àThe€Defendant,€Paschal€Hyde,€Jr.,€appeals€as€of€right€pursuant€to€œRule›€3Ïof€the€Tennessee€Rules€of€Appellate€Procedure.€€He€was€convicted€by€aÏDavidson€County€jury€of€three€counts€of€aggravated€rape,€three€counts€of€assault,Ïand€two€counts€of€attempted€first„degree€murder.€€He€was€sentenced€toÏœconcurrent€terms€of€life›€for€each€conviction€for€aggravated€œrape.€€He€wasÏsentenced€to€eleven€months€and€twenty„nine€days€for€each€count€of€assault,€toÏbe€served€concurrently›€with€each€other€and€with€his€convictions€for€aggravatedÏrape.€€For€the€two€attempted€first„degree€murder€convictions,€the€Defendant€wasÏsentenced€to€twenty„five€years€on€each€count€to€be€served€consecutively€to€eachÏother€and€to€the€other€œconvictions.€€Thus,€his€effective€sentence€is€life€plus€fiftyÏyears.€€The€Defendant€appeals€both€his€convictions€and€sentences,€raising€theÏfollowing€issues:€(1)€That€the€evidence€was€insufficient€to€convict€him€ofÏaggravated€rape;€(2)€that€the€trial€court€erred€by€denying€the€Defendantððs€motionÏto€sever€the€offenses;€(3)€that€counts€one,€two€and€three€in€the€indictment€areÏinvalid€because€they€failed€to€specify€the€requisite€mens€rea€for€aggravated€rape;Ïand€(4)›€that€the€trial€court€erred€by€misapplying€sentence€enhancement€factorsÏand€œordering€consecutive›€œsentences.€€After€a€careful€review€of€the€record€in€thisÏcase,€we€affirm€in€part€and€reverse€and€remand€in€part€the›€judgment€of€the€trialÏcourt.ÌÌà àThe€Defendant€and€the€primary€victim€in€this€case,€Nicole€Bowman,€had€aÏlengthy€œand€disturbing€history›€together€prior€to€the€prosecution€of€the€DefendantÏon€these€numerous€charges.€€œThe€Defendant€was€her€stepfather.€€Teresa›Ð ¾8^/0 ÐBowman,€the€victimððs€mother,€lived€with€the€Defendant€when€Nicole€was€small.€ÏœTeresa›€Bowman€had€two€children€fathered€by€the€Defendant,€Antonio€Hyde€andÏFelicia€Bowman.€€Nicole€recalled€that€the€Defendant€lived€with€them€when€sheÏwas€very€little€and€called€her€names,€such€as€ð ðblackieðð€and€ð ðugly.ðð€€€TheÏDefendant€would€œgrab›€Nicole€by€her€right€arm€and€talk€ð ðdirtyðð€to€her.€€€At€ageÏthree,€four,€or€five€the€Defendant€began€to€vaginally€penetrate€Nicole€with€hisÏindex€and€middle€fingers.€€Sometimes€she€would€not€cooperate€and€refuse€toÏopen€her€legs€and€the€Defendant€would€yell€at€her,€choke€her,€smother€her,€andÏput€his€hand€over€her€mouth.€€Nicole€would€cry€and€tell€the€Defendant€that€theÏpenetration€with€his€fingers€hurt€her.€€The€Defendant€penetrated€her€in€thisÏfashion€approximately€three€or€four€times€per€week.€€€After€the€act€wasÏcompleted,€the€Defendant€would€hug€Nicole€and€would€ask€if€she€wantedÏanything.€€These€acts€would€occur€at€night€because€her€mother€worked€at€night.€ÏThe€Defendant€would€accost€the€victim€in€her€bedroom€and€the€bathroom.€€TheÏDefendant€would€kiss€her,€would€try€to€put€his€penis€in€her€mouth,€and€would€lieÏon€top€of€her.€€The€Defendant€wore€underwear€and€would€remove€NicoleððsÏunderwear€and€rub€his€penis€against€her€until€he€reached€a€climax.€€He€wouldÏpenetrate€her€with€his€fingers.€€Felicia€Bowman€would€sleep€in€the€same€roomÏwith€Nicole€and€would€often€wake€up€in€the€night€and€see€the€Defendant€in€theÏroom.€€Teresa€Bowman€œoften€took›€Felicia€out€with€her€and€left€Nicole€with€theÏDefendant.ÌÌà ` àThe€Defendant€lived€with€Nicole€until€she€was€thirteen.€€After€he€left,€heÏwould€continue€to€send€for€her€or€come€to€œher›€house€when€her€mother€wasÏworking.€€Nicole€recalled€that€this€would€happen€particularly€on€special€occasionsÏlike€the€Defendantððs€birthday€or€Fatherððs€Day€because€he€would€remind€her€ð ðIÐ Ð9p02 Ðknow€you€gonna€give€me€some.ðð€€The€victim€never€told€anyone€because€theÏDefendant€threatened€œto€kill›€her€or€her€mother.€€Nicole€once€attempted€to€tell€herÏmother€when€Teresa€Bowman€was€going€to€the€laundromat€with€Nicoleððs€sister,ÏFelicia.€€Nicole€cried€and€begged€to€go,€but€her€mother€left€her€at€the€house€withÏthe€Defendant.€The€Defendant€then€sexually€penetrated€the€victim€and€made€itÏhurt€œas€punishment€because›€she€had€not€cooperated.ÌÌà ` àWhen€Nicole€was€eighteenœ×ƒ×Ý ƒ #ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×›,€she€was€dating€a€boy€and€her€mother€had€toldÐ ð  Ðthe€Defendant.€€The€Defendant€insisted€that€Nicole€tell€him€what€she€did€with€herÏboyfriend€and€she€admitted€that€she€had€been€having€sexual€relations€with€him.€ÏThe€Defendant€œslapped›€her€in€the€face€and€pushed€her€head€to€the€window€whileÏthey€were€traveling€in€his€car.€€He€said€she€was€a€slut.€€He€stated:€ð ðYou€supposedÏto€be€a€Christian.€€You€ainððt€nothing€but€a€whore.€€You€just€like€your€mama.€€YððallÏainððt€amount€to€nothing€„„€yððall€not€gonna€amount€to€nothing,€never€will€beÏnothing.ðð€€€He€took€her€to€œhis€friend€Fanny›€Leeððs€house€œand›€took€her€into€theÏbathroom€and€pushed€her€in€the€tub.€€The€Defendant€spit€in€her€face€and€calledÏher€names.€€The€Defendant€later€had€sexual€intercourse€with€the€victim.