€listed€in€the€indictment€as€a€witness€against€him.€€The€Petitioner€claimed€that€insteadŠ  p Šof€being€with€Poole€at€the€victimsšš€home€on€the€night€of€the€offense,€he€was€at€Sheila€Baileyššs€home.€Š  \ ŠHe€could€not€recall€Baileyššs€address€but€stated€that€it€was€š šoff€on€past€Briley€Parkwayšš€and€that€itŠ ųH Šwas€š šlike€on€Avey€Street.šš€€The€Petitioner€testified€that€he€arrived€at€Baileyššs€house€around€5:00€p.m.Š ä4 Šon€December€11,€1996€and€left€around€8:00€a.m.€the€next€day.€€He€maintained€that€he€stayed€atŠ Š  ŠBaileyššs€house€the€entire€night.€€The€Petitioner€stated€that€Baileyššs€children€were€also€at€her€homeŠ ¼  Šthat€evening.€€Š Øų ŠĢą  ąThe€Petitioner€testified€that€when€he€left€Baileyššs€house,€Bailey€drove€the€Petitionerššs€car€andŠ €Š Šdropped€him€off€at€his€motherššs€house.€€When€asked€what€information€he€could€not€convey€toŠ l¼ Šcounsel€with€the€deputies€in€the€room,€the€Petitioner€responded,€Š X Ø Šą8  ąš šWell,€just€to€explain€.€.€.€the€different€procedures€about€my€case€.€.€.€.šš€€He€stated,Š D!” Šš šFirst,€I€would€explain€to€him,€try€to€establish€to€him€.€.€.€in€my€behavior,€how€.€.€.Š 0"€  Šthem€people€could€have€been€shot,€.€.€.€for€one,€.€.€.€they€was€trying€to€make€likeŠ #l! Ševerybody,€.€.€.€they€was€just€two€senior€citizens,€good€Samaritans,€but€them€two€drugŠ $X" Šaddicts,€.€.€.€around€in€the€neighborhood,€.€.€.€getting€crack€from€everybody,€differentŠ ō$D # Špeoples,€.€.€.€I€tried,€.€.€.€I€could€have€explained€that€to€him,€but€I€wasnššt€able€to.šš€Šą%0!$Š Š  ŠThe€Petitioner€also€testified€that€he€would€have€told€counsel€that€he€knew€the€victims€and€that€he€hadŠ Ģ&"% Šbeen€in€their€house€on€a€previous€occasion.€€Š ø'#& ŠĢą  ąWhen€asked€if€counsel€explained€to€him€the€Stateššs€proof€in€his€case,€the€Petitioner€replied,Š )ą$( Šš šNot€really.€€I€couldnššt€say,€you€know.šš€€He€stated€that€it€š šwas€obviousšš€that€the€two€victims€couldŠ |*Ģ%) Šidentify€him€in€court€as€the€perpetrator.€€ņ ņó óThe€Petitioner€testified€that€he€told€counsel€where€he€wasŠ h+ø&* Šat€the€time€of€the€offense€and€that€he€had€an€alibi.€€He€stated€that€he€š šleft€it€up€to€[counsel]€to€takeŠ ° Šit€from€there€and€present€it€to€the€Courts.šš€€The€Petitioner€recalled€that€at€the€end€of€the€trial,€counselŠ œģ Šannounced€that€the€defense€was€not€going€to€present€any€proof.€Š ˆŲ ŠĢą  ąOn€re„direct€examination,€the€Petitioner€testified€that€it€was€counselššs€duty€to€present€his€caseŠ `° Šand€that€he€relied€on€counsel€to€present€his€case.€€He€stated€that€he€did€not€feel€that€he€could€speakŠ L œ Šdirectly€to€the€trial€judge.€€The€Petitioner€explained€that€he€is€š šnot€very€sophisticatedšš€in€his€speechŠ 8 ˆ Šor€education€level.€€Š $ t ŠĢą  ąCounsel€testified€that€he€is€an€Assistant€Public€Defender€for€the€Metropolitan€GovernmentŠ ü L  Šof€Davidson€County.€€He€stated€that€during€an€average€week,€he€has€no€more€than€one€jury€trial,€ifŠ č 8  Šany.€€However,€he€testified€that€during€the€time€that€he€represented€the€Petitioner,€he€was€a€š šCriminalŠ Ō$  ŠCourt€floater,šš€so€his€case€load€would€have€been€š šsignificantly€smalleršš€than€usual.€€He€stated€thatŠ Ą  Šhe€has€been€a€practicing€attorney€since€1976.