OnApril26,1993,AppellantappealedtothisCourtandraisedfourissues.ThisCourtheldthat:(1)testimonyaboutAppellantscharacterorreputationwasnoterror,andevenifitwaserror,itwasharmless;(2)thetrialcourtproperlyrefusedtoallowintoevidencethepriorconvictionsoftheinformant;(3)thetrialcourtdidnoterrbyrefusingtoallowthetestimonyofadefensewitnessbecauseAppellantfailedtolayafoundationforthetestimony;and(4)AppellantwasnoteligibleforRangeIIIpunishmentpursuanttoTenn.CodeAnn.3917417(c)(1),andthus,thetrialcourterredinsentencingAppellantStatev.TommyLeeHill,Jr.,Madisoncounty,C.C.A.02C019212CC00285,OpinionfiledDecember1,1993,atJackson.ThisCourtvacatedAppellantssentence,remandedthecasetothetrialcourtforresentencing,andaffirmedthejudgmentofthetrialinallotherrespects.ThetrialcourtresentencedAppellantonDecember14,1994. OnSeptember11,1991,inCaseNos.90432,90434,901000,901127,91198,91199,and91682,Appellantpleadedguiltytotwocountsofsaleofcocaine,theftover$1,000,possessionofcocainewithintenttosell,possessionofahandgunwhilebeingaconvictedfelon,hinderingasecuredcreditor,andfelonyescape.Appellantdidnotappealtheseconviction. OnJune1,1995,AppellantfiledaprosepetitionforpostconvictionreliefinCaseNo.90433andCaseNos.90432,901000,901127,91198,91199,and91682.HeallegedthathisguiltypleasinCaseNo.90433andCaseNos.90432,901000,901127,91198,91199,and91682wereenteredunintelligentlyandunknowinglyduetotheineffectivenessofhistrialcounsel. OnAugust4,1995,thetrialcourtdismissedthepostconvictionpetitionandruled:(1)thepetitionwasfiledoutsidethethreeyearstatuteoflimitationsinCaseNos.90432,901000,901127,91198,91199,and91682;and(2)regardingCaseNo.90433,thepetitionerallegednogroundsforrelief.@ 2.STATUTEOFLIMITATIONS  Itisclearthatthepetitionforpostconvictionrelief,insofarasitrelatestocases90432,901000,901127,91198,91199,and91682,wasproperlydismissedsummarilysinceitisclearlybarredbytheapplicablethreeyearstatuteoflimitations.See.Tenn.CodeAnn.4030102(Repealed).AppellantneverappealedhisconvictionsinthesecasesandthusthetimeforfilingforpostconvictionreliefwithrespecttothemexpiredonSeptember11,1994.TheinstantpetitionfiledonJune1,1995,isobviouslytimebarred. AppellantclaimsthathedidnotdiscoverhiscounselsallegedineffectivenessuntilDecember14,1994.InBurfordv.State,845S.W.2d204(Tenn.1992);ourstatesupremecourtheldthatapostconvictionpetitionermustbeexcusedfromthestrictoperationofthestatuteoflimitationswhereanewissuearisesneartheendofthelimitationsperiodoraftertheperiodtherebydeprivingapetitionerofafairopportunitytolitigatetheissue.Id.at208. Inthiscasehowever,Appellantsimplyfailedtodiscoverthefactualbasisofanallegedclaimofineffectivenessofcounsel.Burforddoesnotapplytoapostconvictionpetitionerwhosimplysleptonhisrightstoseekpostconvictionrelief.Passarellav.State,891S.W.2d619,62526(Tenn.Crim.App.1994).Therefore,thepostconvictionpetitionwastimebarredandproperlydeniedwithrespecttothecasesnotedabove.@ 3.CASENO.90433ANDTHELACKOFACONSTITUTIONALCLAIM  AlthoughthepetitionforpostconvictionreliefwastimelyfiledwithregardtoCaseNo.90433,itfailstostategroundsforwhichpostconvictionreliefcanbegranted.Postconvictionreliefcanbegrantedonlywhenaconvictionorsentenceisvoidorvoidablebecauseofanabridgementofarightguaranteedbythefederalorstateconstitutions.Tenn.CodeAnn.4030105.ThepetitionisthiscaseallegesthataninvoluntaryguiltypleawasenteredinCaseNo.90433astheresultofallegedineffectivenessofcounsel.ThisissomewhatpuzzlingsinceAppellantwasconvictedbyajuryuponapleaofnotguiltyinCaeNo.90433.Thus,weareunabletofindaconstitutionalclaiminthepetitionregardingCaseNo.90433.
