àThe€appellant,€Earl€Haynes,€appeals€as€of€right€his€conviction€in€the€HickmanÏCounty€Circuit€Court€of€aggravated€assault.€€He€received€a€sentence€of€six€years€as€aÏRange€II€Multiple€Offender€to€be€served€consecutively€to€a€sentence€he€is€currentlyÏserving.Ìà àOn€appeal,€appellant€raises€the€following€issues:€(1)€whether€the€trial€courtÏerred€in€admitting€hearsay€testimony€from€David€Westbrooks€pursuant€to€theÏbusiness€records€exception;€(2)€whether€the€trial€court€should€have€given€the€jury€aÏmissing€witness€instruction;€(3)€whether€the€trial€court€should€have€charged€the€lesserÏoffense€of€assault;€and€(4)€whether€appellant€received€the€effective€assistance€ofÏcounsel.€€Following€a€review€of€the€record,€we€reverse€appellantððs€conviction€andÏremand€to€the€trial€court€for€a€new€trial.Ìà àThe€incident€giving€rise€to€appellantððs€conviction€occurred€December€19,€1993Ïat€the€Turney€Center€Prison€in€Hickman€County€where€appellant€and€the€victim,ÏWalter€Long,€were€incarcerated.€€At€approximately€6:00€p.m.€that€evening,€aÏcorrectional€officer€at€the€prison€walked€by€appellant€and€Long,€who€were€having€aÏconversation€in€the€prison€yard.€€As€he€passed€the€men,€he€heard€one€say€ð ðWhatððdÏyou€disrespect€me€for?ðð€€He€turned€around€and€saw€appellant€pull€a€prison„madeÍknife€out€of€the€back€of€his€pants,€swing€at€the€victim,€and€strike€him€in€the€upper€leftÏchest.€€Appellant€ran,€but€was€quickly€apprehended€by€nearby€officers.€€Ìà àThe€officer€identified€the€knife€as€eight€to€ten€inches€long€and€as€having€a€redÏpiece€of€yarn€on€the€handle.€€When€appellant€was€stopped,€he€was€accompanied€byÏKenneth€Rush,€another€inmate.€€A€search€of€both€men€revealed€two€knives€in€theÏsleeves€of€Rushððs€coat.€€No€weapons€were€found€on€appellant,€but€one€of€the€knivesÏrecovered€had€a€red€shoestring€on€the€handle€and€was€identified€as€the€one€whichÏappellant€used.€€Neither€knife€was€submitted€for€forensic€testing.Ìà àDavid€Westbrooks,€an€internal€affairs€officer€at€the€Turney€Center,€investigatedÏthe€altercation.€€He€testified€that€Long€suffered€a€small€puncture€wound€to€his€leftÏbreast€area€and€was€treated€in€the€infirmary€and€released.€€Westbrooks€spoke€withÏboth€Long€and€appellant€in€the€course€of€his€investigation.€€When€he€spoke€toÏappellant,€appellant€reported€that€ð ða€very€large€manðð€stabbed€him€in€the€genital€areaÏjust€minutes€before€he€attacked€Long.× ƒ% ××  ×€€That€man€was€later€identified€as€WalterÏLong.× ƒ& ××  ×€€Westbrooks€observed€an€injury€to€appellantððs€left€testicle€and€he€testified€thatÍappellant€received€medical€treatment€for€the€wound.€€Westbrooks€also€stated€thatÏcriminal€charges€were€pending€against€Long.Ìà àFinally,€Westbrooks€testified€that€disciplinary€charges€were€brought€againstÏappellant€within€the€prison€system.€€He€stated€that€appellant€pled€guilty€to€assault€andÏwas€disciplined€accordingly.€€Ìà àThe€defense€offered€no€proof€and€the€jury€convicted€appellant€of€aggravatedÏassault,€the€indicted€charge.€€At€a€subsequent€sentencing€hearing,€the€assistantÏdistrict€attorney€informed€the€trial€court€that€the€State€and€the€appellant€had€reachedÏan€agreement€on€the€sentence€appellant€would€receive.€€Appellantððs€counselÏconfirmed€that€they€had€agreed€on€a€six€year€sentence,€the€minimum€in€the€range,€toÏbe€served€consecutively€to€appellantððs€current€sentence.€€After€verifying€thatÏappellant€agreed€to€the€sentence,€the€trial€court€sentenced€appellant€accordingly.Ìà àAppellant€first€argues€that€the€trial€court€erred€in€admitting€certain€hearsayÏtestimony€from€David€Westbrooks€under€the€business€records€exception.€€òòSeeóó€Tenn.