Thedefendantwasheldforapproximatelyeighthoursbeforebeingallowedtomakebail.Duringthistimehewasnotallowedtomakeaphonecall. Thetrialcourtfoundnoshowingbythestateoftheneedtokeepthisdefendantforaneighthourperiodforpublicsafetypurposes.Althoughthetrialcourtrecognizedtheremedial,publicsafetyreasonsfordetention,thetrialcourtfoundthatdefendantsdetentionresultedfromthefailuretoallowhimtocallafamilymembertopickhimupandmakebond.Thetrialcourtruledthatthedetention,therefore,constitutedpunishment.Insummary,thetrialcourtfoundthatthedefendantsdetentionwas punishmentforthe sameoffenseforwhichhewasindicted;towit:drivingundertheinfluenceofanintoxicant.ThetrialcourtdismissedtheDUIindictmentfindingittoconstitutedoublejeopardy.@ ANALYSIS  Thedetentionpolicywasintended,atleastinpart,toprotectnotonlythearresteebutalsothepublicfromsomeonewhohadbeenrecentlyarrestedfordrivingundertheinfluenceofanintoxicant.Thisisaremedialpurpose,notapunitiveone,anddoesnottriggerdoublejeopardyprotection.Statev.Pennington,򀀀S.W.2d򀀀(Tenn.1997).Iftheconfinementisremedialandimposedpursuanttoalegitimategovernmentalpurpose,thentheconfinementisnotconsideredpunishmentfordoublejeopardypurposes.SeeDoev.Norris,751S.W.2d834(Tenn.1988);Statev.Conley,639S.W.2d435(Tenn.1982);Statev.Coolidge,915S.W.2d820(Tenn.Crim.App.1995).Wefurtherfindthatthedetentionwasnotexcessiveintheaccomplishmentoftheremedialpurpose.SeeCoolidge,915S.W.2dat824.Thefactthatthedefendantwasnotallowedtopostbondnormakeaphonecalltosecurearelativetopickhimupdoesnotconverthisdetentioninto punishment.