€€SheÏresisted€and€the€Defendant€smothered€and€choked€her€and€forced€her€legs€apartÏand€penetrated€her€with€his€penis.€€Such€encounters€continued€with€frequencyÏuntil€Nicole€was€twenty„one€years€old.ÌÌà ` àNicole€graduated€from€high€school€in€June€of€1992€and€worked€at€Kroger,Ïand€then€Lockheed€Support€Systems€in€Nashville.€€€When€Nicole€received€herÏpaycheck,€she€would€have€to€surrender€the€money€to€the€Defendant€immediatelyÐ ð5,. Ðbecause€œhe›€told€her€she€owed€it€to€him€because€he€had€taken€care€of€her€all€herÏlife.€€The€Defendant€would€then€distribute€half€of€the€money€to€Nicole.€€TheÏDefendant€had€also€cosigned€an€auto€loan€for€Nicole.€€Nicole€made€all€theÏpayments€for€the€car€and€the€Defendant€used€the€money€she€gave€him€everyÏweek€to€pay€the€note€on€his€red€pickup€truck.€€During€this€time,€the€DefendantÏlived€with€œthe›€woman€named€Fanny€Lee.€€Ms.€Lee€owned€the€home€and€paid€theÏbills,€so€the€Defendant€lived€there€for€free.€€The€Defendant€made€Nicole€keep€herÏcar€at€Ms.€Leeððs€house€and€she€could€only€use€it€to€drive€to€work,€to€church,€andÏoccasionally€to€the€park€on€Sunday€afternoons.€€The€Defendant€told€Nicole€thatÏher€parents€should€know€where€she€was€at€all€times€and€she€carried€a€pager.€ÏThe€Defendant€knew€her€work€schedule€and€the€amount€of€time€it€would€take€toÏget€there€and€back€home.€€Nicole€had€no€social€life€and€did€not€have€closeÏfriends.ÌÌà ` àNicole€started€dating€Claude€Rucker€shortly€before€the€œacts€which€resultedÏin€the€attempted›€œmurder€convictions.›€€She€would€sneak€to€see€him€between€9:30Ïwhen€she€got€off€work€and€10:30€when€her€sister€got€off€work€at€LockheedÏbecause€she€drove€her€sister€to€work€and€had€to€wait€until€her€shift€ended.€€TheÏDefendant€was€unaware€of€her€relationship€with€Mr.€Rucker.€€On€November€6,Ï1994,€Nicole€attended€church€with€her€family,€including€the€Defendant€who€œat€thatÏtime€was›€an€assistant€minister.€€She€noticed€that€he€was€acting€strange€and€wasÏnot€reading€the€Bible,€but€sitting€there€like€he€had€something€on€his€mind.€€AsÏNicole€and€her€family€were€leaving€the€church,€a€man€named€Lawon€had€his€armÏaround€her€shoulder€and€they€were€œdiscussing€his›€getting€a€job€at€Lockheed.€€TheÏDefendant€essentially€broke€œthe€conversation›€up€and€told€Nicole€and€her€sisterÏFelicia€to€go€home.€€At€home,€the€Defendant€confronted€Nicole,€claiming€that€sheÐ Ð9p02 Ðhad€an€œð ðattitude€problem.ð𛀀She€told€the€Defendant€that€he€had€the€problem,€notÏher,€and€she€walked€off.€€She€stated€that€she€just€could€not€take€it€anymore.ÌÌà ` àLater€that€evening,€œin€the€Defendantððs€presence,€Nicole›€and€Felicia€wereÏarguing€about€late€fees€for€a€rented€video€œtape.€€He€started€criticizing€Felicia,Ïstating›€that€she€was€selfish€and€would€not€amount€to€anything.€€Felicia€blurted€outÏsomething€about€Nicole€using€up€gas€in€the€car.€€The€Defendant€jerked€Nicole€upÏby€the€collar€and€threw€her€on€a€chair.€€Felicia€ran€out€and€the€Defendant€toldÏtheir€brother€Tony€to€unplug€the€telephone.€€He€told€Nicole€to€park€her€car€in€hisÏyard€and€complained€œagain€of›€her€attitude€problem.€€He€threatened€to€tear€up€theÏcar.€€Meanwhile,€Felicia€had€called€the€police.€€Nicole€œinitially€sought›€a€warrant,Ïbut€did€not€get€one€at€that€time.€€She€then€decided€to€stay€at€Claude€RuckerððsÏhouse.€€The€next€day,€the€Defendant€drove€her€to€work€because€he€would€not€letÏher€use€her€car.€€Nicole€told€Erica€Frierson,€her€friend€at€Lockheed,€that€she€wasÏgoing€to€ride€home€with€her€an€hour€early€and€get€her€clothes.€€Her€mother€sawÏthat€she€was€home€early€and€asked€whether€the€Defendant€knew€this.€€Nicole€toldÏher€mother€she€was€staying€the€night€with€Ms.€Frierson,€but€she€went€to€ClaudeÏRuckerððs€house.€€Ms.€Frierson€drove€Nicole€to€work€on€Tuesday,€November€8,Ï1994.ÌÌà ` àThat€morning,€Mr.€Rucker€went€over€to€his€motherððs€house€to€check€on€herÏand€the€Defendant€was€there.€€Mr.€Rucker€had€noticed€the€Defendant€hangingÏaround€at€his€motherððs€house€a€lot€during€the€prior€week€and€felt€that€he€wasÏœlooking›€for€some€information.€€Mr.€Rucker€volunteered€to€talk€with€the€DefendantÏand€told€him€that€he€was€dating€Nicole.€€The€Defendant€initially€indicated€that€heÏhad€œno›€problem€with€them€dating,€but€then€launched€into€concerns€about€NicoleððsÐ Ð9p02 Ðlying€to€him€and€his€attitude€reflected€rage.€€The€Defendant€refused€to€shakeÏhands€with€Mr.€Rucker€when€he€left.ÌÌà ` àRucker€thought€that€the€Defendant€went€to€Lockheed€when€he€startedÏreceiving€pages€with€the€number€911.€€Meanwhile,€Nicoleððs€manager€atÏLockheed,€William€Brady,€informed€her€that€the€Defendant€was€there€and€wantedÏto€speak€with€her.€€œAlthough€she›€was€reluctant,€œshe›€clocked€out€and€went€outside.€ÏErica€Frierson€told€Brady€that€it€was€not€a€good€situation.€€Brady€went€outside€andÏobserved€the€Defendant€telling€Nicole€that€she€needed€to€apologize€to€herÏmother.€€The€conversation€escalated€and€the€Defendant€tried€to€force€Nicole€intoÏa€blue€Blazer.€€As€Brady€turned€to€go€inside€and€tell€his€employees€to€call€theÏpolice,€Erica€Frierson€came€out€and€walked€up€behind€the€Defendant.