ÏR.€Evid.€803(6).€€He€contends€that€Westbrooksðð€testimony€was€inadmissible€becauseÏit€was€premised€upon€prison€records€which€were€not€introduced€into€evidence€andÏbecause€Westbrooks€was€not€the€custodian€of€the€records.€Ìà àAppellantððs€first€contention€is€without€merit.€€He€argues€that€the€businessÏrecords€hearsay€exception€permits€admission€of€the€records€only€and€does€not€coverÏtestimony€based€upon€those€records.€€In€the€absence€of€those€records€being€admittedÍinto€evidence,€he€argues€that€Westbrooksðð€testimony€was€inadmissible€hearsay.€ÏHowever,€our€review€of€the€relevant€case€law€indicates€that€courts€do€not€draw€such€aÏdistinction.€€òòSeeóó€òòAlexander€v.€Inmanóó,€903€S.W.2d€686,€700€n.27€(Tenn.€Ct.€App.Ï1995);€òòState€v.€Haileyóó,€769€S.W.2d€228,€230„31€(Tenn.€Crim.€App.€1989);€òòState€v.ÏBlackmonóó,€701€S.W.2d€228,€231€(Tenn.€Crim.€App.€1985)€(permitting€hearsayÏtestimony€based€on€business€records€that€were€not€admitted€into€evidence).€Ìà àNevertheless,€we€are€unable€to€address€the€merits€of€the€business€recordsÏissue€because€appellant€has€failed€to€make€appropriate€references€to€the€record.€ÏTenn.€Ct.€Crim.€App.€R.€10(b);€òòState€v.€Killebrewóó,€760€S.W.2d€228,€231€(Tenn.€Crim.ÏApp.€1988).€€In€order€to€review€this€issue,€it€is€imperative€for€appellant€to€direct€us€toÏwhich€of€Westbrooksðð€statements€that€he€is€challenging€as€hearsay.€€Unfortunately,Ïhis€brief€fails€to€do€so.€€Westbrooksðð€testimony€encompassed€thirty„eight€pages€ofÏtranscript.€€While€appellant€broadly€attacks€Westbrooksðð€testimony€regarding€medicalÏrecords,€disciplinary€proceedings,€and€appellantððs€guilty€plea€in€prison€disciplinaryÏproceedings,€he€fails€to€refer€to€the€applicable€pages€in€the€record.€€We€cannotÏspeculate€as€to€which€portions€of€the€testimony€that€appellant€believes€were€admittedÏin€error.€€As€a€result,€the€issue€is€waived.€€òòState€v.€Robert€Anthony€Devitoóó,€No.€01C01„9509„CC„00285€(Tenn.€Crim.€App.€at€Nashville,€November€27,€1996)€(concludingÏthat€hearsay€issue€was€waived€for€failure€to€make€appropriate€references€to€record).€€Ìà àAppellant€also€contends€that€he€was€entitled€to€a€missing€witness€instruction€inÏlight€of€the€Stateððs€failure€to€call€the€victim€to€testify€at€trial.€€He€argues€that€it€wouldÏonly€have€been€ð ðnaturalðð€for€the€State€to€call€Long€because€he€had€more€particularÏknowledge€of€the€facts.€€In€denying€appellantððs€request,€the€trial€court€stated€that€aÏmissing€witness€instruction€is€not€warranted€when€the€witness€is€available€to€eitherÏparty.€€We€agree.€€Ìà àGenerally,€when€a€party€fails€to€call€an€available,€material€witness€who€wouldÏbe€expected€to€offer€favorable€testimony,€the€trial€court€may€instruct€the€jury€that€suchÏfailure€leads€to€an€inference€that€the€witnessðð€testimony€would€have€beenÏunfavorable€to€that€party.€€òòState€v.€Francisóó,€669€S.W.2d€85,€88€(Tenn.€1984);€òòDelk€v.ÏStateóó,€590€S.W.2d€435,€440€(Tenn.€1979).€€However,€that€inference€does€not€ariseÏwhen€the€witness€is€equally€available€to€both€parties.€€òòState€v.€Bigbeeóó,€885€S.W.2dÏ797,€804€(Tenn.€1994);€òòState€v.€Eldridgeóó,€749€S.W.2d€756,€758€(Tenn.€Crim.€App.Ï1988);€òòState€v.€Overtonóó,€644€S.W.2d€416,€417„18€(Tenn.€Crim.€App.€1982);€òòBolin€v.ÏStateóó,€472€S.W.2d€232,€235€(Tenn.€Crim.€App.€1971).€€€Ìà àAt€appellantððs€trial,€counsel€freely€admitted€that€Long€was€present€in€theÏcourtroom€and€that€he€had€spoken€to€Long.€€He€stated€that€Long€was€willing€to€testifyÏon€appellantððs€behalf.× ƒ' ××  ×€€Clearly,€the€victim€was€available€to€both€the€prosecution€andÍdefense.€€Appellant€may€not€now€profit€from€his€decision€not€to€call€Long€as€aÏdefense€witness.