Thepetitionerwasconvictedofaggravatedchildabuse.Thetrialcourtsentencedthepetitionertoconfinementfortwelve(12)yearsintheDepartmentofCorrection.Thiscourtaffirmedthepetitionersconvictionandsentence.DonnaBaileyandDarrellEugeneHeltonv.State,HawkinsCountyNo.03C019207CR00266,1993WL480428(Tenn.Crim.App.,Knoxville,November22,1993).ThesupremecourtdeniedthepetitionersapplicationforpermissiontoappealonApril4,1994. Counselforthepetitionerfiledamotionforachangeofvenue.Itappearsthemotionwaspredicatedupon somepretrialpublicity.Counselarguedthemotion.Thetrialcourttookthemotionunderadvisementtoseeifafairandimpartialjurycouldbeselectedtodecidetheguiltofthepetitioner.Concludingthatafairandimpartialjurywasimpaneled,thetrialcourtdismissedthemotionforachangeofvenue. Theattorneywhorepresentedthepetitionertestifiedonbehalfofthestateduringtheevidentiaryhearing.Hetestifiedtherewerethreemajorissueswhichhadmerit.Whilehedidnotbelievethedefendantwouldbegrantedreliefonthechangeofvenueissue,heneverthelessplacedtheissueinthebriefatthelastmoment.AccordingtothisCourtsopinion,counselfailedtobrieftheissue.ThisCourtheldtheissuehadbeenwaived.SeeTenn.R.App.P.27(a)(7);Tenn.Ct.Crim.App.Rule10.
