Ðtestified€that€she€began€feeling€a€burning€sensation€and€noticed€abrasions€on€her€leg.€She€then€wentÐ <#Œ" Ðto€the€Emergency€Room.Ð "$r# ÐÌà  àThe€next€day,€Tennessee€State€University€police€officers,€Carlton€Bowen€and€JacquelineÐ î%>!% ÐBumpas,€called€the€appellant€out€of€class€to€serve€an€arrest€warrant€on€her.€€The€appellant€becameÐ Ô&$"& Ðbelligerent,€cursed€at€the€officers,€and€refused€to€let€them€search€her.€€Because€of€her€physicalÐ º' #' Ðresistance,€the€officers€handcuffed€the€appellant.€€The€officers€took€the€appellant€to€see€DeanÐ  (ð#( ÐLockridge,€the€Associate€Vice€President€of€Student€Affairs€who€handles€disciplinary€sanctions€at€theÐ †)Ö$) Ðuniversity.€€The€Dean€asked€the€appellant€whether€she€would€have€the€same€attitude€if€it€had€beenÐ ° Ða€metro€police€officer€in€Davidson€County€that€had€asked€her€to€move.€€The€appellant€replied€thatÐ –æ Ðshe€would€have€reacted€in€the€same€manner€regardless.€Ð |Ì ÐÌà  àAs€a€result€of€the€accident,€Hodge€has€been€diagnosed€with€Reflex€Sympathetic€Dystrophy,Ð H˜ Ðwhich€is€trauma€to€the€nervous€system€of€the€leg.€€She€suffers€from€severe€swelling€in€the€leg€andÐ . ~ Ðhas€been€unable€to€return€to€work.€€€Presently,€there€is€no€cure€for€this€disorder.€At€trial,€the€appellantÐ  d Ðadmitted€that€she€told€the€officer€to€move,€but€denied€knowledge€of€hitting€her.€€The€appellant€alsoÐ ú J Ðadmitted€to€writing€a€letter€of€apology€to€Hodge,€but€stated€that€she€only€wrote€the€letter€because€theÐ à 0 Ðuniversity€required€her€to€do€so€as€a€condition€of€graduation€and€that€she€was€not€sorry€about€theÐ Æ   Ðincident.Ð ¬ ü  ÐÌò òÓ  ÓI.€€Length€of€the€SentenceÐ xÈ  ÐÓ  Óó óÌà  àThe€appellant€contends€that€the€sentence€ð ðimposed€was€excessiveðð€and€asks€this€Court€toÐ D”  Ðgrant€her€ð ðrelief€in€the€form€of€a€sentence€of€probation€or€other€appropriate€sentence€alternative€toÐ *z  Ðher€sixty€(60)€day€sentence€to€serve.ðð€€Upon€review,€we€find€the€sentence€imposed€by€the€trial€courtÐ ` Ðto€be€proper.€€Therefore,€we€affirm€the€judgment€of€the€Davidson€County€Criminal€Court.Ð öF ÐÌà  àThe€appellant€bears€the€burden€of€establishing€that€the€sentence€imposed€by€the€trial€courtÐ Â Ðwas€erroneous.€€òòState€v.€Ashbyóó,€823€S.W.2d€166,€168€(Tenn.€1991);€òòState€v.€Boggsóó,€932€S.W.2d€467,Ð ¨ø Ð473€(Tenn.Crim.App.€1996);€òòState€v.€Fletcheróó,€805€S.W.2d€785,€786€(Tenn.Crim.App.€1991).Ð ŽÞ ÐAppellate€review€of€a€sentence€is€òòde€novoóó,€with€a€presumption€that€the€determinations€made€by€theÐ tÄ Ðcourt€from€which€the€appeal€is€taken€are€correct.€€Tenn.€Code€Ann.€ðð€40„35„401(d);€òòAshbyóó,€823Ð Zª ÐS.W.2d€at€169.€€In€determining€whether€the€appellant€has€carried€the€burden,€this€Court€mustÐ @ Ðconsider€the€evidence€received€at€the€trial€and€the€sentencing€hearing,€the€presentence€report,€theÐ &v Ðprinciples€of€sentencing,€the€arguments€of€counsel,€the€nature€and€characteristics€of€the€offenses,Ð  \ Ðexisting€mitigating€and€enhancing€factors,€statements€made€by€the€offender,€and€the€potential€forÐ òB Ðrehabilitation.€€òòAshbyóó,€823€S.W.2d€at€169òòóó;€Tenn.€Code€Ann.€ðð€40„35„210.€€Ð Ø( ÐÌà  àThe€appellant€is€twenty„three€years€old€and€is€a€graduate€of€Tennessee€State€University€withÐ ¤ô Ða€degree€in€mathematics.€€Her€prior€criminal€history€reflects€two€misdemeanor€arrests€for€assault€andÐ Š Ú Ðdrugs.€€The€assault€charge€was€retired€following€completion€of€a€diversion€program.€€Following€herÐ p!À  Ðconviction€for€drug€possession,€she€was€granted€probation.€€In€the€present€case,€the€appellant€wasÐ V"¦! Ðconvicted€of€aggravated€assault,€a€class€C€felony.€òòSeeóó€Tenn.€Code€Ann.€ðð€39„13„102.€€Because€theÐ <#Œ" Ðappellant€was€convicted€of€a€class€C€felony,€she€is€entitled€to€the€presumption€that€she€is€a€favorableÐ "$r# Ðcandidate€for€alternative€sentencing.€€òòSee€óóTenn.€Code€Ann.