€€Š ¬ü  ŠĢą  ąCounsel€recalled€that€on€February€20,€1998,€he€was€appointed€to€represent€the€Petitioner€afterŠ „Ō  Šthe€Petitionerššs€prior€counsel€moved€to€withdraw€from€the€case.€€He€testified€that€when€he€wasŠ pĄ Šappointed,€the€Petitionerššs€case€was€set€for€trial€on€April€20,€1998.€€Counsel€stated€that€pursuant€toŠ \¬ Šhis€motion,€the€case€was€continued€until€June€22,€1998.€€He€testified€that€he€met€with€the€PetitionerŠ H˜ Šon€eight€occasions.€€He€stated€that€at€least€five€of€those€meetings€lasted€forty€minutes.€€CounselŠ 4„ Šreported€that€he€also€had€several€additional€brief€encounters€with€the€Petitioner€in€addition€to€theŠ  p Šeight€meetings.€€Š  \ ŠĢą  ąCounsel€described€a€meeting€with€the€Petitioner€that€took€place€on€June€17,€1998.€€HeŠ ä4 Šexplained€that€the€maximum€security€units€at€the€Criminal€Justice€Center€were€under€a€great€deal€ofŠ Š  Šrenovation€so€that€the€š šwhole€area€was€kind€of€torn€up€and€basically€it€was€a€very€noisy€area€in€whichŠ ¼  Šthere€was€absolutely€no€privacy.šš€€He€testified€that€deputies€were€always€close€by€and€could€overhearŠ Øų Šhis€conversations,€which€he€believed€impeded€communication€with€the€Petitioner.€€Following€theŠ ”ä ŠJune€17€meeting,€counsel€sent€an€email€to€Judge€Blackburn€and€Assistant€District€Attorneys€GeneralŠ €Š ŠSharon€Brox€and€Dan€Hamm.€€He€reported€that€he€stated€the€following€in€the€email:Š l¼ Šą8  ąPlease€be€advised€I€just€met€with€[the€Petitioner]€to€discuss€final€trial€preparationsŠ X Ø Šand€all€was€not€well.€€He€became€upset€about€the€matter€and€was€concerned€that€I€hadŠ D!” Šnot€done€enough€to€help€him€or€to€prepare€his€defense.€€He€returned€to€his€cellŠ 0"€  Šsuggesting€I€was€working€with€the€prosecution€to€convict€him.€€The€physical€situationŠ #l! Šdidnššt€permit€me€to€properly€confront€him€and€to€process€the€issue€(Mr.€Hayes€is€inŠ $X" Š4€max€where€the€attorney€visiting€area€has€been€under€construction€for€months.€€TheŠ ō$D # Šinmates€may€see€their€counsel€only€in€the€presence€of€deputies).€€I€share€thisŠ ą%0!$ Šinformation€only€because€it€could€impact€the€trial€set€for€Monday.ŠĢ&"%Š Š  ŠĢą  ąCounsel€could€not€recall€specifically€what€caused€the€Petitioner€to€become€angry€during€theŠ ¤(ō#' ŠJune€17,€1998€meeting.€€He€testified€that€his€next€meeting€with€the€Petitioner€occurred€on€June€19,Š )ą$( Šā ā1998,€and€lasted€two€hours.€€Counsel€testified€that€he€spoke€to€the€Petitioner€about€the€defense€ofŠ |*Ģ%) Šalibi.€€He€stated€that€he€also€spoke€to€the€Petitioner€about€the€possibility€that€three€individuals€mightŠ ° Šidentify€him€as€the€person€who€shot€the€victims.€€Š œģ Šā āĢą  ąņ ņó óCounsel€testified€that€the€Petitioner€claimed€that€one€of€the€potential€witnesses€against€himŠ tÄ Šwas€with€the€Petitionerššs€mother€at€the€time€of€the€offense.€€He€stated€that€in€essence,€the€PetitionerŠ `° Šwas€providing€an€alibi€for€one€of€the€prosecution€witnesses,€Wanda€Poole.