Ðcommitting€a€crime€when€the€risk€to€human€life€was€high.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„114(10).Ð à%0!$ ÐIn€this€case,€the€Defendant€forcibly€intruded€into€the€victimððs€home,€knowing€that€she€and€her€youngÐ Ì&"% Ðchild€were€there,€brandishing€a€knife€and,€later,€a€hammer.€€A€high€risk€to€human€life€is€not€anÐ ¸'#& Ðessential€element€of€the€crime€of€aggravated€burglary€€€òòSeeóó€òòid.óó€ðð€39„14„403(a).€€Accordingly,€we€holdÐ ¤(ô#' Ðthat€the€trial€court€properly€applied€this€enhancement€factor€to€the€Defendantððs€sentence€forÐ )à$( Ðaggravated€burglary.€€Also,€although€not€challenged€by€the€Defendant,€we€further€find€appropriate€Ð ° Ðthe€trial€courtððs€application€of€factor€(16),€that€the€crime€was€committed€under€circumstances€underÐ œì Ðwhich€the€potential€for€bodily€injury€to€a€victim€was€great.€€As€with€factor€(6),€a€great€potential€forÐ ˆØ Ðbodily€injury€to€a€victim€is€not€an€essential€element€of€aggravated€burglary.€€òòSeeóó€òòid.óó€€Because€of€theÐ tÄ Ðmanner€in€which€the€Defendant€committed€the€aggravated€burglary€in€this€case,€however,€applicationÐ `° Ðof€this€factor€is€appropriate.€€€€Ð L œ ÐÌà  àThe€Defendant€also€contends€that€the€trial€court€should€have€found€as€mitigating€factors€thatÐ $ t Ðher€prior€criminal€record€is€ð ðalmost€negligible,ðð€she€has€worked€steadily€since€dropping€out€of€highÐ  ` Ðschool,€has€no€history€of€violence,€and€is€supporting€two€small€children.€€We€respectfully€disagree.€Ð ü L  ÐWhile€the€Defendant€has€few€criminal€convictions,€she€admitted€at€the€sentencing€hearing€toÐ è 8  Ðsignificant€cocaine€use,€including€while€she€was€out€on€bond€awaiting€trial.€€Also,€one€of€theÐ Ô$  ÐDefendantððs€witnesses€at€the€sentencing€hearing€testified€that€the€Defendant€had€stolen€$100€fromÐ À  Ðher€just€days€before€trial.€€Ô#†XM!XXXM!EQ#ÔÔ‡ XM!XXXM!ÔThe€Defendant€is€therefore€not€entitled€to€a€reduction€in€her€sentence€onÐ ¬ü  Ðthis€basis.€€With€respect€to€the€Defendantððs€work€history€and€parenting€responsibilities,€weÐ ˜è  Ðacknowledge€that€defendants€are€ð ðnormally€.€.€.€due€some€favorable€consideration€based€upon€.€.€.Ð „Ô  Ðfamily€contributions€and€work€ethic.ðð€€òòState€v.€McKnightóó,€900€S.W.2d€36,€55€(Tenn.€Crim.€App.Ð pÀ Ð1994).€€òòSee€alsoóó€òòState€v.€Kelleyóó,€34€S.W.3d€471,€482„83€(Tenn.€Crim.€App.€2000).€€In€this€case,Ð \¬ Ðhowever,€the€Defendant€used€her€work€as€the€avenue€of€attack,€rendering€questionable€the€value€ofÐ H˜ Ðher€claimed€work€ethic.€€Moreover,€the€Defendantððs€use€of€cocaine€is€clearly€not€appropriateÐ 4„ Ðbehavior€for€a€parent€of€small€children.€€In€short,€the€Defendant€was€due€little,€if€any,€mitigation€onÐ  p Ðthese€bases,€and€Ô#†XM!XX XM!rk#ÔÔ‡XM!XXXM!Ôwe€therefore€decline€to€find€that€the€trial€court€erred€in€refusing€to€reduce€theÐ  \ ÐDefendantððs€sentence.€€In€sum,€the€trial€courtððs€imposition€of€the€maximum€sentence€for€theÐ øH ÐDefendantððs€aggravated€burglary€conviction€was€proper,€and€this€issue€is€without€merit.Ð ä4 ÐÌà  àWe€turn€now€to€the€application€of€the€enhancement€factors€to€the€Defendantððs€aggravatedÐ ¼  Ðassault€conviction.€€Application€of€factor€(1)€is€appropriate€and€not€challenged€by€the€Defendant.€Ð ¨ø ÐApplication€of€factor€(6)€„„€that€the€victimððs€injuries€were€particularly€great€„„€is€also€appropriate.€Ð ”ä ÐNot€every€aggravated€assault€results€in€acute€post„traumatic€stress€disorder,€and€the€proof€here,€asÐ €Ð Ðset€forth€above,€established€that€the€victimððs€psychological€injuries€from€the€attack€were€ð ðparticularlyÐ l¼ Ðgreat.ðð€€With€respect€to€factor€(10),€we€note€that€every€aggravated€assault€with€a€deadly€weaponÐ X ¨ Ðincludes€a€high€risk€to€human€life.