€ðð€40„35„102(6).€€Accordingly,€the€trialÐ %X $ Ðcourt€imposed€a€sentence€of€split€confinement,€which€is€listed€as€a€sentencing€alternative€in€Tenn.Ð î%>!% ÐCode€Ann.€ðð€40„35„104(4).€€Therefore,€the€trial€court€properly€applied€the€statutory€presumptionÐ Ô&$"& Ðunder€Tenn.€Code€Ann.€ðð€40„35„102(6).Ð º' #' ÐÌà  àThe€appellant,€in€effect,€argues€that€€the€trial€court€erred€by€not€sentencing€her€to€fullÐ †)Ö$) Ðprobation.€€ð ðThe€determination€of€whether€the€appellant€is€entitled€to€an€alternative€sentence€andÐ l*¼%* Ðwhether€the€appellant€is€entitled€to€full€probation€are€different€inquires.ðð€€òòState€v.€Boggsóó,€932€S.W.2dÐ R+¢&+ Ð467,€477€(Tenn.Crim.App.€1996).€€Where€a€defendant€is€entitled€to€the€statutory€presumption€ofÐ 8,ˆ', Ðalternative€sentencing,€the€State€has€the€burden€of€overcoming€the€presumption€with€evidence€to€theÐ ° Ðcontrary.€€òòState€v.€Binghamóó,€910€S.W.2d€448,€455€(Tenn.Crim.App.€1995).€€Conversely,€theÐ –æ Ðdefendant€has€the€burden€of€establishing€her€suitability€for€total€probation,€even€if€the€appellant€isÐ |Ì Ðentitled€to€the€statutory€presumption€of€alternative€sentencing.€òòId.óó;€€òòBoggsóó,€932€S.W.2d€at€477.€€ToÐ b² Ðmeet€the€burden€of€establishing€suitability€for€full€probation,€the€defendant€must€demonstrate€thatÐ H˜ Ðprobation€will€ð ðsubserve€the€ends€of€justice€and€the€best€interest€of€both€the€public€and€theÐ . ~ Ðdefendant.ðð€òòId.óó€at€456.Ð  d ÐÌà  àIn€determining€a€defendantððs€suitability€for€probation,€the€sentencing€court€should€considerÐ à 0 Ð(1)€the€nature€and€circumstances€of€the€conduct€involved;€(2)€the€defendantððs€potential€or€lack€ofÐ Æ   Ðpotential€for€rehabilitation,€including€the€risk€that€during€the€period€of€probation€the€defendant€willÐ ¬ ü  Ðcommit€another€crime;€(3)€whether€a€sentence€of€full€probation€would€unduly€depreciate€theÐ ’â  Ðseriousness€of€the€offense;€and€(4)€whether€a€sentence€other€than€full€probation€would€provide€anÐ xÈ  Ðeffective€deterrent€to€others€likely€to€commit€similar€crimes.€€Tenn.€Code€Ann.€ðððð€40„35„210(b)(4),Ð ^®  Є103(5),€„103(1)(B);€òòsee€also€óóòòBinghamóó,€910€S.W.2d€at€456.Ð D”  ÐÌà  àAt€sentencing,€the€appellant€offered€the€testimony€of€three€witnesses.€€The€first€witness,Ð ` ÐSusan€Sims,€stated€that€it€was€out€of€character€for€the€defendant€to€be€arrogant,€but€that€she€did€ð ðhaveÐ öF Ðan€experience€where€[the€appellant]€was€disrespectful€to€authority.ðð€€The€second€witness,€CalvinÐ Ü, ÐPeters,€described€the€appellant€as€a€role€model,€a€team€player,€and€never€disrespectful,€or€arrogant.Ð Â ÐThe€third€witness,€Morris€Fitzgerald,€testified€that€the€appellant€was€a€leader€and€stated€that€he€hadÐ ¨ø Ðnever€known€her€to€be€disrespectful€to€authority.Ð ŽÞ ÐÌà  àThe€trial€court€ultimately€concluded€that€the€appellant€had€shown€no€remorse€for€the€incident,Ð Zª Ðother€than€a€meager€ð ðIððm€sorryðð€during€sentencing€when€she€began€to€realize€the€severity€of€theÐ @ Ðproceedings.€€€While€the€trial€court€recognized€that€the€appellant€was€an€intelligent€young€lady€withÐ &v Ða€bright€future€and€commended€the€witnesses€who€testified€on€her€behalf,€the€court€indicated€that€theÐ  \ Ðappellant€had€never€accepted€responsibility€for€her€actions€and€stated,€ð ðshe€still€thinks€that€what€theÐ òB Ðofficer€did€is€what€caused€the€problem,€not€her€arrogance€or€disrespect€or€whatever€it€was€for€them.ðð€Ð Ø( ÐThe€trial€judge€further€stated€that€he€felt€the€appellant€ð ðshould€serve€a€short€period€of€time€in€jailÐ ¾ Ðwhere€[she€could]€reflect€on€exactly€what€[she]€did.ðð€€Lastly,€the€trial€court€concluded€that€the€periodÐ ¤ô Ðof€jail„time€would€serve€as€a€deterrence€to€similar€behavior€by€the€appellant€in€the€future.Ð Š Ú ÐÌà  àUpon€review,€we€find€the€trial€court€properly€imposed€a€sentence€of€split€confinement.€€ð ðTheÐ V"¦!
