Ðmade€the€statement€to€his€sister,€he€told€his€sister€that€he€intended€to€lie€down.€€Such€actions€do€notÐ  $\" Ðindicate€that€the€victim€was€in€an€excited€state.Ð ø$H # Ðà  àFurthermore,€the€hearsay€statement€is€not€admissible€under€òòCarpenteróó.€€In€òòCarpenteróó,€theÐ ä%4!$ Ðvictim„Ô_ÔdeclarantÔ_Ô€made€two€statements€referencing€the€defendant.€€òòCarpenteróó,€773€S.W.2d€at€8.€€TheÐ Ð& "% Ðvictim€made€the€first€statement€during€a€telephone€conversation€with€her€friend,€Ms.€Smith,€at€aboutÐ ¼' #& Ð9:00€Ô_Ôa.m.Ô_Ô€€In€the€first€statement,€the€victim€named€the€defendant€because€she€suspected€the€defendantÐ ¨(ø#' Ðof€having€stolen€money€from€her€store€earlier€that€day.€€òòId.óó€€The€victim€made€the€second€statementÐ ”)ä$( Ðduring€another€call€to€Ms.€Smith€at€approximately€6:20€p.m.€€òòId.óó€€During€this€conversation,€she€toldÐ €*Ð%) ÐMs.€Smith€that€she€would€have€to€hang€up€because€ð ðthat€little€son„of„a„bitch€is€coming€back€in€theÐ l+¼&* Ðstore.ðð€€òòId.óó€€Ms.€Smith€asked€the€victim€if€she€was€talking€about€ð ðthe€guy€you€thought€got€yourÐ ° Ðmoney,ðð€and€the€victim€responded€affirmatively.€€òòId.óóÐ œì Ðà  àThe€trial€court€allowed€the€admission€of€both€hearsay€statements,€and€this€Court€affirmed€theÐ ˆØ Ðtrial€courtððs€decision€by€finding€that€the€second€hearsay€statement€was€admissible€under€the€excitedÐ tÄ Ðutterance€exception€and€that€the€first€hearsay€statement€was€admissible€for€the€limited€purpose€ofÐ `° Ðclarifying€the€meaning€of€the€second€hearsay€statement.€€òòId.óó€at€10.€€Therefore,€òòCarpenteróó€did€notÐ L œ Ðcreate€a€new€hearsay€exception€unrelated€to€the€excited€utterance€exception,€as€the€trial€court€in€theÐ 8 ˆ Ðinstant€case€found,€but€rather€allowed€the€admission€of€a€second€hearsay€statement€in€order€to€clarifyÐ $ t Ðanother€hearsay€statement€that€was€admissible€under€the€recognized€excited€utterance€exception.Ð  ` ÐThus,€òòCarpenteróó€does€not€create€new€law€allowing€the€admission€of€the€contested€hearsay€statementÐ ü L  Ðin€the€case€at€bar.Ð è 8  Ðà  àThe€trial€court€also€considered€the€admissibility€of€the€hearsay€statement€under€TennesseeÐ Ô$  ÐRule€of€Evidence€804(b)(6),€the€ð ðforfeiture€by€wrongdoingðð€hearsay€exception€allowing€admissionÐ À  Ðof€a€hearsay€statement€ð ðagainst€a€party€that€has€engaged€in€wrongdoing€that€was€intended€to€and€didÐ ¬ü  Ðprocure€the€unavailability€of€the€Ô_ÔdeclarantÔ_Ô€as€a€witness.ðð€€Tenn.€R.€Ô_ÔEvidÔ_Ô.€804(b)(6).€€While€our€courtsÐ ˜è  Ðhave€not€published€a€case€construing€this€hearsay€exception,€it€appears€that€a€hearsay€statement€mayÐ „Ô  Ðbe€admitted€against€a€party€under€this€exception€only€if€that€party€intentionally€procured€theÐ pÀ Ðunavailability€of€the€Ô_ÔdeclarantÔ_Ô:€ð ðEven€intentional€misconduct,€such€as€killing€a€witness,€does€notÐ \¬ Ðqualify€unless€done€for€the€purpose€of€procuring€the€witnessððs€unavailability.ðð׃N×Ý ƒM#ÃÝòòÚ  Ú2Ú  ÚóóÝ  Ý×  ×€€Neil€P.€Cohen,€et€al.,Ð H˜ ÐòòTennessee€Law€of€Evidenceóó€ðð€8.39[2][c]€(4th€ed.€2000).