Nashville,TN372430493           JOSEPHD.BAUGH        DistrictAttorneyGeneral̜       P.O.Box937       Franklin,TN37065                          OPINIONFILED:____________________ REVERSEDANDREMANDED JOHNH.PEAY, Judge    @ OPINION   ThepetitionerpledguiltytoonecountofsolicitationtocommitfirstdegreemurderandwassentencedpursuanttoapleabargainasaRangeIstandardoffendertoeightyearsincarcerationintheTennesseeDepartmentofCorrection.JudgmentwasenteredonAugust25,1994.OnMay3,1996,thepetitionerfiledforpostconvictionreliefallegingthathehadpledguiltyasaresultofineffectiveassistanceofcounsel.Thecourtbelowsummarilydismissedthepetitiononthegroundsthat measuredagainstthecourtrecord,thepetitionforpostconvictionreliefiswithoutmerit.Thepetitionernowappeals,claimingthathewasentitledtoahearingonhispostconvictionclaims.Weagreeandreverseandremandthismatterforanevidentiaryhearing.  Uponreceiptofapetitionforpostconvictionrelief, thecourtshallexaminetheallegationsoffactinthepetition.Ifthefactsalleged,takenastrue,failtoshowthatthepetitionerisentitledtorelieforfailtoshowthattheclaimsforreliefhavenotbeenwaivedorpreviouslydetermined,thepetitionshallbedismissed.T.C.A.4030206(f)(Supp.1996)(emphasisadded).Intheinstantcase,thepetitionerallegedthathereceivedineffectiveassistanceofcounselandthathewastherebycoercedintopleadingguilty.Insupportofhisclaims,healleged,amongotherthings,thathisattorneysfailedtorepresenthimproperlyasfollows:̜       1. Failedtoenterhispleainaccordancewithhiswishes;Ӝ2. Disregardedhissuggestionsforthe developmentoforϜ aggressivepursuitofanyviabledefenses;̜3. Refusedtofileamotionforpsychologicalevaluations;̜4. Refusedtocontactwitnesses;̜5. Failedtorespondtorepeatedcommunications;̜6. Informedhimthattheonlyresponsibilitytohim wasnotϜ adefensewhichshallprevailattrial,buttoget[him]theϜ bestdeal(i.e.,pleabargain),nor,forthatmatter,toϜhave thejuryfind[him]innocent,nornoverdictduetotheϜ insufficiencyoftheevidencebeyondareasonabledoubt tosustainaconvictionofguilt;and7. ToldhimthathisreligionWiccawasontrial,nothisϜ crime. P   P   Asaresultofthesefailures,thepetitionercontends,he wascoercedbythemandtheirmissleadingadviseofprevailingintheAppellateCourtsoftheStateofTennessee,toacceptaplea.  Inreviewingthepetitionersallegations,thecourtbelowexaminedothermatterscontainedintherecordoftheStatescaseagainstthepetitioneranddecidedthatthepetitionersallegationswerewithoutmerit.WecommendthecourtbelowforattemptingtosavetheStatethetime,moneyandresourcesrequiredtoprovidethepetitionerwithahearing.However,indoingso,thecourtbelowoverlookeditsstatutorydutytotakeastruetheallegationscontainedinthepetition,withoutregardtoothermatterscontainedintherecord.Takenastrue,thepetitionersallegationsstateaclaimforrelief.Accordingly,evenifeverysingleallegationisprovedfalse,thepetitionerisentitledtoahearing.
