àThe€Defendant,€Starling€Jean€Hiner,€appeals€as€of€right€her€conviction€for€€firstÏoffense€DUIñxñ›ñxñ€following€a€jury€trial€in€the€Circuit€Court€of€Coffee€County.€€DefendantÏwas€subsequently€found€guilty€by€the€trial€court€of€violation€of€the€Implied€ConsentÏLaw.€€The€trial€court€sentenced€Defendant€to€eleven€(11)€months,€twenty„nine€(29)Ïdays€with€all€but€four€(4)€ñxñœñxñdays€suspendedñxñ›ñxñ€for€the€DUI€conviction,€and€the€courtÏrevoked€her€license€for€a€period€of€one€(1)€year€for€the€violation€of€the€ImpliedÏConsent€Law.€€Defendant€raises€the€following€two€issues€in€this€appeal:€(1)€whetherÏthe€evidence€was€sufficient€to€sustain€a€conviction€for€DUI€beyond€a€reasonableÏdoubt,€and€(2)€whether€the€arresting€officer€made€a€proper€traffic€stop€and€whetherÏhe€had€the€authority€to€make€that€ñxñœñxñstop.€€The€judgment€of€the€trial€court€is€affirmed.ñxñ›ñxñÌÌà àOn€June€29,€1996,€Officer€Ray€Stewart,€Constable€Calvin€McGee€andÏLakewood€Park€security€guard€Terry€Jackson,€were€all€called€to€the€home€of€LucyÏGrizzle,€a€resident€in€Lakewood€Park,€regarding€a€disturbance€between€Ms.€GrizzleÏand€her€neighbor,€the€Defendant.€€Officer€Stewart,€Constable€McGee€and€Mr.ÏJackson€testified€at€trial€that€upon€their€arrival€at€the€Grizzle€residence€atÏapproximately€5:00€p.m.,€Defendant€appeared€to€be€intoxicated€as€she€was€speakingÏloudly,€slurring€her€words,€and€was€unsteady€on€her€feet.€€The€officers€calmedÏeveryone€down€and€then€asked€Defendant€and€her€boyfriend€to€return€to€their€home.€ÏOfficer€Stewart€instructed€Defendant€and€her€boyfriend€that€should€the€officers€needÏœñ{ñtñ{ño›€return,€that€he€would€arrest€them€for€public€intoxication.ÌÌà ` àAt€approximately€9:45€p.m.€that€same€evening,€Constable€McGee€pulled€overÏa€vehicle€in€Lakewood€Park€driven€by€Defendant.€€Mr.€Jackson€was€in€the€car€withÐ ¶9V01 ÐConstable€McGee.€€Constable€McGee€testified€at€trial€that€he€had€first€observed€aÏvehicle€roll€through€a€stop€sign€at€the€intersection€of€Lakewood€Drive€and€Rim€FireÏDrive€and€proceed€to€the€left€on€Rim€Fire€Drive.€€Constable€McGee€then€followed€theÏvehicle€for€approximately€two€and€a€half€blocks€where€he€observed€it€traveling€slowlyÏand€swerving€to€some€extent.€€While€following€the€vehicle€he€realized€that€the€carÏbelonged€to€either€Defendant€or€her€boyfriend€although€he€could€not€tell€who€wasÏdriving€at€the€time.ÌÌà ` àAfter€initiating€the€ð ðblue€lightsðð€and€pulling€the€vehicle€over,€Constable€McGeeÏasked€Defendant,€who€was€in€fact€the€driver,€to€step€out€of€the€car.€€At€this€point€heÏnoticed€that€Defendant€smelled€of€alcohol,€was€unsteady€on€her€feet€and€slurred€herÏspeech.€€Constable€McGee€then€administered€two€field€sobriety€tests,€recitation€ofÏthe€alphabet€and€the€finger€to€nose€test,€both€of€which€Defendant€failed.€€ConstableÏMcGee€determined€Defendant€to€be€ñxñœñxñunder€the€influence€of€alcohol.ñxñ›ñxñÌÌà ` àMr.€Jackson,€who€was€riding€with€Constable€McGee,€also€observed€thatÏDefendant€failed€the€field€sobriety€tests.€€He€testified€that€Defendant€had€beenÏdriving€the€vehicle€very€slowly€and€that€it€was€weaving€prior€to€being€stopped.€€WhenÏDefendant€got€out€of€the€car,€Mr.€Jackson€noticed€that€she€was€ð ðbarely€able€to€standÏupðð€and€that€she€smelled€of€alcohol.