€€She€toldÏNicole€that€she€did€not€have€to€go€with€the€Defendant.€€He€turned€around€andÏthrew€her€to€the€pavement.€€Nicole€scrambled€across€the€car€seat€and€got€outÏthrough€the€driverððs€side€door.€€Both€Nicole€and€Frierson€headed€toward€theÏLockheed€building.€€Brady€told€them€to€get€inside€and€told€the€Defendant€that€heÏwas€on€private€property€and€that€he€had€to€leave.€€The€Defendant€sat€there€forÏawhile€and€then€left.ÌÌà ` àClaude€Rucker€and€his€sister€went€to€Lockheed€and€œmet€the›€œDefendantððsÏvehicle›€on€the€road.€€The€Defendant€turned€around€and€came€œback,›€œbut›€when€heÏsaw€that€the€police€were€there,€he€did€not€stop.€€Ruckerððs€sister€got€nervous€andÏtold€him€she€wanted€to€leave€and€he€agreed€to€take€her€home.€€As€they€wereÏtraveling€on€Polk€Avenue€to€Fesslers€Lane,€the€Defendant€followed€them€andÏdrove€beside€Ruckerððs€car.€€He€said:€ð ðYou€need€to€go€get€Nicole€and€bring€her€toÏme€where€I€can€talk€to€her€and€you€need€to€get€her€now.€€Itððs€done€got€seriousÐ Ð9p02 Ðand€itððs€going€to€get€seriouser€(sic)€than€that.ðð€€Rucker€told€the€Defendant€that€heÏhad€earlier€offered€to€come€with€Nicole€to€talk€to€her€mother€and€that€he€wouldÏsee€what€he€could€do.€€They€proceeded€in€traffic€to€a€traffic€light€at€MurfreesboroÏRoad€and€the€Defendant€was€approximately€three€cars€in€front.€€The€DefendantÏgot€out€of€his€car€and€told€Rucker€that€he€had€to€bring€Nicole€to€him€that€day.€€TheÏDefendant€left€and€Rucker€returned€to€Lockheed.€€Rucker€went€with€Nicole€andÏErica€Frierson€to€the€police€department€to€obtain€warrants€for€assault.€€ÌÌà ` àRucker€and€Nicole€stayed€out€that€evening€until€approximately€11:00€orÏ11:15.€€When€they€returned€to€Ruckerððs€house,€they€noticed€Nicoleððs€car,€a€BuickÏLeSabre,€parked€on€the€street€with€the€Defendant€ducked€down€in€the€seat.€€TheyÏkept€driving€and€called€the€police€from€a€gas€station€for€an€escort€home.€€TheÏDefendant€was€gone€when€they€returned.€€ÌÌà ` àThe€next€day,€November€9th,€Rucker€and€Nicole€went€out€in€the€morningÏto€take€Ruckerððs€sister€to€work.€€When€they€returned,€the€Defendant€was€at€theÏhouse.€€He€asked€to€speak€with€Nicole€and€approached€their€car€and€said€that€heÏdid€not€have€a€weapon.€€They€all€stood€on€the€sidewalk€and€the€Defendant€askedÏwhy€Nicole€was€lying€and€œdisrespectful€of›€her€mother.€€He€told€her€to€go€homeÏwith€him€and€the€conversation€œthen€continued.›€€Rucker€reached€in€the€car€and€gotÏNicoleððs€purse,€which€contained€cards€from€the€police€department,€as€well€as€hisÏcar€keys.€€He€œtold›€the€Defendant€that€they€would€go€with€him,€but€that€he€neededÏto€go€into€the€house€for€a€minute.€€Nicole€and€Rucker€went€into€the€house€andÏRucker€called€the€police.€€While€they€were€€waiting,€Rucker€went€outside€and€toldÏhim€that€he€had€called€the€police€and€they€would€all€go€together€to€straightenÏthings€out.€€Rucker€went€inside€and€locked€the€door€because€they€did€not€trust€theÐ Ð9p02 ÐDefendant.€€Soon€afterwards,€the€Defendant€knocked€on€the€door€and€they€letÏhim€in.€€The€Defendant€grabbed€Nicole€by€the€right€arm€and€told€her€to€ð ðClaude,€you€can€bring€her€home€when€you€get€ready.€ÏYouððve€got€to€come€out.€Youððve€got€to€go€to€the€store€or€somewhere.€.€.€.€justÏremember€that€Iððm€gonna€shoot€you€down€like€a€dog.ðð€€Claude€followed€theÏDefendant€onto€the€porch€and€the€Defendant€said:€ð ðClaude,€you€get€in€the€way,ÏIððm€going€to€shoot€you€down€like€a€dog,€too.ðð€€When€the€Defendant€reached€hisÏcar,€he€said€ð ðClaude,€donððt€you€cross€me.ðð€€Rucker€and€Nicole€obtained€warrantsÏfor€threatening€their€lives.ÌÌà ` àThe€next€morning,€November€10,€1994,€Rucker€and€Nicole€decided€to€goÏout€for€breakfast.€€Mr.€Rucker€had€parked€his€car€around€the€corner€in€hopes€thatÏthe€Defendant€would€not€know€its€location.€€The€two€walked€to€the€car€and€sat€inÏit€while€the€engine€warmed€up.€€Nicole€said,€ð ðHere€comes€Junior,€ð ð€œreferring€to€the›ÏDefendant.€€The€Defendant€pulled€up€quickly€in€his€red€Ford€king€cab€pickupÏtruck.€€The€Defendant€opened€the€truck€door€and€approached€œwielding€a›€shotgun.€ÏRucker€put€his€car€in€reverse,€it€hesitated€a€minute,€and€the€Defendant€startedÏshooting.€€The€car€œswerved›€and€hit€a€telephone€pole.€€Rucker€could€not€see€wellÏbecause€he€had€blood€on€his€face.€€He€opened€his€car€door€and€saw€theÏDefendant€ejecting€the€spent€shell€casings€as€if€he€were€going€to€reload.€€RuckerÏtook€off€running€and€the€Defendant€said€ð ðUh„huh,€I€told€you€I€was€going€to€killÐ Ð9p02 Ðyou.ðð€€Rucker€ran€to€a€œwoman›€standing€in€her€doorway€with€a€cellular€phone€andÏasked€her€to€call€the€police.ÌÌà ` àFanny€Lee€was€taking€a€shower€between€8:00€and€8:30€a.m.€when€sheÏheard€someone€come€into€the€house€and€stand€by€the€bathroom€door€for€a€fewÏminutes,€then€leave.€€She€thought€it€was€the€Defendant.€€Approximately€twentyÏminutes€later,€the€police€came€to€her€door.€€She€saw€that€the€Defendantððs€blueÏBlazer€was€not€parked€there.€€She€stated€that€the€Defendant€owned€two€guns€andÏkept€them€at€her€house.