€€Because€there€is€no€proof€in€the€record€toÐ 4„ Ðsupport€a€finding€that€the€defendant€harmed€the€victim€for€the€purpose€of€procuring€hisÐ  p Ðunavailability,€we€find€that€the€victimððs€hearsay€statement€was€not€admissible€under€this€hearsayÐ  \ Ðexception.€€Ð øH Ðà  àThe€state€argues€that€the€contested€hearsay€statement€is€admissible€under€the€state„of„mindÐ ä4 Ðhearsay€exception.€€òòSeeóó€Tenn.€R.€Ô_ÔEvidÔ_Ô.€803(3).€However,€in€order€for€the€victimððs€statement€to€beÐ Ð  Ðadmissible€under€the€state„of„mind€hearsay€exception,€the€statement€would€not€be€a€mere€factualÐ ¼  Ðassertion€offered€to€prove€the€truth€of€the€matter€asserted,€as€in€the€instant€case,€but€it€would€expressÐ ¨ø Ðthe€Ô_ÔdeclarantÔ_Ôððs€Ó SÓÔ#†XXXXÈ[#ÔÔ‡XXXXÔÓÈÓð ðthen€existing€state€of€mind,€emotion,€sensation,€or€physical€condition[,]€such€asÐ ”ä Ðintent,€plan,€motive,€design,€mental€feeling,€pain,€and€bodily€health[].ðð€Ó SÓÓÈÓÔ#†XXXXûp#ÔÔ‡XXXXÔ€Tenn.€R.€Ô_ÔEvidÔ_Ô.€803(3).€€TheÐ \¬ Ðvictimððs€statement€to€his€sister€that€Wanda€was€present€in€his€apartment€does€not€express€the€victimððsÐ H˜ Ðsensations,€emotions,€or€motivations,€and€accordingly,€it€was€not€admissible€under€this€hearsayÐ 4 „ Ðexception.€Ð  !p Ðà  àNevertheless,€although€we€find€that€the€trial€court€erred€by€admitting€the€victimððs€hearsayÐ  "\  Ðstatement,€we€find€that€the€admission€to€be€harmless€error.€€While€the€hearsay€statement€was€proofÐ ø"H! Ðof€the€defendantððs€presence€in€the€victimððs€apartment€at€approximately€midnight€on€the€night€of€hisÐ ä#4" Ðmurder,€there€was€other€evidence€linking€the€defendant€and€the€victim€on€that€evening.€€Specifically,Ð Ð$ # Ðthe€defendantððs€husband€testified€that€the€defendant€visited€the€victim€that€evening€at€approximatelyÐ ¼% !$ Ð10:00€p.m.;€a€witness€saw€the€defendant€and€an€unidentified€man€kicking€on€the€defendantððs€doorÐ ¨&ø!% Ðat€sometime€between€11:30€p.m.€and€midnight;€a€witness€testified€that€the€defendant€knew€that€theÐ ”'ä"& Ðvictimððs€head€had€been€beaten,€although€this€information€had€not€been€released€to€the€public;€theÐ €(Ð#' Ðdefendant€sold€a€knife€smelling€of€cleaning€fluid€the€day€after€the€victimððs€death,€and€the€victimððsÐ ° Ðthroat€had€been€slit€by€a€knife€or€knife„like€object;€after€the€murder€the€defendant€was€trying€to€sellÐ œì ÐÔ_ÔLortabÔ_Ô€and€Ô_ÔXanaxÔ_Ô€tablets,€the€same€types€of€prescription€medications€missing€from€the€victimððsÐ ˆØ Ðapartment;€and€the€defendant€was€overheard€telling€her€mother€that€she€was€in€the€victimððs€apartmentÐ tÄ Ðon€the€night€of€his€murder.€€Considering€the€strong€evidence€against€the€defendant,€we€cannot€sayÐ `° Ðthat€the€erroneous€admission€of€this€hearsay€statement€affected€the€outcome€of€the€trial.€€WeÐ L œ Ðtherefore€find€that€the€admission€of€this€hearsay€statement€was€harmless€error€and€accordingly€findÐ 8 ˆ Ðthat€this€issue€does€not€merit€relief.Ð $ t ÐÌÌò òòòòòÓ  ÓóóImproper€Impeachment€of€Defense€Witnessó óóóÐ è 8  ÐÌÓS{Óà  àThe€defendant€argues€that€the€trial€court€erred€by€refusing€to€grant€a€mistrial€or€new€trial€afterÐ À  Ðthe€state€improperly€impeached€Pollock,€the€defendantððs€husband€and€alibi€witness.