ÌÌà ` àConstable€McGee€radioed€Officer€Stewart€when€he€was€following€DefendantððsÏcar€and€told€him€that€he€was€about€to€stop€a€car€because€of€a€suspected€intoxicatedÐ  :À00 Ðdriver.€€Officer€Stewart,€who€was€only€a€few€blocks€away,€drove€to€the€scene€to€aidÏConstable€McGee.€€While€Officer€Stewart€ran€a€records€check€on€the€DefendantððsÏlicense,€he€watched€Defendant€stagger€towards€the€back€of€her€car€and€fail€toÏsuccessfully€complete€the€field€sobriety€tests.€€In€his€opinion,€Defendant€wasÏð ðobviously€drunkðð€and€ð ðhad€no€business€doing€any€driving€of€any€kind.ðð€€He€furtherÏtestified€that€she€appeared€to€be€more€drunk€at€9:45€p.m.€than€when€he€had€seenÏher€earlier€that€day.ÌÌà ` àConstable€McGee€placed€Defendant€under€arrest,€had€her€vehicle€towed,€andÏtook€her€to€the€Coffee€County€Jail.€€While€driving€Defendant€to€jail,€she€told€him€thatÏshe€had€consumed€five€beers.€€Also€while€in€the€patrol€car,€a€car€in€front€of€them€wasÏð ðdriving€all€over€the€roadðð€and€Defendant€commented€to€the€officers€that€ð ð[ñxñœñxñh]eñxñ›ñxñððsÏdrunker€than€I€am.ððÌÌà ` àOfficer€Dale€Brissey,€a€correctional€officer€at€the€county€jail,€testified€that€whenÏDefendant€arrived€at€the€jail€ñxñœñxñsheñxñ›ñxñ€appeared€to€be€under€the€influence€of€an€intoxicant.€ÏHe€noticed€that€her€eyes€were€bloodshot,€her€speech€was€ñxñœñxñslurred,€andñxñ›ñxñ€that€she€œñzñwasÏñzñunsteady›€on€her€feet.€€Defendant€refused€to€submit€to€the€intoximeter€test.ÌÌà ` àDefendant€testified€that€she€was€not€intoxicated€and€that€she€only€consumedÏone€and€one„half€beers€prior€to€being€stopped€by€Constable€McGee.€€She€said€thatÏthe€reason€she€couldnððt€recite€the€alphabet€was€because€she€was€too€nervous€to€doÏso.€However,€she€claimed€that€she€was€not€incapable€of€driving.€€Her€boyfriend,ÏRamsey€Johnson,€testified€that€Defendant€was€not€drunk€and€that€she€consumedÏless€than€two€beers€that€evening.€€He€said€that€she€drove€the€car€because€she€hadÐ  :À00 Ðhad€less€to€drink€that€evening€than€he€had.€€Officer€Stewart,€Constable€McGee,€Mr.ÏJackson€and€Ms.€Grizzle€all€testified€that€even€though€Lakewood€Park€is€a€privatelyÏowned€and€ñxñœñxñoperatedñxñ›ñxñ€development€the€general€public€nonetheless€travels€on€theÏroads€within€Lakewood€Park€on€a€regular€daily€basis.€€Lakewood€Park€does€have€aÏgated€entrance€into€the€subdivision,€but€according€to€testimony€presented€at€trial,Ïessentially€no€one€is€denied€access€into€the€subdivision.€€Ì€€€ÌÓ  ÓI.€€SUFFICIENCY€OF€THE€EVIDENCEÌÓª%ÓÌà ` àWhen€an€accused€challenges€the€sufficiency€of€the€convicting€evidence,€theÏstandard€is€whether,€after€reviewing€the€evidence€in€the€light€most€favorable€to€theÏprosection,€any€rational€trier€of€fact€could€have€found€the€essential€elements€of€theÏcrime€beyond€a€reasonable€doubt.€€òòJackson€v.€Virginiaóó,€443€U.S.€307,€319€(1979).€Ð àFirst,€from€the€testimony€presented€at€trial,€Defendant€was€clearly€in€physicalÏcontrol€of€the€car.€€The€officers€observed€the€car€weaving€on€the€road€and€when€theÏofficers€stopped€the€vehicle,€it€was€Defendant€who€exited€the€car€from€the€driverððsÏside.€€Second,€it€is€clear€to€us€that€Defendant€was€on€premises€frequented€by€theÏpublic€at€large.