€€According€to€counsel,Š L œ ŠPoole€would€have€testified€to€the€following€regarding€the€night€of€the€offense:€that€she€was€with€theŠ 8 ˆ ŠPetitioner;€that€she€accompanied€the€Petitioner€to€the€store;€€that€on€the€way€back€from€the€store,€theŠ $ t ŠPetitioner€wanted€to€stop€at€someoneššs€house;€that€she€knocked€on€the€door€of€the€home,€thatŠ  ` ŠTawanda€Parker€opened€the€door,€and€the€Petitioner€entered€the€residence€behind€Parker;€that€thereŠ ü L  Šwas€a€discussion€about€borrowing€an€automobile,€and€the€Petitioner€pulled€out€a€handgun,€shot€Mr.Š č 8  ŠMcLemore,€and€then€shot€Parker;€and€that€as€they€were€leaving,€the€Petitioner€grabbed€Poole€by€herŠ Ō$  Šblouse€and€told€her€that€if€she€told€anyone,€he€would€kill€her.€€According€to€counsel,€this€was€PooleššsŠ Ą  Šinitial€account€of€the€events,€but€she€later€š šback„pedaled€and€got€somewhat€ambivalent.šš€€Š ¬ü  ŠĢą  ąCounsel€testified€that€he€had€several€reasons€to€question€Pooleššs€credibility:€€He€stated€thatŠ „Ō  Šshe€waited€several€days€before€sharing€the€information€with€anyone,€that€her€account€š šratherŠ pĄ Šconveniently€exonerated€her€from€any€kind€of€criminal€responsibility,šš€that€she€was€š šlacking€someŠ \¬ Šdetailsšš€in€her€account,€and€that€she€had€a€personal€relationship€with€the€Petitioner.€€Counsel€testifiedŠ H˜ Šthat€the€Petitioner€claimed€that€Poole€had€been€to€the€victimsšš€home€to€purchase€drugs.€However,Š 4„ Šcounsel€acknowledged€that€the€trial€court€would€not€allow€him€to€introduce€certain€evidenceŠ  p Šregarding€drug€activity€at€the€victimsšš€home.€€Counsel€testified€that€he€had€a€brief€phone€conversationŠ  \ Šwith€Sheila€Bailey€in€which€she€stated€that€she€thought€the€Petitioner€was€with€her€on€the€night€ofŠ ųH Šthe€offense€but€claimed€she€was€not€positive.€€He€testified€that€he€also€talked€to€the€PetitionerššsŠ ä4 Šmother.€Š Š  ŠĢą  ąCounsel€testified€that€he€was€provided€with€the€Stateššs€discovery€material€in€this€case€andŠ Øų Šwas€familiar€with€the€Stateššs€case€against€the€Petitioner.€€He€stated€that€this€was€not€an€š šoverlyŠ ”ä Šcomplicatedšš€case.€€Counsel€testified€that€he€spent€a€sufficient€amount€of€time€with€the€PetitionerŠ €Š Što€prepare€the€case€for€trial.€€He€also€reported€that€š š[n]inety„percent€of€[his]€trials€are€without€aŠ l¼ Šdefense.šš€€Š X Ø ŠĢą  ąHe€acknowledged€that€the€Petitioner€wanted€his€mother€and€his€girlfriend€to€testify.€€CounselŠ 0"€  Štestified€that€he€did€not€š šthink€a€girlfriend€saying€that€she€might€have€been€with€the€Petitioneršš€wouldŠ #l! Šhave€been€very€persuasive€to€a€jury.€€€However,€counsel€explained€that€he€š šwas€not€pleased€with€theŠ $X" Šquality€of€what€their€anticipated€testimony€would€be.šš€€He€also€testified€that€if€the€PetitionerššsŠ ō$D # Šmother€had€testified,€she€could€have€provided€the€State€with€a€motive€for€the€shootings.€€AccordingŠ ą%0!$ Što€counsel,€the€Petitionerššs€mother€would€have€stated€that€Parker€had€š šrepeatedly€and€annoyinglyŠ Ģ&"% Šcalledšš€the€Petitioner€seeking€to€buy€drugs,€and€she€would€have€testified€that€she€told€Parker€to€callŠ ø'#& Šthe€Petitioner€on€his€beeper.€€Š ¤(ō#' ŠĢą  ąOn€re„direct€examination,€counsel€testified€that€he€would€have€discussed€with€the€PetitionerŠ |*Ģ%) Šwhat€the€Stateššs€evidence€would€include.€€However,€he€stated€that€he€probably€did€not€tell€theŠ h+ø&* ŠPetitioner€that€he€did€not€have€a€defense.