OnJanuary4,1991,theappellantpledguiltyintheHardemanCountyCircuitCourttothreecountsoftheftofpropertyover$10,000,classCfelonies.Pursuanttofederalsentencingguidelines,thesestateconvictionswereusedtoenhancetheappellantssentenceresultingfromasubsequentfederalconviction. '   ׀Presently,theappellantisincarceratedattheFederalCorrectionalInstitutioninMemphis,Tennessee.OnMay3,1996,theappellantfiledaprosepetitionforpostconvictionreliefallegingthathis1991HardemanCountyguiltypleaswerenotknowinglyandvoluntarilyentered. (   ׀OnMay14,1996,thetrialcourtdismissedthepetitionasbeingbarredbythestatuteoflimitations. Theappellantpresentstwoargumentstosupporthisclaimthatthetrialcourterredindismissinghispetitionasbeingtimebarred.First,hecontendsthat,duetohisconfinementinthefederalcorrectionfacility,hewas withoutaccesstotheTennesseeCodeAnnotated,therefore,hewasunawareofthethreeyearlimitationperiod.Lackofknowledgedoesnotexcuselatefilings.Skinnerv.State,No.02C019403CC00039,(Tenn.Crim.App.atJackson,July13,1994);(citingWillisv.State,No.01C019211CR00359,(Tenn.Crim.App.atNashville,Oct.21,1993).Thisissueiswithoutmerit. Second,theappellantcontendsthatthenewPostConvictionProcedureAct(effectiveMay10,1995)grantsanadditionaloneyearperiod,untilMay10,1996,tofileapostconvictionpetition.TheappellantspetitionwasfiledonMay3,1996.Tenn.CodeAnn.4030102(1990)(repealed1995)limitedthefilingofpostconvictionpetitionsto"withinthreeyearsofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistaken."SeealsoBurfordv.State,845S.W.2d204(Tenn.1992).Becausenodirectappealwastaken,thejudgments,intheinstantcase,becamefinalthirtydaysaftertheentryoftheappellant'sguiltypleas.Thus,underthethreeyearstatuteoflimitation,theappellanthaduntilFebruary4,1994,tofileapetitionforpostconvictionrelief.AsthepetitionwasnotfileduntilMay3,1996,thetrialcourtcorrectlydismissedthepetitionasbeingtimebarred. WerecognizethatonepanelofthiscourthasheldthatthenewPostConvictionProcedureActcreatesaoneyearwindowwithinwhichpersonswithpreviouslytimebarredpetitionsmayseekrelief.Carterv.State,No.03C019509CC00270,(Tenn.Crim.App.atKnoxville,July11,1996)(Welles,J.,dissenting),perm.app.granted,(Tenn.Dec.2,1996).However,thealmostunanimouspositionofthiscourt,sinceCarter,hasbeenthatthenewactdoesnotrevivepreviouslytimebarredpostconvictionreliefclaims.See,e.g.,Wolfenbargerv.State,No.03C019603CC00124(Tenn.Crim.App.atKnoxville,Apr.1,1997);Carterv.State,No.01C019511CC00398(Tenn.Crim.App.atNashville,Feb.13,1997);Pendletonv.State,No.01C019604CR00158(Tenn.Crim.App.atNashville,Feb.13,1997);Blakev.State,No.03C019603CR00110(Tenn.Crim.App.atKnoxville,Feb.12,1997);Koprowskiv.State,No.03C019511CC00365(Tenn.Crim.App.atKnoxville,Jan.28,1997).