€€On€the€morning€of€November€10th,€the€shotgun€wasÏmissing.€€She€admitted€that€her€nephew€would€sometimes€borrow€a€rifle,€but€sheÏwas€not€certain€as€to€the€difference€between€a€shotgun€and€rifle.ÌÌà ` àThe€shotgun€blasts€shattered€the€front€windshield€of€the€car.€€ClaudeÏRucker€suffered€injuries,€including€shotgun€pellets€and€glass€in€his€head,€face,€leftÏarm€and€shoulder.€€His€ear€was€split€and€had€to€be€stitched€back€together.€€NicoleÏBowman€received€massive€injuries€to€her€face.€€She€was€hospitalized€fromÏNovember€to€January.€€œShe€lost›€vision€in€her€right€eye,€there€was€damage€to€theÏroof€of€her€mouth€and€her€teeth,€and€she€had€to€be€fed€through€a€tube.€€She€mustÏundergo€reconstructive€surgery€of€her€nose€and€face.€€When€she€was€releasedÏfrom€the€hospital,€she€was€still€being€fed€through€a€tube,€had€a€suction€machineÏand€was€fed€oxygen€through€her€trachea.€€She€stayed€œa€short€while€with›€herÏmother,€but€was€rehospitalized€briefly.€€When€she€was€released,€she€went€to€liveÏwith€Fanny€Lee.ÌÌà ` àAt€trial,€Nicole€read€letters€that€she€had€written€to€her€mother€in€1991€andÏin€1989€or€1990,€alluding€that€her€relationship€with€the€Defendant€was€negativeÐ Ð9p02 Ðand€that€he€had€ð ðdoneðð€things€to€her€and€that€he€had€an€ð ðevil€eyeðð€even€if€he€wasÏa€church€deacon.€€The€letters€revealed€thoughts€of€suicide€and€Nicole€pleadingÏwith€her€mother€to€listen€and€understand€her.€€She€alluded€to€something€ð ðeatingÏme€up€on€the€inside€badly.ððÌÌà ` à€At€trial,€Nicoleððs€mother,€Teresa€Bowman,€testified€on€behalf€of€theÏDefendant.€€She€admitted€that€when€she€lived€with€the€Defendant,€he€made€herÏgive€him€the€money€she€earned€at€her€job.€€She€never€saw€the€DefendantÏsexually€abusing€her€daughter.€€She€got€a€letter€from€Nicole€in€1991,€but€did€notÏthink€she€was€being€raped.€€œWhen€Nicole›€started€staying€overnight€with€ClaudeÏRucker,€Teresa€Bowman€asked€the€Defendant€to€bring€her€home€on€œTuesday,›ÏNovember€8th.€On€cross„examination,€Teresa€Bowman€admitted€that€sheÏunderstood€that€the€letters€written€by€her€daughter€meant€that€she€was€beingÏsexually€abused€by€the€Defendant.ÌÌà ` àThe€Defendant€presented€a€somewhat€different€account€of€the€events€inÏquestion.€€The€Defendant€testified€that€he€carried€a€twenty„gauge€shotgun€for€hisÏprotection.€€He€stated€that€he€went€to€œLockheed›€on€November€8th€at€TeresaÏBowmanððs€behest€to€ask€Nicole€to€come€home.€€œHe€testified›€that€Erica€FriersonÏgrabbed€him€first€and€that€he€just€pushed€and€she€fell.€€He€testified€that€he€wentÏto€Claude€Ruckerððs€motherððs€house€later€that€day€to€pick€up€a€payment€for€hittingÏa€ð ðnumberðð€because€Ruckerððs€mother€paid€out€winnings.€€On€November€9th,€theÏDefendant€went€to€check€on€Nicole€at€Ruckerððs€house.€€He€stated€that€RuckerÏwarned€him€not€to€start€anything.€€The€Defendant€felt€like€Rucker€was€threateningÏhim.€€He€testified€that€Rucker€sold€drugs€on€Green€Street.€€Rucker€told€theÏDefendant€that€he€was€dating€Nicole.€€The€Defendant€stated€that€he€kept€NicoleððsÐ Ð9p02 Ðcar€at€his€house€because€it€had€been€broken€into€at€her€house.€€He€would€cleanÏthe€car€and€had€the€brakes€œrepaired,›€and€once€found€a€bag€of€marijuana€in€theÏcar.€€He€confronted€Nicole,€who€denied€using€marijuana.€€He€also€wanted€her€toÏpay€a€cellular€telephone€bill€that€she€had€ð ðrun€up.ððÌÌà ` àThe€Defendant€testified€that€on€November€10th,€he€went€to€the€cleaners,Ïgave€someone€a€ride,€then€went€to€Ruckerððs€house.€€He€saw€Rucker€sitting€in€aÏcar,€but€not€Nicole.€€He€started€to€get€out€of€the€truck€and€thought€Rucker€wasÏreaching€under€the€seat€for€a€weapon.€€He€got€his€shotgun€out€and€shot€at€theÏcar.€€The€Defendant€went€home,€left€his€truck€there€and€drove€away€in€his€Blazer.€ÏHe€turned€himself€in€three€days€later.€ÌÌà ` àOn€cross€„examination,€the€Defendant€denied€that€he€exerted€control€overÏNicole€Bowman€and€that€she€had€to€report€to€him€whenever€she€went€anywhere.€ÏThe€Defendant€testified€that€Nicole€voluntarily€had€him€hold€her€money€for€herÏbecause€she€spent€a€lot.€€He€denied€making€Fanny€Lee€or€any€of€the€childrenÏgive€him€money.€€He€admitted€that€he€lived€without€paying€expenses€at€FannyÏLeeððs€house€and€that€he€used€the€money€he€got€to€play€the€numbers€and€to€buyÏclothes€for€the€children.€€He€stated€that€he€used€his€own€money€to€gamble.€€TheÏDefendant€denied€calling€Nicole€ð ðdarkie.ðð€€He€denied€that€he€lived€with€TeresaÏBowman€œduring€1979›€through€1981.€€He€denied€hitting€Nicole,€but€admitted€thatÏhe€may€have€ð ðwhoopedðð€her€once€or€twice.€€œHe€denied€any€sexual€contact€withÏNicole.€€He›€testified€that€Nicole€made€up€all€of€the€allegations,€but€admitted€thatÏhe€assaulted€her.€€He€denied€that€he€tried€to€throw€Nicole€in€his€car€at€LockheedÏand€œsaid€that›€the€witnesses€were€lying.€€The€Defendant€stated€that€he€wasÏconcerned€for€Nicole€and€that€shooting€her€was€an€accident.€€He€testified€that€heÐ Ð9p02 Ðshot€only€once,€even€though€there€were€two€holes€in€the€carððs€windshield.