€€Counsel€acknowledged€that€his€conversation€with€BaileyŠ ° Šwas€brief.€€According€to€counsel,€Bailey€was€only€able€to€say€that€she€thought€she€and€the€PetitionerŠ œģ Šwere€together€on€the€night€of€the€offense,€but€she€could€not€remember€the€date.€€Š ˆŲ ŠĢą  ąSheila€L.€Bailey€testified€that€she€and€the€Petitioner€had€š šbeen€together€on€and€off€for€the€lastŠ `° Šseven€years.šš€€She€recalled€that€on€December€11,€1996,€the€Petitioner€helped€her€move€into€herŠ L œ Šapartment€and€spent€the€night€with€her€there.€€Bailey€stated€that€she€picked€up€the€Petitioner€at€hisŠ 8 ˆ Šmotherššs€home€and€that€the€Petitioner€was€at€her€residence€on€Ivey€Street€with€her€until€10:30€a.m.Š $ t Šthe€next€day€when€she€took€him€home.€€She€testified€that€she€drove€the€Petitioner€home€in€herŠ  ` Šcousinššs€car€the€next€morning.€€Bailey€reported€that€her€home€is€in€west€Nashville.€€She€maintainedŠ ü L  Šthat€the€Petitioner€was€with€her€the€entire€night.€€Bailey€testified€that€she€did€not€recall€counsel€orŠ č 8  Šanyone€from€the€public€defenderššs€office€calling€her€about€this€case.€€Š Ō$  ŠĢą  ąOn€cross„examination,€Bailey€testified€that€the€Petitioner€is€the€father€of€her€thirteen„year€oldŠ ¬ü  Šson.€€She€stated€that€she€has€two€other€sons€who€are€eighteen€and€sixteen€years€of€age.€€BaileyŠ ˜č  Šreported€that€she€moved€some€of€her€possessions€from€her€former€residence€on€December€10,€1996,Š „Ō  Šand€the€Petitioner€helped€her€move€the€remainder€on€December€11,€1996.€€She€testified€that€she€leftŠ pĄ Šwork€at€9:00€p.m.€on€December€11,€1996€and€went€by€the€Petitionerššs€motherššs€home€to€pick€up€theŠ \¬ ŠPetitioner.€€Bailey€claimed€that€she€did€not€know€Tawanda€Parker,€the€female€shooting€victim.€Š H˜ ŠBailey€was€certain€that€she€was€not€with€the€Petitioner€at€5:00€p.m.€on€December€11,€1996€becauseŠ 4„ Šshe€was€at€work.€€She€testified€that€her€three€children€stayed€at€their€grandmotherššs€house€that€nightŠ  p Šand€did€not€go€to€Baileyššs€new€house.€€Bailey€testified€that€she€did€not€find€out€right€away€that€theŠ  \ ŠPetitioner€was€arrested€because€she€was€not€speaking€to€him.€€However,€she€testified€that€sheŠ ųH Šremained€on€good€terms€with€the€Petitionerššs€mother.€€Š ä4 ŠĢą  ąMattie€Darnell,€the€Petitionerššs€mother,€testified€that€on€the€evening€of€December€11,€1996,Š ¼  Šher€oldest€son,€William€Hayes,€and€Wanda€Poole€were€at€her€house.€€She€testified€that€Poole€was€aŠ Øų Šformer€girlfriend€of€the€Petitioner.€€According€to€Darnell,€Poole€stayed€at€her€house€the€entire€night.€Š ”ä ŠOn€cross„examination,€Darnell€testified€that€she€is€a€light€sleeper€and€that€she€slept€š špartiallyššŠ €Š Šthrough€the€night.€€When€asked€what€she€was€doing€that€night,€Darnell€responded,€Š l¼ Šą8  ąš šI€looked€at€TV.€€We€talked€back€and€forth.€€I€answered€the€phone.€€I€ran€to€theŠ X Ø Šbathroom.€€I€went€and€took€a€nap€and€back€up€answering€the€phone,€going€to€theŠ D!” Šbathroom,€talking€to€Wanda€or€either€saying€a€few€things€to€my€other€son€because€heŠ 0"€  Šalso€gets€up€at€night.šš€€Š#l!Š Š  ŠĢą  ąDarnell€testified€that€Parker€called€a€š šfewšš€times€that€night€trying€to€find€the€Petitioner.€€SheŠ ō$D # Šcircumstances.