€€òòEldridgeóó,€749€S.W.2d€at€758.Ìà àAppellant€next€argues€that€the€trial€court€erred€in€denying€his€request€toÏinstruct€the€jury€on€the€lesser€offense€of€assault.€€He€contends€that€assault€is€a€lesserÏincluded€offense€of€aggravated€assault€and€the€trial€court€had€a€duty€to€charge€theÏjury€on€that€offense.€€We€agree€that€assault€should€have€been€charged€to€the€jury.€€Ìà àWhile€somewhat€agreeing€with€defense€counsel€that€the€factual€proofÏsupported€an€instruction€on€assault,€the€trial€court€declined€to€give€that€instructionÍbased€on€the€language€used€in€the€indictment.× ƒ( ××  ×€€As€a€result,€the€only€offense€uponÏwhich€the€jury€received€instruction€was€aggravated€assault.Ìà àAssault€is€a€lesser€grade€offense€of€aggravated€assault.€€òòSeeóó€Tenn.€Code€Ann.Ïðð39„13„101€(1991);€Tenn.€Code€Ann.€ðð39„13„102€(Supp.€1993);€òòTrustyóó,€919€S.W.2dÏat€310.€€Because€all€the€elements€of€assault€are€included€in€the€offense€of€aggravatedÏassault,€it€is€a€lesser€included€offense€as€well.€€òòTrustyóó,€919€S.W.2d€at€311.€€Therefore,Ïif€supported€by€the€evidence€at€trial,€the€trial€court€had€a€mandatory€duty€to€charge€theÏjury€on€the€elements€of€assault.€Ìà àAlthough€we€are€unable€to€discern€a€particular€theory€of€defense€from€theÏrecord,€the€proof€was€susceptible€of€supporting€a€conviction€for€simple€assault.€€InÏspite€of€testimony€that€appellant€struck€the€victim€with€a€knife,€appellant€was€not€inÏpossession€of€a€knife€when€apprehended.€€There€was€no€medical€testimony€toÏdemonstrate€that€the€wound€suffered€by€the€victim€was€caused€by€a€knife.× ƒ) ××  ×€€We€noteÏthat€the€victimððs€accident€report€from€the€prison€infirmary€indicates€that€the€woundÏwas€a€ð ðscratch.ðð× ƒ+ ×× àWhile€it€may€be€abundantly€clear€to€this€Court€or€to€the€trial€judge€thatÏappellant€is€guilty€of€the€greater€offense,€the€determination€of€disputed€facts€is€withinÏthe€exclusive€province€of€the€jury.€€òòState€v.€Boyceóó,€920€S.W.2d€224,€227€(Tenn.€Crim.ÏApp.€1995).€€Without€an€instruction€on€assault,€the€jury€was€not€given€the€opportunityÏto€weigh€the€evidence€with€respect€to€that€offense.€€The€failure€of€the€trial€court€toÏcharge€the€jury€on€simple€assault€deprived€appellant€of€his€right€to€a€jury€trial€on€thatÏoffense.€€òòId.óó€€Appellant€is€entitled€to€a€new€trial.€€€€€Ìà àAppellantððs€final€issue€alleges€that€he€received€the€ineffective€assistance€ofÏcounsel€at€trial.€€He€argues€that€trial€counselððs€failure€to€object€to€certain€hearsayÏtestimony,€failure€to€serve€a€motion€on€the€State€in€advance€of€trial,€and€counselððsÏfailure€to€call€the€victim€to€testify€were€errors€that€fell€below€the€range€of€competenceÏdemanded€of€attorneys€in€criminal€cases.€€Ìà àAlthough€the€issue€of€ineffective€assistance€was€raised€in€appellantððs€motionÏfor€new€trial€and€new€counsel€was€appointed,€there€was€no€proof€submitted€on€theÏissue€at€the€hearing€on€the€motion€for€new€trial,€and€the€trial€court€made€no€factualÏfindings€with€regard€to€this€issue.€€Without€counselððs€testimony€and€other€relevantÏproof,€we€would€be€forced€to€speculate€as€to€counselððs€reasoning€for€his€actions€andÏwhether€any€prejudice€resulted€from€the€alleged€deficiencies.€€òòState€v.€DerenzyÏTurner€and€Vernon€Westóó,€slip€op.€at€17.€€Therefore,€we€decline€to€address€the€issueÍon€the€merits.€€à àIn€light€of€the€trial€courtððs€error€in€failing€to€charge€the€lesserÏincluded€offense€of€assault,€we€conclude€that€appellant€is€entitled€to€a€new€trial.€ÏAccordingly,€we€reverse€the€judgment€of€the€trial€court€and€remand€for€furtherÏproceedings€in€accordance€with€this€opinion.ÌÌÓÓà