€€TheÏDefendant€stated€that€he€left€the€shotgun€in€his€truck,€but€the€gun€was€neverÏrecovered.ÌÌà ` àDuring€the€January€term€of€1995,€a€Davidson€County€grand€jury€issued€aÏfive„count€indictment€against€the€Defendant€for€assault€against€Erica€Frierson,€Ïtwo€assaults€against€Nicole€Bowman,€and€œthe€attempted›€first€degree€murder€œofÏNicole›€Bowman€and€Claude€Rucker.€€€A€superseding€indictment€was€issued€fromÏthe€April,€1995,€term,€adding€counts€one€through€eight€of€aggravated€rapeÏincluding€the€aforementioned€offenses€in€counts€nine€through€thirteen.€ÏSubsequently,€the€trial€court€dismissed€counts€four€through€eight€for€œaggravated›Ïrape€because€the€indictments€were€issued€beyond€the€applicable€statute€ofÏlimitations€for€those€offenses.€€Count€one€for€aggravated€rape€between€JulyÏthrough€December,€1979,€count€two€for€aggravated€rape€between€January€1€andÏDecember€31,€1980,€and€count€three€for€aggravated€rape€between€January€1€andÏDecember€31,€1981,€were€tried€along€with€counts€nine€through€thirteen€regardingÏthe€events€that€occurred€in€November,€1994.€€€The€Defendant€was€convicted€ofÏthree€counts€of€aggravated€rape,€three€counts€of€assault,€and€two€counts€ofÏattempt€to€commit€first„degree€murder.€€He€now€appeals€both€his€convictions€andÏsentences.ÌÌÓ  ÓI.ÌÓÃcÓà ` àÌà ` àAs€his€first€issue,€the€Defendant€argues€that€the€evidence€was€insufficientÏâ âto€support€the€guilty€verdicts€for€aggravated€rape.€€However,€during€ourÐ à7€.0 Ðexamination€of€the€record€in€this€case,€it€ñgñœñgñappeared€thatñgñ›ñgñ€plain€error€ñgñœñgñprecludeñgñ›œñgñdñgñ›ñgñ€usÏfrom€such€a€review€of€the€evidence.Ìâ âÌà ` àñeññgñ›œñgññeñDuring€our€initial€review€of€the€record,€it€became€apparent€that€some€of€theÏproceedings€in€the€trial€court€had€not€been€transcribed€and€made€a€part€of€theÏrecord€on€appeal.€€We€therefore€gave€the€parties€the€opportunity€to€supplementÏthe€record€if€necessary€and€to€file€supplemental€briefs€on€the€issue€of€the€failureÏof€the€State€to€elect€the€offenses€upon€which€it€relied€for€conviction.€€In€itsÏsupplemental€brief,€the€State€concedes€that€the€failure€to€elect€constitutes€error,Ïbut€argues€that€in€this€case€the€error€is€harmless.€€We€do€not€believe€that€theÏerror€is€harmless€beyond€a€reasonable€doubt.ñeññgñ›ñgñÌÔ‡Šc0ŠŠŠc0ÔÌà ÐS.W.2d€578,€580„81€(Tenn.€Crim.€App.€1985).€€TheÏthird€òòBurlisonóó€rationale€addresses€the€most€seriousÐ H+è!# Ðconcern:€€the€well„established€right€under€our€stateÏconstitution€to€a€unanimous€jury€verdict€before€aÏcriminal€conviction€is€imposed.€€Ð ¸ ¤¸ ¤ ÐÌòòState€v.€Sheltonóó,€851€S.W.2d€134,€137€(Tenn.€1993).€€Ð  0À&( ÐÌÌÓÓà ` àThe€Defendant€was€charged€with€aggravated€rape;€testimony€concerningÏsuch€behavior€during€the€time€period€specified€in€the€indictment€is€relevant€andÏadmissible.€€òòState€v.€Rickmanóó,€876€S.W.2d€824,€828„829€(Tenn.€1994).€€AlthoughÐ è6ˆ-/ Ðthis€evidence€was€admissible,€the€trial€court€erred€in€allowing€the€state€to€presentÐ Ø8x/1 Ðthis€evidence€without€requiring€an€election€as€mandated€by€òòBurlisonóó.€€òòRickmanóóÐ `  Ð876€S.W.2d€at€829.€€Our€supreme€court€has€reaffirmed€that€the€trial€court€ð ðtakeÏprecautions€to€ensure€that€the€jury€deliberates€over€the€particular€chargedÏoffense,€instead€of€assembling€a€ððpatchwork€verdictðð€based€on€the€differentÏoffenses€in€evidence.ðð€€òòTidwell€v.€Stateóó,€922€S.W.2d€497,€501€(Tenn.€1996).€€AÐ  À Ðprimary€concern€in€assuring€a€unanimous€jury€verdict€is€when€multiple€incidentsÏhave€occurred,€and€a€general€time€frame€has€been€drafted€in€the€indictment.€€òòId.óó€Ð    Ðð ð[I]t€is€quite€evident€that€there€is€no€apparent€means€to€differentiate€amongÏvarious€counts€of€the€same€offense.€€Additionally,€the€indictments€provide€noÏmeans€to€enable€a€fact„finder€to€match€a€specific€conduct€to€a€specific€count.ðð€òòId.Ô#†Šc0ŠŠŠc0l#ÔÔ‡ ŠòV ŠŠŠc0ÔóóÐ Ðp ÐÓ§uÓÓÓÔ#†Šc0Š Š ŠòVÏz#ÔÌà ` àIn€the€case€òòsub€judiceóó,€the€victim€testified€that€she€was€raped€by€digitalÐ °P Ðpenetration€on€multiple€occasions€over€a€period€of€years.€€She€stated€that€theÏrapes€occurred€wherever€she€was€living€and€that€they€occurred€in€her€bedroomÏor€in€the€bathroom.€€Finally,€the€victim€testified€that€these€acts€occurred€ð ðeveryÏdayðð€or€ð ðthree€or€four€times€a€weekðð€in€1979,€1980€and€1981.€€€She€did€notÏdescribe€any€particular€event€with€specificity.€€We€ñgñœñgñbelieve€that€we€must€considerñgñ›ñgñÏthis€an€example€of€the€ð ðgrab€bagðð€that€our€supreme€court€warned€against€inÏòòTidwellóó:Ð @,à"$ Ðà ` àÌÓ{ÓÒ4ÒÒ°„Òà Œ àThis€approach,€in€our€view,€is€akin€to€a€"grab-bag"€theory€of€justice.€ÏTo€illustrate€the€operation€of€this€theory,€in€any€given€case€the€State€couldÏpresent€proof€on€as€many€offenses€within€the€alleged€period€as€it€chose.€ÏBecause€all€such€offenses€will€have€been€"proven,"€the€jury€may,€in€effect,Ïreach€into€the€brimming€bag€of€offenses€and€pull€out€one€for€each€count.€ÏEven€when€done€by€this€method,€the€argument€goes,€each€offense€willÏhave€been€proven€beyond€a€reasonable€doubt.