€€ņņStricklandóó,€466€U.S.€at€690ņņóó;€ņņState€v.€Mitchellóó,€753€S.W.2d€148,€149€(Tenn.€Crim.Š ą%0!$ ŠApp.€1988).€€The€reviewing€court€must€evaluate€the€questionable€conduct€from€the€attorneyššsŠ Ģ&"% Šperspective€at€the€time.€€ņņStricklandóó,€466€U.S.€at€690;€ņņCooperóó,€849€S.W.2d€at€746;€ņņHellard€v.€Stateóó,Š ø'#& Š629€S.W.2d€4,€9€(Tenn.€1982).€€€In€doing€so,€the€reviewing€court€must€be€highly€deferential€andŠ ¤(ō#' Šš šshould€indulge€a€strong€presumption€that€counselššs€conduct€falls€within€the€wide€range€ofŠ )ą$( Šā āreasonable€professional€assistance.šš€€ņņBurnsóó,€6€S.W.3d€at€462.€€Counsel€should€not€be€deemed€to€haveŠ |*Ģ%) Šbeen€ineffective€merely€because€a€different€procedure€or€strategy€might€have€produced€a€differentŠ ° Šresult.€€ņņWilliams€v.€Stateóó,€599€S.W.2d€276,€279„80€(Tenn.€Crim.€App.€1980).ą x ąŠ œģ Šā āĢą  ąFollowing€the€evidentiary€hearing€on€the€Petitionerššs€petition€for€post„conviction€relief,€theŠ tÄ Štrial€court€made€the€following€findings:Š `° Šą8  ąą ` ąFirst€of€all,€I€donššt€see€any€deficiency€of€[counsel].€€He€interviewed€Ms.Š L œ ŠBailey,€or€Batey,€as€he€had€written€down.€€He€made€a€comment€like€obviously€sheŠ 8 ˆ Šdidnššt€remember€and€for€him€to€go€much€further€would€probably€have€not€been€ofŠ $ t Šmuch€benefit€and€would€run€the€risk€of€being€accused€of€having€told€the€witness€whatŠ  ` Što€say.Šü L Š Š  Šą8  ąą ` ąWith€regard€to€the€motherššs€testimony,€obviously,€[counsel]€had€theŠ č 8  Šinformation€that€he€needed€to€make€the€decision€not€to€use€it€because€of€the€impactŠ Ō$  Šit€would€have€on€the€actual€trial.ŠĄ Š Š  Šą8  ąą ` ąHe€defended€this€case€based€on€the€issue€with€the€identification,€which€onŠ ¬ü  Šcross€he€made€much€of.€€Also,€with€the€fact€it€was€so€inexplicable€that€it€could€notŠ ˜č  Špossibly€have€been€premeditated€and€intentional.€€He€was€very€much€arguing€for€aŠ „Ō  Šlesser€included€offense,€so€that€was€the€thrust€of€the€defense.€€ŠpĄŠ Š  Šą8  ąą ` ąGiven€the€facts€of€the€case,€and€Iššll€have€to€say€this€is€one€of€the€moreŠ \¬ Šoverwhelming€cases€Iššve€ever€seen.€€It€did€not€take€the€jury€long,€and€part€of€it€is€myŠ H˜ Šobservations€of€the€victims€as€they€testified,€which€I€have€the€benefit€of€that€readingŠ 4„ Ša€cold€record€doesnššt€give€you,€but€these€witnesses€knew€the€[Petitioner].€€Ms.€ParkerŠ  p Šhad€known€him€for€three€months.€€He€had€been€to€the€house,€had€borrowed€moneyŠ  \ Špreviously.€€There€had€been€no€problems€whatsoever€with€them.€€He€came€there€toŠ ųH Šborrow€a€car,€and€itššs€just€interesting.€€The€identification€was€not€compromised.€Š ä4 ŠWhen€the€paramedics€finally€got€there€and€these€people€were€left€for€dead.€€She€keptŠ Š  Štrying€to€dial€911€because€they€are€not€paralyzed€and€Mr.€McLemore€is,€he€wasŠ ¼  Šawake€a€lot€of€the€time,€but€he€couldnššt€do€anything€given€the€way€he€was€shot€andŠ Øų Šthey€were€just€laying€there€in€this€bedroom€waiting€for€people€to€find€them.€€But€theŠ ”ä Šfirst€thing€they€tell€the€paramedics€is€Ervin.€€He€did€this.€€I€mean,€there€is€no€questionŠ €Š Šthat€they€knew€who€he€was.€€Šl¼Š Š  Šą8  ąą ` ąNow,€the€other€interesting€thing€was€the€photo€lineup,€and€that€is€the€policeŠ X Ø Šwere€trying€to€verify€who€they€were€talking€about€just€to€make€sure.