€€Nevertheless,€we€agree€with€the€trial€court€that€this€factor€isÐ D!” Ðapplicable€under€the€facts€of€this€case€because€the€victim€was€pregnant,€and€the€life€of€the€fetus€wasÐ 0"€  Ðalso€at€high€risk.€€We€note€the€Defendant€was€aware€that€the€victim€was€pregnant,€as€evidenced€byÐ #l! Ðthe€threatening€language€the€Defendant€used€regarding€the€ð ðbaby€youððre€carrying.ðð€€The€risk€to€anÐ $X" Ðunborn€fetus€is€not€necessarily€present€in€every€aggravated€assault€with€a€deadly€weapon€and€isÐ ô$D # Ðtherefore,€we€find,€properly€applied€in€this€case.׃ ×Ý ƒ*#ÃÝòòÚ  Ú5Ú  ÚóóÝ  Ý×  ׀Рà%0!$ ЇÔ#†XM!XXXM!qo#ÔÔ‡ XM!XXXM!Ôà  àHowever,€we€find€that€the€trial€court€erred€in€applying€factor€(16),€that€the€DefendantððsÐ ° Ðcommission€of€the€aggravated€assault€created€a€great€potential€for€bodily€injury€to€a€victim.€€A€greatÐ œì Ðpotential€for€bodily€injury€to€the€victim€of€an€aggravated€assault€with€a€deadly€weapon€is€present€inÐ ˆØ Ðevery€such€offense.€€Accordingly,€this€enhancement€factor€cannot€be€applied€with€respect€to€theÐ tÄ Ðattack€upon€Ms.€Slater,€and€the€trial€court€correctly€refused€to€so€use€this€factor.€€Instead,€the€trialÐ `° Ðcourt€applied€this€factor€based€on€the€great€potential€for€bodily€injury€to€Ms.€Slaterððs€unborn€child.€Ð L œ ÐHowever,€our€supreme€court€has€recently€held€that,€where€the€defendant€is€convicted€of€an€offenseÐ 8 ˆ Ðinvolving€a€specific,€named€victim,€such€as€aggravated€assault,€this€factor€cannot€be€used€to€enhanceÐ $ t Ðthe€sentence€on€the€basis€that€there€were€other€potential€victims.€€òòSeeóó€òòState€v.€Imfeldóó,€70€S.W.3d€698,Ð  ` Ð706„07€(Tenn.€2002).€€The€court€reasoned€that€ð ð[t]here€is€nothing€in€the€statutory€language€of€.€.€.Ð ü L  Ðenhancement€factor€[number€16]€to€indicate€that€it€applies€to€potential€victims€or€that€it€appliesÐ è 8  Ðsimply€because€the€offense€was€committed€in€the€presence€of€other€individuals.ðð€òòóó€€Accordingly,€theÐ Ô$  ÐDefendantððs€sentence€for€aggravated€assault€should€not€have€been€enhanced€by€factor€(16)€on€theÐ À  Ðbasis€that€the€offense€created€a€great€potential€for€bodily€injury€to€Ms.€Slaterððs€unborn€child.€€Ô#†XM!XX XM!ßv#ÔÔ‡XM!XXXM!ÔÐ ¬ü  ÐÌà  àNevertheless,€we€find€that€the€trial€courtððs€imposition€of€the€maximum€sentence€for€theÐ „Ô  ÐDefendantððs€conviction€of€aggravated€assault€is€proper€based€on€enhancement€factors€(1),€(6)€andÐ pÀ Ð(10),€and€this€issue€is€therefore€without€merit.Ð \¬ ÐÌà  àWe€turn€now€to€the€Defendantððs€aggravated€kidnapping€conviction.€€The€trial€court€sentencedÐ 4„ Ðthe€Defendant€to€the€maximum€term€of€twelve€years€for€this€felony.€€òòSeeóó€Tenn.€Code€Ann.€ðððð€39„13„Ð  p Ð304(b)(1),€40„35„112(a)(2).€€In€doing€so,€the€trial€court€relied€upon€the€same€four€enhancementÐ  \ Ðfactors€set€forth€above.€€Again,€the€Defendant€does€not€challenge€the€applicability€of€enhancementÐ øH Ðfactor€(1).€€We€find€that€the€trial€court€properly€applied€enhancement€factor€(6)€for€the€same€reasonsÐ ä4 Ðset€forth€above:€€not€every€aggravated€kidnapping€results€in€acute€post„traumatic€stress€disorder.€€WeÐ Ð  Ðfurther€find€that€the€application€of€factor€(10)€is€appropriate€under€the€facts€of€this€case€for€the€sameÐ ¼  Ðreason€it€is€appropriate€with€respect€to€the€aggravated€assault€conviction.€€An€aggravated€kidnappingÐ ¨ø Ðaccomplished€with€a€deadly€weapon€necessarily€involves€a€high€risk€to€the€victimððs€life;€here,Ð ”ä Ðhowever,€it€also€involved€a€high€risk€to€the€victimððs€unborn€fetus.€€Application€of€this€factor€wasÐ €Ð Ðtherefore€appropriate€in€this€case.