€€We€acknowledge€that€theÏillustration€is€an€extreme€one,€but€we€think€it€makes€the€point:€€such€anÏapproach€is€contrary€to€our€law.€€ÌÒ4~ÒÒ„°~ÒÓÓŠÓÐ Ø8x/1 ÐòòTidwellóó,€922€S.W.2d€at€501.€€Here,€the€victim€testified€that€finger€penetrationÐ `  Ðoccurred€basically€all€of€the€time.€€Without€an€election,€the€jury€could€reason€that€Ïbecause€the€acts€occurred€all€of€the€time,€€at€least€one€aggravated€rape€occurredÏin€each€year€in€question.€€ñgñœñgñUnder€our€law,€thisñgñ›ñgñ€constitutes€reversible€error.€€ÌÌà ` àWe€ñgñœñgñrecognize,€as€the€jury€surely€did,ñgñ›ñgñ€that€the€Defendantððs€actions€areÏdeplorable€examples€of€domination€and€abuse.€€We€ñgñœñgñfindñgñ›ñgñ€the€result€we€mustÏenforce€most€distasteful.€€The€Defendant€is€clearly€ñgñœñgña€personñgñ›ñgñ€who€engenders€littleÏor€no€sympathy.€€However,€we€note€that€the€State€could€have€ñgñœñgñperhaps€assistedñgñ›ñgñÏñgñœñgñMs.ñgñ›ñgñ€Bowman,€who€was€an€adult€at€the€time€of€trial,€to€isolate€specific€incidents€ofÏabuse€in€the€years€in€question€upon€which€to€anchor€the€convictions.€€With€theÏproof€as€it€currently€exists€in€the€record,€we€are€compelled€to€grant€the€DefendantÏa€new€trial€on€the€charges€for€aggravated€ñgñœñgñrape.ñfñ€€We€simply€cannot€conclude€thatÏthe€error€is€harmless€beyond€a€reasonable€doubt.ñfñÌÌà ` àAs€our€supreme€court€recently€again€emphasized:ÌÓÀ€ÓÌà8 ` àWe€appreciate€the€difficulties€involved€in€prosecuting€cases€ofÏsexual€abuse€against€small€children.€€In€such€cases,€the€rules€ofÏevidence€and€the€rules€of€procedure€have€been€relaxed€to€someÏextent€to€accommodate€very€young€witnesses.€€Nevertheless,€theÏconstitutional€protections€guaranteed€a€criminal€defendant,€who€isÏpresumed€by€the€law€to€be€innocent€until€proven€guilty,€cannot€beÏsuspended€altogether€because€of€the€victimððs€age€or€relative€inabilityÏto€testify.€€In€cases€such€as€this€one,€the€state€must€either€limit€theÏtestimony€of€prosecuting€witnesses€to€a€single€event,€or€prepare€theÏcase€so€that€an€election€can€be€made€before€the€matter€is€submittedÏto€the€jury€to€decide.Ð ` ü!` ü! àAs€his€next€issue,€the€Defendant€contends€that€the€trial€court€erred€byÏfailing€to€grant€his€motion€to€sever€offenses.€€€The€Defendant€was€indicted€onÏeight€counts€of€aggravated€rape€which€occurred€between€1979€and€1985,€threeÏcounts€of€assault€and€two€counts€of€attempted€first„degree€murder,€all€of€whichÏoccurred€in€1994.€€The€offenses€were€consolidated€for€trial.€€The€Defendant€filedÏa€motion€to€sever€counts€1€through€ñgñœñgñ8ñgñ›ñgñ€and€counts€9€through€13€because€they€wereÏremote€in€time€and€unrelated€in€nature.€€The€Defendant€also€filed€a€motion€toÏdismiss€counts€4€through€8,€which€was€granted.€€On€the€day€of€the€trial,€the€trialÏjudge€stated€that€he€would€allow€the€State€to€present€evidence€to€connect€theÏoffenses,€but€if€they€did€not,€he€would€grant€a€severance€and€a€mistrial.€€TheÏremaining€three€counts€of€aggravated€rape€were€tried€together€with€the€countsÏoriginating€from€the€1994€incidents.€ÌÌà ` àUnder€Rule€8(b)€of€the€Tennessee€Rules€of€Criminal€Procedure,€separateÏand€distinct€offenses€may€be€joined€in€one€indictment€if€(1)€the€offenses€are€of€theÏsame€or€similar€character€or€(2)€the€offenses€constitute€parts€of€a€commonÏscheme€or€plan.€€Under€Rule€14(b)(1)€,€a€defendant€has€a€right€to€a€severance€ofÏoffenses€joined€by€Rule€8(b)€unless€(1)€the€offenses€are€part€of€a€commonÏscheme€or€plan€and€(2)€the€evidence€of€one€would€be€admissible€upon€the€trialÏof€the€others.€€Tenn.€R.€Crim.€P.€14(b)(1).ÌÌà àñgñœñgñWeñgñ›ñgñ€must€first€determine€whether€the€offenses€that€were€tried€togetherÏconstitute€€a€common€scheme€or€plan.€€A€common€scheme€or€plan€for€severanceÏpurposes€is€the€same€as€a€common€scheme€or€plan€for€evidentiary€purposes.€Ð Ðsimilarity€between€the€crimes,€but€the€common€goal€or€purpose€at€which€they€areÏñgñœñgñdirected.ððñgñ›ñgñ€ñgñœñgñ€òòIdóó.€€(citationñgñ›ñgñ€ñgñœñgñomitted).€ñgñ›ñgñ€In€such€circumstances,€the€proof€sought€is€of€aÐ ð  Ðworking€plan,€operating€towards€the€future€with€such€force€as€to€make€probableÏthe€crime€for€which€the€defendant€is€on€trial.ðð€òòId.óó€€Ð Ðp ÐÌà ` àIn€the€case€at€bar,€the€ñgñœñgñproof€demonstrated€that€the€Defendantñgñ›ñgñ€dominatedÏthe€victimððs€family€from€the€time€he€became€involved€with€them.€€He€began€to€useÏNicole€Bowman€as€his€sexual€ð ðpropertyðð€and€molested€her€from€as€early€as€theÏage€of€three€until€ñgñœñgñthe€time€of€theñgñ›ñgñ€offenses€that€occurred€in€1994.€€Nicole€would€beÏforced€to€stay€at€home€alone€with€the€Defendant€when€her€sister€was€allowed€toÏleave€with€her€mother.€€He€exerted€control€over€the€victim€even€after€he€movedÏout€of€her€home€when€she€was€thirteen.€€The€Defendant€demanded€that€sheÏcome€to€his€house€so€he€could€continue€to€molest€her.€€He€demanded€moneyÏfrom€Teresa€Bowman,€and€was€the€disciplinarian€to€her€children,€whether€or€notÏhe€was€the€biological€father.€€When€Nicole€Bowman€began€to€work,€theÏDefendant€demanded€money€from€her.€€He€required€her€to€be€accessible€at€allÏtimes.