Thecountofaggravatedrapeascontainedintheindictmentchargedthatthedefendant unlawfullydidpenetrate[thevictim],towit:byinsertingdefendantspenisinvictimsvagina,thesaid[victim]beingapersonunderthirteen(13)yearsofage,inviolationof[TennesseeCodeAnnotatedϜsection]3914502....  Thecountsofaggravatedsexualbatterychargedthedefendantwithhaving sexualcontactwith[thevictim],towit:by[performingspecificactsoflickingortouchingthedefendantsorthevictimsintimatebodyparts,onesuchactbeingdescribedineachoffivecounts],thesaid[victim]abeingpersonunder13yearsofageinviolationof[TennesseeCodeAnnotatedϜsection]3913504....  AtthetimeoftheoffensesinAugustandSeptemberof1991,TennesseeCodeAnnotatedsection3913502(a)proscribedaggravatedrapeasan unlawfulsexualpenetrationofavictimbythedefendantorthedefendantbyavictimaccompaniedbyanyofthefollowingcircumstances:...(4)Thevictimislessthanthirteen(13)yearsofage.𛀀Tenn.CodeAnn.3913502(a)(1991)(amended1992).  TennesseeCodeAnnotatedsection3913504(a)proscribedaggravatedsexualbatteryasan unlawfulsexualcontactwithavictimbythedefendantorthedefendantbythevictimaccompaniedbyanyofthecircumstanceslistedin3913502(a).Tenn.CodeAnn.3913504(a)(1991)(amended1993). Theproscriptivestatutesinthiscasedonotindicatethatthemensreaisamaterialelementoftheoffensesofrapeoraggravatedsexualbattery.Therefore,becausethedefectofwhichthepetitionercomplainsdoesnotdivestthetrialcourtofjurisdictionorrenderthesubsequentproceedingsvoid,habeascorpusreliefisnotavailable.RogerLeeKimmel,slipop.at6;JamesClydeSaylorv.HowardCarlton,No.03C019612CR00453,slipop.at3(Tenn.Crim.App.,Knoxville,Oct.31,1997).  Evenifthisissuewereproperlybeforethiscourt,thepetitionwouldfailonsubstantivegroundsaswell.Thedefendantclaims,baseduponStatev.RogerDaleHill,Sr.,No.01C019508CC00267(Tenn.Crim.App.,Nashville,June20,1996),thattheindictmentisdefectivebecauseitfailstoallegeaculpablemensrea;however,thesupremecourtreversedthiscourt'sdecisioninRogerDaleHill.SeeStatev.Hill,954S.W.2d725(Tenn.1997).Accordingly,ourresolutionofthisissueisguidedbythesupremecourt'spronouncementinHill.  TheSentencingReformActof1989requiresaculpablementalstateinordertoestablishanoffenseunlessthestatutorydefinitionofthecrime"plainlydispenseswithamentalelement."Tenn.CodeAnn.3911301(b)(1997).ThequestionraisedinHilliswhetheracharginginstrumentwhichchargesacrimethatbyitsstatutorytermsdoesnotexpresslyrequireorplainlydispensewithaculpablementalstateissufficientwithoutexplicitlyallegingaculpablemensrea.Hill,954S.W.2dat726.Thesupremecourtsaidthatsuchacharginginstrumentisneverthelesssufficienttosupportprosecutionwhere8 (1) thelanguageoftheindictmentissufficienttomeettheconstitutionalrequirementsofnoticetotheaccusedofthechargeagainstwhichtheaccusedmustdefend,adequatebasisforentryofaproperjudgment,andprotectionfromdoublejeopardy;8 (2) theformoftheindictmentmeetstherequirementsofTenn.CodeAnn.4013202;and8 (3) thementalstatecanbelogicallyinferredfromtheconductalleged.Hill,954S.W.2dat72627.  Theindictmentlanguageallegingaggravatedsexualbatteryinthiscasecloselyfollowsthestatutorylanguagedescribingthecrime.Itcomplieswiththestatutoryformbystatingthe"factsconstitutingtheoffenseinordinaryandconciselanguage,withoutprolixityorrepetition,insuchamannerastoenableapersonofcommonunderstandingtoknowwhatisintended,andwiththatdegreeofcertaintywhichwillenablethecourt,onconviction,topronouncetheproperjudgment...."SeeHill,954S.W.2dat728;Tenn.CodeAnn.4013202(1997).Further,itisadequatetoprotectthedefendantfromdoublejeopardy.  Whethertherequisitementalstatemaybeinferredfromthecharginglanguagerequiresmoreanalysis.Thecrimeofaggravatedsexualbatteryinvolvingachildlessthanthirteenyearsofagehastwoelements:(1)sexualcontact,and(2)avictimlessthanthirteenyearsold.Tenn.CodeAnn.3913504(a)(4)(1991)(amended1993).Thiscourthaspreviouslyobservedthatthemensreaforsexualcontactisintentional,asprovidedinthedefinitionofsexualcontactfoundinCodesection3913501(6) &   ׀(1997),andthemensreaforthevictim'sageisintentional,knowing,orreckless,asdefinedbyCodesection3911301(c). Withrespecttotheaggravatedrapecharge,wefindtheindictmentatbartobevirtuallyidenticaltotheaggravatedrapeindictmentupheldinHill.Itcloselyfollowsthestatutorylanguagedescribingthecrimes.Itcomplieswiththestatutoryformbystatingthe factsconstitutingtheoffenseinordinaryandconciselanguage,withoutprolixityorrepetition,insuchamannerastoenableapersonofcommonunderstandingtoknowwhatisintended,andwiththatdegreeofcertaintywhichwillenablethecourt,onconviction,topronouncetheproperjudgment....SeeTenn.CodeAnn.4013202(1997);Hill,954S.W.2dat727.Further,thementalstateiscapableoflogicalinferencefromtheconductalleged.SeeHill,954S.W.2dat729;seealsoStatev.Marshall,870S.W.2d532,53738(Tenn.Crim.App.1993).AsthesupremecourtnotedinHill,theallegationof unlawfullysexuallypenetrat[ing]avictimnecessarilyrequiresanintentional,knowingorrecklessmensrea.Hill,954S.W.2d729.Therefore,theallegationraisesaninferenceoftherequiredmentalstate.Hill,954S.W.2dat729.
