ChildrensMedicalCenter.Oncrossexamination,OfficerPricetestifiedthatthedefendantwas " ! verycooperative. #"   OfficerDianaDickersonoftheMemphisPoliceDepartmenttestifiedthatshewascalledto t% $ theprecincttopickupthevictimandthatshetookthevictimtothehospital.Shesaidthevictim ]&!% wasafraidandquiet.Shesaidthatwhenshetriedtopickupthevictim,thevictimmoanedlikeshe F'"& wasinpain.Shesaidthevictimwouldnotletonesideofherbodytouchthehospitalbed. /(#'   SergeantTerryPirtleoftheMemphisPoliceDepartmentsSexCrimeChildAbuseSquad *Q%) testifiedthatheinvestigatedthecaseandaskedthedefendanttocometohisofficeforaninterview, *:&* whichthedefendantandthedefendantsgirlfriend,TammyThompson,didthenextday.Hesaid +#'+ thatheandthedefendantwentintoaninterviewroom,thathereadthedefendanthisrights,andthat  thedefendanttoldhimthefollowing:Thevictimsmotherhadcustodyofthevictim,butthevictim  hadbeenlivingwiththedefendantsinceJanuary2002.Whenthevictimcametolivewithhimin  January,thevictimdidnothaveanyscarsorbruises.Thedefendanthadbeendiscipliningthe k victimbecausethevictimwasurinatingonherself.Thedefendantusedaswitchandabelttowhip T thevictim,andthedefendantdisciplinedthevictimmostofthetime.However,Ms.Thompsonalso =  disciplinedthevictim.Thedefendantlovedthevictimandwasnottryingtohurther.The & v defendanttoldSergeantPirtlethathehadlastwhippedthevictimabouttwoweeksbeforethepolice  _ tookherawayfromhim.Oncrossexamination,SergeantPirtleacknowledgedthatthedefendant  H wascooperativeandthathearrestedthedefendantandMs.Thompson.  1    Dr.KarenLakin,whotreatedthevictimatLeBonheurChildrensMedicalCenter,testified   thatthevictimhadmanysofttissueinjuriestoherskin,includinglacerationsandbruises.Shesaid   thatskinwasmissingfromsomeoftheinjuredareasandthatshehaddifficultytellingwhetherthose   injurieswerelacerationsorburns.Shesaidthatthevictimhadaserious,deepinfectionontheback n  ofherrightlegandaninfectedwoundonherupperlip.Shesaidthattheinfectionsresultedfrom W  injuriestotheskin,thatitwouldhavetakenonetofivedaysfortheinjuriestobecomeinfected,and @ thatbothinfectedwoundswouldhavebeenpainful.Shesaidthatthevictimcouldnotfullyextend )y herrightknee,indicatingthatthewoundbehindthekneehadbeen goingonforalittlewhile,and b thatthevictimwouldnotputanyweightontheknee.Shesaidthatbythetimethevictimwas K dischargedfromthehospitalonApril24,thevictimstillwalkedwithaslightlimp.Regardingthe 4 woundonthevictimsupperlip,shestatedthatexcessivescartissueformedbetweenthevictims  noseandupperlip,thattherewasno surefirewaytoremovethescartissue,andthatitwas  possiblethevictimwouldhavethescarsfortherestofherlife.    Dr.Lakintestifiedthatthevictimhadloopshapedmarksonherlegs,indicatingthatthe q victimhadbeenhitwithaloopedcord,andthatthemarksonthevictimwereinvariousstagesof Z healing.Shesaidthatthevictimhadaninjuryononeofherbuttocksandthat wehaddifficulty C tryingtofigureoutwhetheritwasactuallyaburnorjustwhereachunkoffleshhadcomeoff.She ,| saidthevictimwasverymalnourishedbutgainedsixpoundswhileinthehospital.Shesaidthatthe e victimreceivedmorphine,aheavypainkiller,andthatdoctorsusuallydidnotgivemorphineto N children.Shesaidthatwhenthevictimwasdischargedfromthehospital,thevictimwasstilltaking  7 antibioticsandthatthevictimhadtoreceivephysicaltherapy. ! Thompsonimmediatelybeforethepolicetookthevictimintoprotectivecustodyandbecausehe " ! treatedthevictimswounds.Thestateclaimsthattheevidenceissufficient.Weagreewiththe #" state. $#   Ourstandardofreviewwhenthedefendantquestionsthesufficiencyoftheevidenceon _&!