€€Nicole€had€no€social€life€and€did€not€date.€€When€she€was€eighteen,€theÏDefendant€found€out€that€she€was€dating€a€boy€and€that€she€ñgñœñgññgñœñgñhad€hadñgñ›ñgññgñ›ñgñ€sexualÏrelations€with€him.€€The€Defendant€became€enraged,€assaulted€the€victim,€andÏthen€forced€vaginal€intercourse€with€her.Ð Ð9p02 Їà ` àThe€victim€graduated€ñgñœñgñfrom€highñgñ›ñgñ€school€ñgñœñgñand€thenñgñ›ñgñ€worked€full€time.€€ñgñœñgñEvidenceÏestablished€that€theñgñ›ñgñ€Defendant€continued€to€dominate€his€ð ðpossession.ðð€€HeÏcosigned€for€a€car€but€forced€Nicole€to€keep€it€at€his€house.€€She€had€to€surrenderÏher€wages€to€the€Defendant,€who€used€them€to€pay€for€his€own€car.€€ñgñœñgñSheñgñ›ñgñ€had€aÏpager€and€could€only€use€her€car€to€drive€to€and€from€work€and€to€church€onÏSunday.€€She€was€expected€to€account€€for€her€whereabouts€at€all€times.€€She€stillÏhad€no€social€or€dating€relationships.€€When€Nicole€began€seeing€Claude€Rucker,Ïshe€became€ñgñœñgñmoreñgñ›ñgñ€courageous€and€cooperated€less€frequently.€€She€had€to€ñgñœñgñseeñgñ›ñgñÏMr.€Rucker€ñgñœñgñsecretly€duringñgñ›ñgñ€a€free€hour€she€had€after€her€work€shift€ended€andÏñgñœñgñbeforeñgñ›ñgñ€her€sisterððs€shift€ended.€€When€she€left€her€motherððs€house,€at€age€twenty„¼one,€the€Defendant€attempted€to€force€her€in€his€vehicle€to€make€her€return€home.€ÏAfter€the€Defendant€discovered€she€was€seeing€Claude€Rucker,€he€becameÏenraged.€€He€stalked€the€two€and€warned€them€that€he€would€shoot€them€downÏð ðlike€dogs.ðð€€His€desire€to€control€Nicole€Bowman€culminated€in€his€shooting€herÏand€Claude€Rucker€as€they€sat€in€Ruckerððs€car€outside€his€house.ÌÌà ` àAlthough€the€offenses€tried€together€were€indeed€remote€in€time,€theÏevidence€in€the€record€reveals€that€the€offenses€committed€by€the€DefendantÏwere€perpetrated€as€a€result€of€his€goal€to€sexually€molest€and€completelyÏdominate€Nicole€Bowman€for€his€own€gratification.€€òòSeeóó€òòState€v.€Bomaróó,€C.C.A.Ð 0.Ð$& ÐNo.€85„81„III,€Davidson€County€(Tenn.€Crim.€App.,€Nashville,€Nov.€27,€1985)Ïñgñœñgñòòperm.ñgñ›ñgñ€to€appeal€deniedóó€(Tenn.€ñgñœñgñ1986).Ð 2°(* ÐÌà ` àWe€must€next€consider€whether€the€evidence€of€the€aggravated€rapesÏwould€properly€be€admitted€in€the€trial€for€the€assaults€and€attempted€murders.€ÏEvidence€that€the€accused€committed€crimes€independent€of€those€for€which€heÐ Ð9p02 Ðis€on€trial€is€generally€inadmissible€because€such€evidence€lacks€relevance€andÏinvites€the€finder€of€fact€to€infer€guilt€from€propensity.€€Tenn.€R.€Evid.€404(b).€ÏHowever,€evidence€of€other€crimes,€wrongs,€or€acts€may€be€admissible€for€otherÏpurposes.€404(b).€€For€example,€when€a€prior€bad€act€reveals€a€defendant'sÏmotive€or€intent,€shows€a€common€scheme€or€plan,€or€rebuts€a€defendant's€theoryÏthat€the€charged€offense€was€an€accident€or€mistake,€the€trial€court€may€admitÏevidence€of€the€prior€bad€act€after€holding€a€hearing€out€of€the€jury's€presence.€ÏAt€the€hearing€the€trial€judge€must€weigh€the€probative€value€of€the€evidenceÏagainst€possible€unfair€prejudice€to€the€defendant.€€Tenn.€R.€Evid.€404(b);€€òòStateÐ Ðbe€admissible€at€trial.€€The€evidence€of€the€history€of€sexual€abuse€was€admittedÏnot€to€prove€the€Defendant€acted€in€accord€with€this€character€but€as€part€of€theÏproof€establishing€his€motive€for€the€assaults€and€attempted€murders.€€òòSeeóóñgñ›ñgñ€òòStateÐ €$  Ðv.€Smithóó,€868€S.W.2d€561,€574€(Tenn.€1993).€€The€Defendant€claimed€that€theÐ p& Ðassaults€occurred€only€because€he€was€trying€to€mediate€an€argument€betweenÏNicole€Bowman€and€her€mother.€€He€went€to€her€ñgñœñgñplace€of€employment€toñgñ›ñgñ€take€herÏhome€at€her€motherððs€behest.€€He€also€claimed€that€his€actions€taken€to€controlÏNicole€were€for€her€own€protection.€€The€Defendant€suggested€that€ClaudeÏRucker€had€threatened€ñgñœñgñthe€Defendantñgñ›ñgñ€to€leave€Nicole€alone€because€ñgñœñgñRuckerñgñ›ñgñ€wasÏwith€her€now.€€The€Defendant€testified€that€he€only€shot€at€Claude€Ruckerððs€carÏbecause€he€thought€Rucker€was€reaching€for€a€gun.€The€Stateððs€proof€and€theÏDefendantððs€explanations€were€clearly€contradictory€and€motive€was€certainly€anÏissue€in€proving€the€level€of€intent€for€€ñgñœñgñattempted€first„degreeñgñ›ñgñ€ñgñœñgñmurder.ñgñ›ñgñ€€Proof€of€theÏnature€of€the€relationship€between€the€victim€of€a€violent€crime€and€a€defendantÐ Ð9p02 Ðprior€to€the€commission€of€the€offense€are€relevant€to€show€defendant's€hostilityÏand€a€settled€purpose€to€harm€the€victim.€€òòSeeóó€òòSmithóó,€868€S.W.2d€at€574;€òòStateÐ P ð Ðv.€Turnbillóó,€640€S.W.2d€40,€46-47€(Tenn.€Crim.€App.€1982);€€òòState€v.€Glebockóó,€616Ð @ à ÐS.W.2d€897,€905-906€(Tenn.€Crim.€App.€1981).€€ñgñœñgñWe€do€not€believe€that€theñgñ›ñgñÏprobative€value€of€this€evidence€is€ñgñœñgñoutweighedñgñ›ñgñ€by€the€danger€of€unfair€prejudice.€ÏÌà ` àTherefore,€we€cannot€conclude€that€the€trial€court€erred€by€failing€to€grantÏthe€Defendantððs€motion€to€sever.ÌÌÓ  ÓIV.