JOHNH.PEAY,  P7-1 Judge  09/3w X    @:M ';XXOPINION#XX';#Ԉ `     Thepetitionerwaschargedintheindictmentwithfirstdegreemurder,felonymurder,especiallyaggravatedrobbery,andespeciallyaggravatedburglary.OnFebruary4,1991,hepledguiltytofirstdegreemurderandespeciallyaggravatedrobberyandreceivedlifeplusaconcurrenttwentyfiveyearsentenceasaRangeIstandardoffender.OnFebruary2,1994,thepetitionerfiledhispetitionforpostconvictionrelief.Thepetitionwasinitiallydismissedforfailuretoprosecute,butuponmotion,thepetitionwasreinstatedandanamendedpetitionwasfiled.  Intheamendedpetition,andlateratthehearing,thepetitionerarguedhisdefenseattorney,MarkFowler,wasineffectivebyallowinghimtowaivehisrighttoapreliminaryhearingandfailingtopursueamotiontosuppressaconfessionwhenthepetitionerinsistedhewascoerced,beaten,anddeprived of foodandwateruntilhesignedanincriminatingstatement.ThepetitioneralsoarguedMr.Fowlerfailedtotreatthispotentialdeathpenaltycaseseriously,asevidencedbythesmallamountoftime(6.9hours)hespentwithhimduringhisrepresentationandhisfailuretoimmediatelyrequestcocounsel.Thepetitionersuggestedthatduetootherpendingcasesandpersonalconcerns,Mr.Fowlerdidnothaveadequatetimetoeffectivelyhandlethisseriouscase.Thetrialcourtdiscreditedthepetitionersposition,foundthatMr.Fowlersrepresentationwasnotdeficient,and thus deniedthepetitionforrelief. XXXX  InreviewingthepetitionersSixthAmendmentclaimofineffective 2f), assistanceofcounsel,thisCourtmustdeterminewhethertheadvicegivenorservicesrenderedbyMr.Fowlerwerewithintherangeofcompetencedemandedofattorneysin ^6,0 criminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Thepetitioner must 6&-2 showthatcounselsrepresentationfellbelowanobjectivestandardofreasonablenessandthatthisperformanceprejudicedthedefense,thatis,theremustbeareasonableprobabilitythatbutforcounselserrortheresultoftheproceedingwouldhavebeendifferent.Stricklandv.Washington,466U.S.668,68788,692,694(1984);Bestv. d State,708S.W.2d421,422(Tenn.Crim.App.1985).Tosatisfytherequirementof 0 prejudice,hemustdemonstrateareasonableprobabilitythat,butforcounselserrors,hewouldnothavepledguiltyandwouldhaveinsistedongoingtotrial.SeeHillv.Lockhart, (  474U.S.52,59(1985);Bankstonv.State,815S.W.2d213,215(Tenn.Crim.App.   1991).#X_CXX X_C# `   Here,evenassumingthattheevidencepreponderatesagainstthetrialcourtsfindingthatMr.Fowlersrepresentationfellbelowtherangeofcompetencedemandedofattorneysincriminalcases,thepetitionerhasfailedtoshowprejudice.Mostofthepetitionersbriefisdedicatedtoemphasizinghowlittletimehisattorneyspentonhiscase.Inthemeantime,however,thepetitionerfailstoshow,forinstance,thatbutforhiscounselsperformance,hisinculpatorystatementtoauthoritieswouldhavebeensuppressed,orthathewouldhaveproceededtotrial,orthattheoutcomeoftheproceedingswouldhavebeendifferent.Infact,becausetherecordisdevoidofanyevidencesuggestingthattheStatewouldhavebeenunabletoproveaggravatingfactorswarrantingthedeathpenalty,itappearslikelytousthathadthepetitionerproceededtotrialhemight not havereceivedasfavorableasentenceashedidbypleadingguilty.Inshort,withoutanyshowingofprejudice,thepetitionersclaimsmustfail.Thetrialcourtsdenialofpostconvictionreliefisaffirmed.