% appealis whether,afterviewingtheevidenceinthelightmostfavorabletotheprosecution,any H'"& rationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyondareasonable 1(#' doubt.Jacksonv.Virginia,443U.S.307,319,99S.Ct.2781,2789(1979).Wedonotreweigh )j$( theevidencebutpresumethatthejuryhasresolvedallconflictsinthetestimonyanddrawnall *S%) reasonableinferencesfromtheevidenceinfavorofthestate.SeeStatev.Sheffield,676S.W.2d *<&* 542,547(Tenn.1984);Statev.Cabbage,571S.W.2d832,835(Tenn.1978).Questionsabout +%'+ witnesscredibilitywereresolvedbythejury.SeeStatev.Bland,958S.W.2d651,659(Tenn.  1997).    Thedefendantwasindictedfortwocountsofaggravatedchildabuseandneglect,whichis  onecrimethatcanbesatisfiedbytwodifferentcoursesofconduct,seriousbodilyinjurycausedby k physicalabuseorseriousbodilyinjurycausedbyneglect.SeeT.C.A.39-15-402(a);Statev. T Hodges,7S.W.3d609,622(Tenn.Crim.App.1998)(providingthatT.C.A.39-15-401,thechild =  abuseandneglectstatute,createsonlyonecrime). Seriousbodilyinjuryisbodilyinjuryinvolving & v  (A)Asubstantialriskofdeath;(B)Protractedunconsciousness;(C)Extremephysicalpain;(D)  _ Protractedorobviousdisfigurement;or(E)Protractedlossorsubstantialimpairmentofafunction  H ofabodilymember,organ,ormentalfaculty.T.C.A.39-11-106(a)(34).  1    Takeninthelightmostfavorabletothestate,theevidenceissufficienttosupportthe   convictions.Thedefendantandhisexwifetestifiedthatbeforethevictimwenttolivewithhimin   January2002,thevictimhadnomarksorinjuriesonherbody.Dr.Lakintestifiedthatthevictim   hadlarge,openwoundsonherface,rightleg,andbuttockandthatitwouldhavetakenonetofive n  daysforthewoundstobecomeinfected.Shesaidthatmarksonthevictimindicatedthevictimhad W  beenhitwithaloopedcordandthatthemarkswereinvariousstagesofhealing.Shealsosaidthat @ thevictimreceivedapowerfulmedicationforherpainandthatexcessivescartissueresultedfrom )y thewoundonthevictimsface.Wenotethatphotographstakennearthetimeofthetrialand b introducedintoevidenceshowlargescarsbetweenthevictimsnoseandupperlip.Thedefendant K admittedwhippingthevictimwithaswitchandbelt.Webelievearationaljurycouldhave 4 concludedbeyondareasonabledoubtthatthedefendantphysicallyabusedthevictim,causing  extremelypainfullacerationstoherskin,andthatheneglectedtoseekpropermedicaltreatmentfor  herwounds,whichresultedinthewoundsbecominginfectedanddisfiguringthevictim.The  evidenceissufficienttosupporttheconvictions.    II.SENTENCES Z      Thedefendantclaimsthathissentencesareexcessivebecausethetrialcourtimproperly .~ appliedtwoenhancementfactors.ThestatenotesthattherecentcaseofBlakelyv.Washington, g 542U.S.___,124S.Ct.2531(2004),callsintoquestionatrialcourtsabilitytoenhancea  P defendantssentenceabovethepresumptivesentenceforanyenhancementfactorotherthanfora  9 defendantspriorconvictions.However,thestatecontendsthatthedefendanthaswaivedany !"  BlakelyissuebecauseBlakelydoesnotestablishanewruleinTennessee.SeeSchrirov. " ! Summerlin,___U.S.___,___,124S.Ct.2519,2522(2004)(statingthat [w]henadecisionofthis #" Courtresultsinanewrule,thatruleappliestoallcriminalcasesstillpendingondirectreview). $# Thestatealsoclaimsthat,inanyevent,anymisapplicationofenhancementfactorsunderBlakely v% $ isharmlesserrorbecausetheevidenceestablishingthosefactorsisuncontrovertedand _&!% overwhelming.WeholdthatthetrialcourtimproperlyappliedenhancementfactorsunderBlakely H'"& andreducethedefendantssentencesaccordingly. 1(#'   ThetrialcourtappliedthefollowingenhancementfactorsasprovidedinT.C.A.4035114: *S%) (3)thatthedefendantwasa leaderinthecommissionofanoffenseinvolvingtwo(2)ormore *<&* criminalactors,(5)thatthevictimwasparticularlyvulnerablebecauseofherage,(6)thatthe +%'+ defendanttreatedthevictimwithexceptionalcrueltyduringthecommissionoftheoffenses,(7)that  thepersonalinjuriesinflictedonthevictimwereparticularlygreat,and(16)thatthedefendant  abusedapositionofprivatetrust.Thetrialcourtnotedthatthedefendanthadnopriorconvictions  butheldthatheshouldservethemaximumpunishmentintherangeforaClassAfelony,twenty k fiveyears,foreachconviction.