€€The€stateÐ ¬ü  Ðcontends€that€the€defendant€has€waived€this€issue€by€failing€to€request€a€mistrial€and€that€the€trialÐ ˜è  Ðcourtððs€curative€instruction€was€sufficient€to€safeguard€the€defendant€from€the€prejudicial€effect€ofÐ „Ô  Ðthe€impeachment€evidence.€€Ð pÀ ÐÔ#†XXXX*r#ÔÔ‡XXXXÔà  àWe€first€note€that€the€decision€regarding€whether€to€grant€a€mistrial€is€within€the€trial€courtððsÐ \¬ Ðsound€discretion€and€will€not€be€disturbed€absent€an€abuse€of€that€discretion.€òòState€v.€McPhersonóó,Ð H˜ Ð882€S.W.2d€365,€370€(Tenn.€Ô_ÔCrimÔ_Ô.€App.€1994).€ð ðGenerally€a€mistrial€will€be€declared€in€a€criminalÐ 4„ Ðcase€only€when€there€is€a€ððmanifest€necessityðð€requiring€such€action€by€the€trial€judge.ðð€€òòState€v.Ð  p ÐÔ_ÔMillbrooksÔ_Ôóó,€819€S.W.2d€441,€443€(Tenn.€Ô_ÔCrimÔ_Ô.€App.€1991).€Ð  \ Ðà  àIn€the€instant€case,€the€prosecutor€asked€the€defendantððs€husband€and€sole€alibi€witness,Ð øH ÐDavid€Pollock,€whether€he€had€ever€been€convicted€of€a€crime,€and€Pollock€responded€that€he€hadÐ ä4 Ðbeen€convicted€of€resisting€arrest.€€Defense€counsel€objected,€and€the€trial€court€excused€the€jury.€Ð Ð  ÐThe€trial€court€chastised€the€prosecutor€for€asking€such€a€question€without€first€requesting€a€jury„outÐ ¼  Ðhearing€and€announced€that€it€would€instruct€the€jury€to€disregard€that€portion€of€Pollockððs€testimony.€Ð ¨ø ÐDefense€counsel€then€responded,€ð ðI€donððt€know€what€else€to€do.€€I€donððt€want€a€mistrial€at€this€pointÐ ”ä Ðon€it.€€I€donððt€think€itððs€a€basis€for€a€mistrial,€but€they€need€.€.€.ðð€€The€trial€court€then€called€for€theÐ €Ð Ðjury€to€return€and€gave€the€following€curative€instruction:Ð l¼ ÐÌà8  àLadies€and€gentlemen,€just€before€you€left€the€assistant€district€attorney€asked€aÐ D!” Ðquestion€of€this€defendant€[sic]€regarding€prior€convictions.€€Iððm€instructing€you€atÐ 0"€  Ðthis€time,€as€I€told€you€I€might€during€the€course€of€this€process,€to€disregard€hisÐ #l! Ðobviously€exculpatory,€in€which€€case€the€state€is€bound€to€release€the€information,Ð $X" Ðwhether€requested€or€not);€Ðô$D #Ð Ð  Ðà8  à2.€The€state€must€have€suppressed€the€information;€Ðà%0!$Ð Ð  Ðà8  à3.€The€information€must€have€been€favorable€to€the€accused;€and€ÐÌ&"%Ð Ð  Ðà8  à4.€The€information€must€have€been€material.€€€Ð¸'#&Ð Ð  ÐÌòòState€v.€Ô_ÔEdginÔ_Ôóó,€902€S.W.2d€387,€389€(Tenn.€1995).€The€burden€of€proving€a€òòBradyóó€violation€restsÐ )à$( Ðâ âwith€the€defendant,€and€the€violation€must€be€proven€by€a€preponderance€of€the€evidence.€òòId.óó€Ð |*Ì%) Ðà  àWhen€determining€the€materiality€of€undisclosed€information,€a€reviewing€court€mustÐ ° Ðâ âestablish€whether€ð ðin€[the]€absence€[of€the€information,€the€defendant]€received€a€fair€trial,Ð œì Ðunderstood€as€a€trial€resulting€in€a€verdict€worthy€of€confidence.ðð€òòÔ_ÔKylesÔ_Ô€v.€Whitleyóó,€514€U.S.€419,Ð ˆØ Ð434,€115€S.€Ct.€1555,€131€L.€Ed.€2d€490€(1995).€In€other€words,€evidence€is€considered€material€onlyÐ tÄ Ðif€there€is€a€reasonable€probability€that€had€the€evidence€been€disclosed€to€the€defense,€the€results€ofÐ `° Ðthe€proceeding€would€have€been€different.