InMay2002,aShelbyCountygrandjuryreturnedtwomulticountindictmentsagainstthe ## Appellantcharginghimwithnumerousfelonydrugoffenses.Theindictmentsresultedfrom $$ offenseswhichoccurredinJulyandAugust2001.ApleaagreementwasreachedbytheStateand v% % theAppellant.TheproofattheguiltypleahearingestablishedthatinJuly2001,policeofficers _&!& stoppedtheAppellantsvehicleandfoundhimtobeinpossessionof7.4gramsofcrackcocaineand H'"' 1.4gramsofmarijuana.TheAppellantwasarrestedforthesedrugoffensesandreleasedonbond. 1(#( InAugust2001,duringtheexecutionofasearchwarrantofahouseownedbytheAppellant, )j$) officersseized666gramsofmarijuana,drugparaphernalia,andasmallquantityofhydromorphone. *S%*   ThetermsofthepleaagreementprovidedthatwithregardtotheAugustoccurrence,the +%', Appellantwouldpleadguiltytoattemptedfelonypossessionofcocaine,aclassDfelony,andClass ,(- Efelonypossessionofmarijuanaandreceivesentencesoftwoyearsandoneyearrespectivelyfor -(. _theseconvictions.Thesentencesweretobeservedconcurrently.WithregardtotheJuly2001  offenses,theAppellantagreedtopleadguiltytofelonypossessionofmarijuanaandreceiveaone  yearsentence,anduponhisguiltypleatomisdemeanorpossessionofhydromorphonebeassessed  afineof$750.00.ThetwoJulyoffensesweretobeservedconcurrentlybutconsecutivelytothe k Augustoffenses,resultinginaneffectivethreeyearsentence.Thepleaagreementfurtherprovided T thattheissueofwhethertheAppellantwouldreceiveanalternativesentencewouldbesubmitted =  tothetrialcourtfordetermination.OnApril4,2004,thetrialcourtacceptedtheAppellantspleas & v andimposedthesentencesprovidedbythepleaagreement.  _   TheproofatthesentencinghearingestablishedthattheAppellantwasthirtyyearsoldand  1  thefatherofonechild.Hedroppedoutofschoolintheninthgrade,butheobtainedhisGEDwhile    inprison.ThepresentencereportreflectsonlytwoperiodsofemploymentduringtheAppellants   adulthood.Hewasemployedasajanitorforaoneyearperiodandworkedfor Mrs.Winners   ChickenandBiscuitsforfourmonths.TheAppellantcontestedthecompletenessandaccuracyof   thisemploymenthistoryatthesentencinghearing.ThetrialcourtcharacterizedtheAppellants n  previousworkhistoryas sketchy,atbest. W    Withregardtopriorcriminalhistory,thepresentencereportshowsapatternofcriminal )y activitybeginningatageeighteenandcontinuingtothepresent.Hiscriminalrecordincludestwo b felonyconvictions,oneforattemptedseconddegreemurderresultinginatenyearsentenceanda K felonydrugconvictionresultinginaoneyearsentence.Inaddition,hisrecordreflectsfourprior 4 misdemeanordrugconvictions.Followingthisproof,thetrialcourtdeniedallformsofalternative  sentencingandorderedthattheAppellantseffectivethreeyearsentencebeservedinconfinement. CodeAnn.4035210(2003).Theburdenofshowingthatthesentenceisimproperisuponthe #" appealingparty.Tenn.CodeAnn.4035401(d),SentencingCommissionComments. $#   InviewoftheAppellantsguiltypleastoclassDandEfelonies,asaRangeIoffender,itis _&!% undisputedthatheisstatutorilyentitledtothepresumptionofanalternativesentence.Tenn.Code H'"& Ann.4035102(5)(2003).TherecorddemonstratesthatthetrialcourtaffordedtheAppellantthis 1(#' presumptionatthesentencinghearing. )j$(   TheAppellantcontendsthatthetrialcourterredbydenyinghimprobationorasentenceof *<&* splitconfinement.Insupportofthisposition,hearguesthathisconductnever threatenedbodily +%'+ harmtoanyoneandthatheisa goodcandidateforrehabilitation.Wefind,asdidthetrialcourt,  thatthecircumstancesofthecurrentdrugconvictions,theAppellantspriorcriminalhistory,and  theAppellantsongoingdrugactivitybeliethisargument.Atthesentencinghearing,theAppellant  admittedthathehadbeensellingdrugs sincehe[was]seventeen.Theproofalsoestablishedthat k thehousewhichwasthesubjectoftheAugustsearchwasusedbytheAppellantasalocationto T storedrugsforresale.Thetrialcourtdeniedallformsofalternativesentencing basedon[the =  Appellants]lengthyrecord,hislengthyinvolvementwithcriminalviolationsandcriminal & v convictions.ThetrialcourtfoundtheAppellantsestablishmentofa drughouseabhorrentand  _ the rootproblemforthedemiseofcommunityneighborhoods.
