ÐUpon€further€search,€the€officers€discovered€$€1645.00€in€cash€on€Jacksonððs€person,€a€small€amountÐ tÄ Ðafterward.€€Defendant€claimed€that€she€lived€with€Jackson€and€that€she€packed€the€suitcases€for€bothÐ l*¼%* Ðof€them€on€the€evening€prior€to€their€departure.€€She€stated€that€Jackson€placed€the€suitcases€in€theÐ R+¢&+ Ðcar,€however,€and€that€he€also€had€access€to€them€in€the€hours€before€they€left.€€Defendant€deniedÐ 8,ˆ', Ðknowledge€regarding€the€ownership€of€the€drugs€that€were€wrapped€in€her€clothing,€but€claimed€thatÐ ° ÐJackson€gave€her€the€marijuana€discovered€in€her€pocket.€€Ð –æ ÐÌà  àDefendant€testified€that€she€had€worked€for€only€three€months€during€the€last€year€and€thatÐ b² ÐJackson€supported€Defendant€financially.€€Jackson€worked€sporadically,€but€he€always€had€moneyÐ H˜ Ðand€told€Defendant€not€to€be€concerned.€€Defendant€testified€that€although€she€considered€thisÐ . ~ Ðsituation€strange,€she€stopped€questioning€Jackson€regarding€money€matters€because€this€wouldÐ  d ðfacilitation€of€the€offense€charged€orÐ à 0 Ðof€an€offense€that€otherwise€meets€the€definition€of€lesser-included€offense€in€part€(a)€or€(b)....ðð€€òòIdóó.Ð Æ   Ðat€466-67.€€Once€a€particular€offense€is€a€lesser-included€offense€under€the€above€test,€the€nextÐ ¬ ü  Ðinquiry€is€whether€the€evidence€justifies€a€jury€instruction€on€such€lesser€offense.€€òòIdóó.€at€467.€€ThisÐ ’â  Ðinquiry€has€two€parts.€€First,€the€trial€court€must€determine€ð ðwhether€any€evidence€exists€thatÐ xÈ  Ðreasonable€minds€could€accept€as€to€the€lesser-included€offense.ðð€€òòIdóó.€at€469.€€In€making€thisÐ ^® l*¼%* Ðtwo€possible€scenarios:€criminal€responsibility€for€the€instant€offense€or€an€acquittal.€€òòSeeóó€òòid.óó€at€289.€Ð R+¢&+ ÐIn€òòFowleróó,€the€defendant€pled€guilty€to€criminal€activity€but€argued€at€trial€that€he€was€not€criminallyÐ 8,ˆ', Ðresponsible€for€the€offenses€committed€by€a€co„defendant€because€he€lacked€intent.€€FowlerÐ ° Ðmaintained€that€the€trial€court€should€have€instructed€the€jury€on€facilitation€as€a€lesser„includedÐ –æ Ðoffense.€€During€the€trial,€however,€Fowler€did€not€contend€he€was€guilty€of€facilitation,€did€not€showÐ |Ì Ðevidence€of€substantial€assistance€so€as€to€raise€the€issue€of€facilitation€and€did€not€requestÐ b² Ðinstruction€on€facilitation.€€òòIdóó.€€Likewise,€the€record€in€Defendantððs€case€shows€similar€omissionsÐ H˜ Ðand€ð ðall€or€nothingðð€evidence.€€Two€scenarios€are€possible:€Defendant€packed€the€drugs€in€her€bagÐ . ~ Ðfor€sale€or€delivery,€or€she€was€completely€ignorant€of€the€fact€that€a€crime€was€being€committed.€Ð  d ÐAccordingly,€an€instruction€on€facilitation€of€a€felony€was€not€appropriate.Ð ú J ÐÌà  àIn€sum,€we€conclude€that€when€the€evidence€in€the€record€regarding€whether€DefendantÐ Æ   Ðcommitted€facilitation€of€the€felony€in€issue€is€viewed€liberally€in€the€light€most€favorable€to€theÐ ¬ ü  Ðexistence€of€the€lesser„included€offense,€it€reveals€nothing€that€would€cause€reasonable€minds€toÐ ’â