€òòÔ_ÔEdginÔ_Ôóó,€902€S.W.2d€at€390„91€(citation€omitted).€Ô#†XXXXq©#ÔÐ L œ Ðà  àHere,€the€defendant€complains€that€the€state€failed€to€turn€over€òòBradyóó€material,€namely€anÐ 8 ˆ Ðexculpatory€statement,€discussed€òòinfraóó,€and€the€arrest€and€conviction€records€of€three€state€witnesses,Ð $ t ÐAmi€Wilson,€Tina€Richardson,€and€Ô_ÔVondaÔ_Ô€Mercer.€€Specifically,€Wilson€had€a€then€pending€chargeÐ  ` Ðagainst€her€for€welfare€fraud;€Richardson€had€nine€convictions€for€theft€of€property,€three€convictionsÐ ü L  Ðfor€forgery,€two€convictions€for€writing€worthless€checks,€and€two€convictions€for€criminalÐ è 8  Ðimpersonation;€and€Mercer€had€one€conviction€for€theft.ò òó ó€The€defendant€claims€that€she€could€haveÐ Ô$  Ðimpeached€the€witnesses€with€these€convictions,€as€they€are€all€convictions€for€crimes€relating€toÐ À  Ðhonesty.€€Furthermore,€she€claims€that€she€could€have€impeached€Wilson€with€her€pending€chargeÐ ¬ü  Ðfor€fraud€in€order€show€the€witnessððs€possible€motivation€for€cooperating€with€the€state€in€order€toÐ ˜è  Ðreceive€leniency€during€the€resolution€of€her€own€case.Ð „Ô  Ðà  àThe€defendant€also€claims€that€the€impact€of€impeaching€these€three€material€witnesses€wouldÐ pÀ Ðhave€been€great€because€of€the€importance€of€the€substance€of€their€testimony.€€Wilson€testified€thatÐ \¬ Ðon€the€day€of€the€victimððs€murder,€he€possessed€Ô_ÔLortabÔ_Ô€and€Ô_ÔXanaxÔ_Ô€pills€on€his€person,€as€well€as€aÐ H˜ Ðmoney€clip,€twenty„three€dollars,€and€a€wallet,€which€are€the€only€items€that€were€discovered€to€haveÐ 4„ Ðbeen€stolen€from€the€victim€after€his€murder.€€Richardson€testified€that€the€defendant€sold€her€a€knifeÐ  p Ðshortly€after€the€victimððs€murder€and€that€the€knife€had€an€odor€of€cleaning€fluid€on€it€when€sheÐ  \ Ðreceived€it€from€the€defendant.€€Mercer€testified€that€the€defendant€told€her€that€she€had€spoken€withÐ øH Ðthe€victim€the€night€before€his€death€and€that€the€defendant€went€to€a€trailer€attempting€to€sell€aÐ ä4 Ðsecond€knife€the€morning€after€the€victimððs€murder.Ð Ð  Ðà  àIn€light€of€these€witnessesðð€testimony,€we€find€that€while€there€may€be€a€possibility€that€theÐ ¼  Ðoutcome€of€the€trial€would€have€been€different€if€the€defendant€had€been€able€to€impeach€theseÐ ¨ø Ðwitnesses€with€their€arrest€and€conviction€records,€we€cannot€say€with€any€certainty€that€there€is€aÐ ”ä Ðreasonable€probability€that€the€outcome€of€the€trial€would€have€been€different.€€The€state€put€on€proofÐ €Ð Ðfrom€nineteen€different€witnesses,€and€while€the€three€witnesses€in€question€provided€substantiveÐ l¼ Ðevidence,€we€cannot€say€that€even€if€we€were€to€discount€their€testimony,€there€is€a€reasonableÐ X ¨ Ðprobability€that€the€result€of€the€proceeding€would€have€been€different.Ð D!” Ðà  àFurthermore,€this€Court€has€previously€rejected€arguments€that€a€defendant€was€prejudicedÐ 0"€  Ðby€the€stateððs€failure€to€provide€arrest€and€conviction€records€in€response€to€a€discovery€motion.€€InÐ #l!
