HirtlewassentencedasaRangeIII,PersistentOffender,tofourteen(14)yearsforeachcountofaggravatedburglaryandeleven(11)monthsand29daysforeachcountoftheft.Eachsentenceforaggravatedburglarywastobeservedconcurrentlywiththesentencefortheftunderthesameindictment.Thesentencesforthechargesinthesecondandthirdindictmentsweretobeservedconcurrentlywithoneanother.However,thesentencesforthechargesunderthesecondandthirdindictmentsweretobeservedconsecutivelytothesentencesunderthefirstindictment,givinganeffectivesentenceof28years.Additionally,becauseHirtlecommittedthecrimeswhileonparoleforanotheroffense,eachcountranconsecutivelytotimeservedfortheparoleviolation. Hirtlesfirstargumentisthatasentencingcourtisnotpermittedtoapplythesamepriorconvictionstoenhanceasentenceaswellastosupportconsecutivesentencing.ThisCourthaspreviouslyheldthatthereisnothinginthe1989SentencingActwhichwouldprohibitconsiderationofpriorcriminalconvictionsandbehaviorforbothenhancementandconsecutivesentencingpurposes.Statev.Melvin,913S.W.2d195,205(Tenn.Crim.App.1995);Statev.Meeks,867S.W.2d361,377(Tenn.Crim.App.1993).Therefore,wefindnoerrorinthetrialjudgesdecisiontoconsiderpastcriminalconvictionstobothenhanceappellantssentenceandtojustifyconsecutivesentencing. Additionally,Hirtlecontendsthatthetrialcourtrefusedtoapplyasamitigatingfactorthathisconductdidnotcauseorthreatenseriousbodilyinjury.SeeT.C.A.4035113(1).ThestatedisagreesandsuggeststhatbecauseHirtledidnotofferanyevidenceprovingthathisbehaviordidnotcauseorthreatenseriousbodilyinjury,thetrialcourtiswithoutauthoritytoconsiderthismitigatingfactorforsentencing.Regardless,thetrialjudgehasthediscretiontodeterminetheweightgiventoeachenhancementandmitigatingfactor.Statev.Moss,727S.W.2d229(Tenn.1986);Statev.Santiago,914S.W.2d116(Tenn.Crim.App.1995).Thismitigatingfactor,evenifconsidered,wouldbeentitledtolittleweight.Hirtlehasalengthycriminalrecordandcommittedthepresentoffenseswhileonparole.Althoughtheremaybemitigatingfactorsinvolved,thesefactorsaregreatlyoutweighedbytheaggravatingfactors.Underourdenovostandardofreview,weconcludethatHirtlereceivedfairsentences.