ÌÌÓà´Óà ` àAs€his€final€issue,€the€Defendant€contends€that€the€trial€court€erred€in€itsÏapplication€of€enhancement€factors€for€the€two€attempted€first„degree€murderÏconvictions€and€in€imposing€consecutive€sentences.€€When€an€accusedÏchallenges€the€length,€range,€or€the€manner€of€service€of€a€sentence,€this€courtÏhas€a€duty€to€conduct€a€òòdeóó€òònovoóó€review€of€the€sentence€with€a€presumption€thatÐ Ðthe€determinations€made€by€the€trial€court€are€correct.€€Tenn.€Code€Ann.€ðð€40„35„¼401(d).€€This€presumption€is€"conditioned€upon€the€affirmative€showing€in€theÏrecord€that€the€trial€court€considered€the€sentencing€principles€and€all€relevantÏfacts€and€circumstances."€€òòState€v.€Ashbyóó,€823€S.W.2d€166,€169€(Tenn.€1991).Ð àIf€our€review€reflects€that€the€trial€court€followed€the€statutory€sentencingÏprocedure,€imposed€a€lawful€sentence€after€having€given€due€consideration€andÏproper€weight€to€the€factors€and€principles€set€out€under€the€sentencing€law,€andÏthat€the€trial€court's€findings€of€fact€are€adequately€supported€by€the€record,€thenÏwe€may€not€modify€the€sentence€even€if€we€would€have€preferred€a€differentÏresult.€€òòState€v.€Fletcheróó,€805€S.W.2d€785,€789€(Tenn.€Crim.€App.€1991).Ð Ðp ÐÌà ` àThe€trial€court€sentenced€the€Defendant€to€twenty„five€year€sentences€forÏeach€attempted€first„degree€murder€conviction.€The€trial€court€found€the€followingÏsentence€enhancement€factors€applicable€to€count€twelve,€the€attempted€murderÏof€Nicole€Bowman:€(1)€That€the€Defendant€has€a€previous€history€of€criminalÏbehavior€in€addition€to€those€acts€necessary€to€establish€the€appropriate€range;Ï(6)€that€the€personal€injuries€inflicted€upon€the€victim€were€particularly€great;€andÏ(9)€that€the€defendant€possessed€a€firearm€in€the€commission€of€the€offense.€ÏTenn.€Code€Ann.€ðð€40„35„114(1),(6),(9).€€€On€count€thirteen,€the€attemptedÏmurder€of€Claude€Rucker,€the€trial€court€applied€enhancement€factors€(1),€(9)€andÏ(10)€that€the€defendant€had€no€hesitation€about€committing€a€crime€when€the€riskÏto€human€life€was€high.€€Tenn.€Code€Ann.€ðð€40„35„114(1),€(9),€(10).€€The€trialÏcourt€found€no€mitigating€factors.ÌÌà ` àThe€Defendant€argues€that€enhancement€factor€(6)€does€not€apply€to€ñgñœñgñtheÏsentenceñgñ›ñgñ€in€count€twelve€because€it€is€an€element€of€attempted€first„degreeÐ Ð9p02 ` àà ¸ àNext,€the€Defendant€argues€that€the€trial€court€misapplied€factor€(10)Ïto€count€thirteen€because€there€were€no€bystanders€during€the€commission€of€theÏoffense€and€that€he€was€convicted€based€on€both€victims.€€€The€State€countersÏthat€the€Defendant€shot€Nicole€Bowman,€then€shot€Claude€Rucker.€€BecauseÏNicole€was€leaning€against€Rucker€when€the€Defendant€shot€the€second€time,Ïthis€put€her€further€at€risk,€supporting€the€imposition€of€factor€(10).€€Ordinarily,Ïfactor€(10)€may€not€be€applied€when€it€is€an€essential€element€of€the€offense.€€ItÏhas€been€considered€such€in€charges€for€attempted€murder€because€the€offenseÏconstitutes€behavior€that€is€inherently€a€high€risk€to€human€life.€€òòState€v.€Makokaóó,Ð 0.Ð$& Ð885€S.W.2d€366,€373€(Tenn.€Crim.€App.€1994);€€However,€when€others€who€areÏnot€the€victims€of€the€crime€are€at€risk€of€harm,€this€factor€may€be€applied.€€òòId.óó;Ð 2°(* ÐòòState€v.€Hicksóó,€868€S.W.2d€729,€732€(Tenn.€Crim.€App.€1993).€€In€the€case€at€bar,Ð 4 *, Ðthe€Defendant€was€charged€with€attempted€first„degree€murder€for€both€victimsÏinvolved.€€Therefore,€the€high€risk€to€human€life€was€ñgñœñgñclearly€inherentñgñ›ñgñ€in€theÏcharged€offenses.€€The€fact€that€Nicole€Bowman€was€near€Claude€Rucker€whenÐ Ð9p02 Ðthe€second€shot€ñgñœñgñwas€fired€doesñgñ›ñgñ€not€create€a€risk€that€was€a€ð ðsecond€time€aroundððÏthat€would€justify€a€finding€of€risk€of€harm€above€and€beyond€that€inherent€in€theÏoffense€of€attempted€first„degree€murder.€€Furthermore,€there€is€no€evidence€thatÏany€witnesses€to€the€event€were€in€close€enough€proximity€to€the€shootings€to€beÏconsidered€at€risk€because€of€the€offense.€€We€must€conclude€that€the€trial€courtÏerred€in€applying€factor€(10)€to€count€thirteen,€the€attempted€murder€of€ClaudeÏRucker.€€Nevertheless,€we€believe€that€the€remaining€enhancement€factors€moreÏthan€adequately€support€the€twenty„five€year€sentence€imposed€by€the€trial€court.€ÏLikewise,€we€affirm€the€twenty„five€year€sentence€imposed€for€the€attemptedÏmurder€of€Nicole€Bowman.ÌÌà ` àThe€Defendant€also€charges€that€the€trial€court€erred€by€ordering€him€toÏserve€his€sentences€for€the€attempted€first„degree€murders€consecutively.€€€TheÏtrial€court€found€that€the€Defendant€was€a€dangerous€offender,€which€requiresÏthat€an€offenderððs€ð ðbehavior€indicates€little€or€no€regard€for€human€life,€and€noÏhesitation€about€committing€a€crime€in€which€the€risk€to€human€life€is€high.ðð€€Tenn.ÏCode€Ann.€ðð€40„35„115(b)(4).€€Beyond€ñgñœñgñthis,€the€evidence€must€support€ð ðtheñgñ›ñgñÏfinding€that€an€extended€sentence€is€necessary€to€protect€the€public€againstÏfurther€criminal€conduct€by€the€defendant€and€that€the€consecutive€sentencesÏmust€reasonably€relate€to€the€severity€of€the€offenses€committed.ðð€€òòState€v.Ð
