InHill,thisCourtheldthatanindictmentforaggravatedrapeallegingthatthedefendanthad unlawfullysexuallypenetrate[d]thevictimwasinsufficientbecauseitdidnotallegeaculpablementalstate.However,ourSupremeCourthasoverruledthisCourtsdecisioninHill,holdingthataggravatedrape iscommittableonlyiftheprincipalactor'smensreaisintentional,knowing,orreckless.Thus,therequiredmentalstatemaybeinferredfromthenatureofthecriminalconductalleged.Statev.Hill,__S.W.2d__(Tenn.1997)(footnoteomitted).