€€Detective€PierceŠ D!” Šfirst€takes€a€lineup€that€doesnššt€even€include€the€picture€of€the€[Petitioner]€to€them€inŠ 0"€  Šthe€hospital€and€they€donššt€identify€anybody,€and€as€soon€as€they€get€a€photo€withŠ #l! Šhim€in€it,€that€is€absolutely€him.€€There€is€no€question€about€the€identification€and€noŠ $X" Šquestion€about€their€testimony.Šō$D #Š Š  Šą8  ąą ` ąIt€was€an€overwhelming€case.€[Counsel]€did€the€best€he€could€under€theŠ ą%0!$ Šcircumstances,€made€very€good€decisions,€so€given€all€that,€plus€the€issue€with€regardŠ Ģ&"% Što€the€interview€over€in€the€jail,€[counsel]€also€testified€there€was€one€difficultŠ ø'#& Šinterview€that€he€brought€to€my€attention,€and€Iššm€sure€I€probably€said€something,€itššsŠ ¤(ō#' Šnot€in€the€record,€but€to€the€effect€of€do€you€need€me€to€do€something€with€this,€andŠ )ą$( Šthen€he€had€a€subsequent€interview€that€lasted€two€hours,€so€whatever€problemsŠ |*Ģ%) Šmight€have€occurred€early€on,€they€were€at€least€resolved€by€trial,€so€with€all€this,€IššllŠ h+ø&* Šissue€a€written€order,€but€at€this€point,€Iššm€going€to€deny€the€petition,€but€I€will€issueŠ ° Ša€written€order.€€ŠœģŠ Š  ŠĢŌ#†X‰XXX‰ļ‹#Ōą  ąFrom€the€record€before€us,€we€conclude€that€the€Petitioner€has€failed€to€show€that€counselššsŠ tÄ Šrepresentation€fell€below€the€range€of€competence€of€attorneys€in€criminal€cases.€€Both€victimsŠ `° Štestified€unequivocally€that€the€Petitioner€was€the€person€who€shot€them.€€Although€the€PetitionerŠ L œ Šargues€that€counsel€should€have€presented€the€defense€of€alibi,€counsel€made€a€strategic€decisionŠ 8 ˆ Šbased€on€the€proof€not€to€do€so.€€Counsel€testified€that€when€he€spoke€to€Bailey,€she€did€not€seemŠ $ t Šsure€that€she€was€even€with€the€Petitioner€on€the€night€of€the€offense.€€Counsel€also€testified€thatŠ  ` Šallowing€the€Petitionerššs€mother€to€testify€would€not€have€been€strategically€sound€because€she€couldŠ ü L  Šonly€testify€that€she€was€with€one€of€the€prosecutionššs€witnesses€at€the€time€of€the€offense.€Š č 8  ŠMoreover,€counsel€noted€that€the€Petitionerššs€mother€could€have€inadvertently€provided€theŠ Ō$  Šprosecution€with€a€motive.€€Š Ą  ŠĢą  ąRegarding€the€Petitionerššs€argument€that€he€was€not€able€to€adequately€communicate€withŠ ˜č  Šcounsel,€we€note€that€counsel€testified€that€he€met€with€the€Petitioner€on€eight€separate€occasions€andŠ „Ō  Šthat€at€least€five€of€those€meetings€lasted€a€minimum€of€forty€minutes.€€Counsel€testified€that€heŠ pĄ Šdiscussed€the€case€with€the€Petitioner€and€discussed€the€possibility€of€presenting€the€defense€of€alibi.€Š \¬ ŠAlthough€the€Petitioner€testified€that€he€was€uncomfortable€talking€to€counsel€with€deputies€present,Š H˜ Šhe€failed€to€articulate€what€information€he€was€unable€to€convey€to€counsel€during€those€meetings.Š 4„ ŠĢą  ąThus,€we€conclude€that€the€trial€court€properly€found€that€counsel€was€not€deficient€in€hisŠ  \ Šperformance.€€Accordingly,€the€judgment€of€the€trial€court€is€AFFIRMED.Š ųH ŠĢĢą  ąą ` ąą ø ąą  ąą h ąą Ą ąą  ą___________________________________€Š ¼  Šą  ąą ` ąą ø ąą  ąą h ąą Ą ąą  ąROBERT€W.€WEDEMEYER,€JUDGE