€€However,€we€find€that€under€òòImfeldóó,€the€trial€court€erred€inÐ l¼ Ðapplying€factor€(16)€on€the€basis€of€the€great€potential€for€bodily€injury€to€Ms.€Slaterððs€unborn€child.€Ð X ¨ ÐNevertheless,€we€hold€that€the€trial€courtððs€imposition€of€the€maximum€sentence€for€the€DefendantððsÐ D!” Ðconviction€of€aggravated€kidnapping€is€proper€based€on€enhancement€factors€(1),€(6)€and€(10).€Ð 0"€  ÐAccordingly,€this€issue€is€without€merit.Ð #l! Ðâ âÐ $X" Ðà  àThe€Defendant€also€argues€that€the€trial€court€erred€in€ordering€her€sentences€to€be€servedÐ ° Ðâ âconsecutively€to€one€another,€for€an€effective€sentence€of€twenty„four€years.€€When€a€defendant€isÐ œì Ðconvicted€of€more€than€one€criminal€offense,€the€trial€court€may€order€the€sentences€to€runÐ ˆØ Ðconsecutively€if€it€finds€by€a€preponderance€of€the€evidence€that€the€defendant€is€a€dangerousÐ tÄ Ðoffender€whose€behavior€indicates€little€or€no€regard€for€human€life,€and€no€hesitation€aboutÐ `° Ðcommitting€a€crime€in€which€the€risk€to€human€life€is€high.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„115(b)(4).€Ð L œ ÐThe€trial€court€found€the€Defendant€in€this€case€to€be€such€a€dangerous€offender.€€In€making€thisÐ 8 ˆ Ðfinding,€the€trial€court€noted€the€duration€of€the€Defendantððs€attack€upon€the€victim€and€theÐ $ t ÐDefendantððs€repeated€refusal€to€disengage€the€attack€and€leave€the€house,€going€so€far€as€toÐ  ` Ðrepeatedly€close€doors€that€were€opened€by€the€victim.€€The€trial€court€also€found€the€DefendantððsÐ ü L  Ðtestimony€at€the€sentencing€hearing,€which€differed€markedly€from€her€statement€to€the€police€andÐ è 8  Ðher€statement€to€the€probation€officer€who€prepared€the€presentence€report,€ð ðtotally€falseðð€andÐ Ô$  Ðconcluded€that€her€ð ðuntruthfulness€[indicates]€that€the€chances€for€rehabilitation€are€zero.ðð€€The€trialÐ À  Ðcourt€also€found€not€credible€the€Defendantððs€testimony€that€she€wanted€treatment€for€her€drug€abuse,Ð ¬ü  Ðstating€that,€had€she€wanted€treatment,€she€would€have€sought€it€while€on€bond€rather€thanÐ ˜è  Ðcontinuing€to€use€cocaine€until€shortly€before€trial.Ð „Ô  ÐÌà  àWe€note€that€the€trial€court€did€not€make€the€specific€findings€on€the€record€required€by€òòStateÐ \¬ Ðv.€Wilkersonóó€for€the€imposition€of€consecutive€sentencing€based€on€a€determination€that€theÐ H˜ Ðdefendant€is€a€dangerous€offender:€€ð ðthat€the€terms€imposed€are€reasonably€related€to€the€severity€ofÐ 4„ Ðthe€offenses€committed€and€are€necessary€in€order€to€protect€the€public€from€further€criminal€acts€byÐ  p Ðthe€offender.ðð€€òòWilkersonóó,€905€S.W.2d€933,€938€(Tenn.€1995).€€We€hold,€however,€that€the€factsÐ  \ Ðadduced€at€the€trial€and€the€sentencing€hearing€support€such€findings.€€We€are€mindful€of€this€CourtððsÐ øH Ðholding€in€òòState€v.€Alexanderóó,€957€S.W.2d€1€(Tenn.€Crim.€App.€1997),€in€which€the€defendant€wasÐ ä4 Ðconvicted€of€attempted€first€degree€murder€and€theft€for€his€invasion€of€the€victimððs€home€whileÐ Ð  Ðabusing€cocaine,€and€his€attack€on€the€victim€with€a€knife€and€claw€hammer.€€The€trial€court€imposedÐ ¼  Ðconsecutive€sentences€on€the€basis€that€the€defendant€was€a€dangerous€offender,€but€did€not€makeÐ ¨ø Ðthe€additional€òòWilkersonóó€findings.€€This€Court€nevertheless€affirmed€the€consecutive€sentences,Ð ”ä Ðfinding€that€€Ð €Ð Ðà  àà8 ` à[the]€defendant€committed€the€very€acts€which€place€citizens€in€theÐ l¼ Ðgreatest€fear:€€he€broke€into€a€home€in€the€middle€of€the€night€for€theÐ X ¨ Ðpurpose€of€stealing€personal€property€and,€in€the€midst€of€his€theft,Ð D!” Ðviciously€attacked€the€unarmed€resident,€doing€his€best€to€hammerÐ 0"€  Ðand€stab€her€to€death.€€These€offenses€were€very€severe€and€warrantÐ #l!