€€Defendantððs€insufficiency€issue€is€based€on€the€argument€that€sinceÏthe€streets€of€Lakewood€Park€are€privately€maintained€by€the€board€of€trustees€forÏLakewood€that€they€are€not€subject€to€the€laws€of€this€State.€€We€find€that€the€recordÏestablishes€that€the€streets€of€Lakewood€Park€are€frequented€by€the€public€at€large.€ÏAlthough€there€is€a€gated€entrance€into€the€subdivision,€apparently€no€one€is€actuallyÏturned€away€from€entering.€€According€to€testimony,€the€public€enters€the€area€on€aÏdaily€basis€and€three€public€establishments€are€even€located€in€the€subdivision.€ÏDefense€counsel€vigorously€attempted€to€establish€at€trial€that€the€roads€locatedÏwithin€Lakewood€Park€are€not€in€fact€frequented€by€the€public.€€By€its€verdict,€the€juryÏrejected€Defendantððs€claims€and€accredited€those€of€the€State.€€Based€on€a€carefulÏreading€of€Tennessee€Code€Annotated€section€55„10„401,€it€is€clear€that€theÏlegislature€intended€for€that€statute€to€be€applicable€to€private€property€which€theÏpublic€frequents.€€Defendantððs€argument€is€meritless.€€ÌÌà ` àThird,€based€on€the€facts€presented€at€trial,€the€jury€could€have€foundÏDefendant€to€be€under€the€influence€of€an€intoxicant.€€Officer€Stewart,€ConstableÏMcGee,€Mr.€Jackson€and€Correction€Officer€Brissey€all€testified€that€Defendant€wasÐ 9¼// Ðintoxicated.€€Furthermore,€Defendant€failed€to€successfully€complete€the€fieldÏsobriety€tests.€€A€rational€jury€could€have€concluded€that€Defendantððs€appearance,Ïher€unsteadiness€on€her€feet,€her€slurred€speech,€ñxñœñxñherñxñ›ñxññxññxñ€failure€to€adequately€performÏeach€of€the€field€sobriety€ñxñœñxñtests,€and€even€her€own€statements€shortly€after€the€arrest€ñxñ›ñxññxññxñÏdemonstrated€that€Defendant€was€under€the€influence€of€an€intoxicant.€€In€viewingÏthe€evidence€in€the€light€most€favorable€to€the€State,€the€evidence€was€sufficient€toÏsupport€a€conviction€for€first€offense,€DUI.€€This€issue€is€without€merit.Ì€€ÌÓ àDefendant€argues€that€the€arresting€officer,€Constable€McGee,€made€anÏimproper€stop€of€Defendantððs€car,€and€that€furthermore,€he€did€not€have€the€authorityÏto€even€make€the€stop.ÌÌà ` àAn€investigatory€stop€of€a€motor€vehicle€may€be€made€upon€a€reasonableÏsuspicion€by€a€police€officer,€supported€by€specific€and€ñxñœñxñarticulableñxñ›ñxñ€facts,€that€aÏcriminal€offense€has€been€or€is€about€to€be€committed.€€òòSeeóó€òòTerry€v.€Ohioóó,€392€U.S.Ð ðtotality€of€the€circumstances.ðð€€òòStateÐ ð-$$ Ðv.€Watkinsóó,€827€S.W.2d€293,€294€(Tenn.€1992)€(citation€omitted).€€Constable€McGeeÐ ø/˜&& Ðtestified€at€trial€that€he€began€following€a€vehicle€after€he€saw€it€ð ðrollðð€through€a€stopÏsign.€€He€then€observed€the€car€being€driven€in€an€erratic€manner.€€ñxñœñxñTheseñxñ›ñxññxññxñ€ñxñœñxñfactsñoñ€areÏñoññpñsufficient€to€support€a€ñpññpñ,›€Constable›€McGee›€had›€reñpññqñason›€to€believe€that€not€only€had€a€criminal€offense€beenÏcommitted,€but€also€that€a€crime€was€about€to€be€committed.€€Defendantððs€failure€toÏstop€at€the€stop€sign€constituted€the€past€crime€and€based€on€the€weaving€of€theÐ  :À00 Ðvehicle,€the€Constable€was€ñqñreasonable€ñrñsuspicion€ñrññsñin€his€belief€ñsñthat€the€driver€was€under€the€influenceÏof€an€intoxicant.€€This€issue€is€without€merit.ÌÐ  :À00 Ðà `
