OnMarch20,1997,hefiledanotherpostconvictionreliefpetitionentitled MotionforPostConvictionReliefBasedUponNewlyDiscoveredEvidenceϜchallengingbothconvictions.Heagainattackedtheeffectivenessoftrialcounselandalleged newlydiscoveredevidenceconsistingofmentalhealthevaluationsconductedbetween1966and1972.Heallegestheseevaluationsestablishadefenseofinsanityandincompetencetostandtrialin1979.Thetrialcourtdismissedthepetitionbaseduponthestatuteoflimitations.SeeTenn.CodeAnn.4030202,217.Thisdismissalformsthebasisofthepresentappeal.@ II  SincethesubjectpetitionwasfiledafterMay10,1995,itisgovernedbythePostConvictionProcedureActof1995.SeeTenn.CodeAnn.4030201CompilersNotes.ThePostConvictionProcedureActcontemplatesthefilingofonlyonepetitionforpostconvictionrelief.Tenn.CodeAnn.4030202(c).Ordinarily,asecondorsubsequentpetitionistobesummarilydismissed.Id.ApetitionermayfileamotiontoreopenapriorpostconvictionproceedingunderlimitedcircumstancesassetoutinTenn.CodeAnn.4030217(a). ThepetitiondoesnotmeetanyofthecriteriaforamotiontoreopenpursuanttoTenn.CodeAnn.4030217.PetitionerallegesthatinMay1996hediscoveredcertainmentalhealthrecordscompiledbetween1966and1972andthenfiledthepresentpetitionwithinoneyear.Heconcludesthattheserecords,whichrevealadiagnosisofchronicororganicbrainsyndrome,establishthathewasnotcompetenttostandtrialin1979andcouldhavebeenusedtoestablishaninsanitydefense.TheonlyarguablebasistoreopenwouldbeTenn.CodeAnn.4030217(a)(2)allowingaclaim baseduponnewscientificevidenceestablishingthatsuchpetitionerisactuallyinnocentoftheoffenseoroffensesforwhichthepetitionerwasconvicted.Petitionerwouldalsohaveto establishbyclearandconvincingevidencethatthepetitionerisentitledtohavetheconvictionsetasideorthesentencereduced.Tenn.CodeAnn.4030217(a)(4).Therecordsrelieduponbypetitionerdonotestablishactualinnocenceoftheoffensesforwhichthepetitionerwasconvicted.Evenifthefactsunderlyingtheclaimaretrue,thatpetitionerwasdiagnosedatvarioustimesbetween1966and1972withchronicororganicbrainsyndrome,thiswouldnotentitlepetitionertohavetheconvictionsorsentencessetaside. Furthermore,petitionerdidnotproperlyperfecthisappealtothisCourt.Thedenialofamotiontoreopenmustbeappealedwithinten(10)daysbyfilinganapplicationforpermissiontoappeal.Tenn.CodeAnn.4030217(c).Petitionerdidnotfollowthisprocedure. Moreover,petitionermaynotagainchallengetheeffectivenessofhistrialcounsel.Agroundforreliefis previouslydeterminedifacourtofcompetentjurisdictionhasruledonthemeritsafterafullandfairhearing.Tenn.CodeAnn.4030206(h).Afullandfairhearinghasoccurredwherethepetitionerwasaffordedanopportunitytocallwitnessesandpresentevidence.Id.;Housev.State,911S.W.2d705,711(Tenn.1995).Petitionerlitigatedtheeffectivenessoftrialcounselinthepriorpetitions.Thus,theissueoftheeffectivenessoftrialcounselhasbeenpreviouslydetermined.
