àOn€July€8,€1996,€the€defendant,€Lonny€D.€Hazelwood,€was€chargedÏwith€driving€under€the€influence.€€The€trial€court€suppressed€the€results€of€a€bloodÏalcohol€test.€€The€State€of€Tennessee€filed€this€interlocutory€appeal.€€Rule€9,€Tenn.ÏR.€App.€P.€€The€single€issue€for€review€is€whether€the€trial€court€erred€byÏsuppressing€the€results€of€the€blood€alcohol€test.ÌÌà Œ àà ä àWe€affirm€the€ruling€of€the€trial€court.€€This€cause€is€remanded€forÏfurther€proceedings€consistent€with€this€opinion.ÌÌà Œ àà ä àThe€defendant's€preliminary€hearing€was€initially€scheduled€forÏSeptember€25,€1996.€€Although€the€defendant€was€in€attendance,€the€state€did€notÏhave€the€blood€alcohol€test€results€and€the€hearing€was€continued€to€NovemberÏ10th.€€On€that€date,€the€blood€alcohol€test€results€were€still€unavailable.€€A€secondÏcontinuance€was€granted€to€the€state€and€the€preliminary€hearing€was€rescheduledÏfor€December€18,€1996.€€On€that€date,€when€the€state€was€still€unable€to€produceÏthe€blood€alcohol€test€results€or€its€primary€prosecution€witness,€the€generalÏsessions€judge€dismissed€the€charges€against€the€defendant€for€failure€to€prosecute.ÌÌà àAlmost€three€months€later,€the€state€presented€the€matter€to€the€grandÏjury€which€returned€a€true€bill€of€indictment,€charging€the€defendant€with€drivingÏunder€the€influence.€€Within€days,€the€defendant€filed€a€motion€for€discoveryÏrequesting€the€results€of€the€blood€alcohol€test.€€On€the€following€day,€February€27,Ï1997,€the€state€presented€the€defendant€with€an€official€report€showing€that€theÏTennessee€Bureau€of€Investigation€had€tested€the€blood€sample€ñ¢ ñœñ¢ ñshortly€after€theÏarrestñ¢ ñ›ñ¢ ñ€and€that€the€defendant's€blood€alcohol€level€registered€0.13%.€€Six€days€later,Ð @8à.2 Ðthe€defendant€requested€that€the€sample€be€preserved€for€independent€testing.€Ð 8¸.4 ÐAssistant€District€Attorney€Derek€Smith€attested€that€he€called€the€TBI€laboratory€onÏMarch€7,€two€days€after€the€request€by€the€defense,€to€have€the€sample€preserved.€ÏAt€that€time,€he€was€informed€that€the€sample€had€been€destroyed€within€twenty„fourÏhours€of€the€time€the€state€provided€the€defendant€with€a€copy€of€the€official€report.ÌÌà Œ àà ä àDefense€attorneys€Reid€Street€and€Ed€Silva€attested€that€they€hadÏrequested€the€results€of€the€blood€alcohol€test€from€the€district€attorney's€office€onÏeight€occasions€ñ¢ ñœñ¢ ñsinceñ¢ ñ›ñ¢ ññ¢ ññ¢ ñ€July€22,€1996,€and€were€informed€as€late€as€February€24,Ï1997,€that€the€results€were€not€available.€€At€the€evidentiary€hearing,€each€of€theÏdefense€attorneys€contended€that€they€had€no€knowledge€whether€a€test€had€everÏbeen€performed€on€the€ñ¢ ñœñ¢ ñsample€untilñ¢ ñ›ñ¢ ññ¢ ññ¢ ñ€they€were€notified€in€late€February.€€€€ÌÌà Œ àà ä àAt€the€suppression€hearing,€the€state€maintained€that€defense€counselÏshould€have€filed€a€motion€requesting€access€to€the€sample€for€independent€testingÏbetween€the€July€1996€ñ¢ ñœñ¢ ñarrest€andñ¢ ñ›ñ¢ ññ¢ ññ¢ ñ€ñ¢ ñœñ¢ ñthe€Februaryñ¢ ñ›ñ¢ ññ¢ ññ¢ ñ€1997€indictment.€€The€state€alsoÏargued€that€defense€counsel€should€have€contacted€the€TBI€directly€and€directed€ñ¢ ñœñ¢ ñtheÏagency€toñ¢ ñ›ñ¢ ññ¢ ññ¢ ñ€preserve€the€sample.€ÌÌà Œ àà ä àDr.€Dawn€King,€a€toxicologist€for€TBI,€tested€the€blood€sample.€€SheÏtestified€that€the€ñ¢ ñœñ¢ ñagency€policyñ¢ ñ›ñ¢ ññ¢ ññ¢ ñ€is€to€enter€the€results€of€the€test€into€the€computerÏupon€its€completion.€€She€related€that€the€computer€generates€a€report€and€that€anÏagency€secretary€then€sends€the€report€by€regular€mail€to€the€district€attorney.€€TheÏreport€includes€a€notice€that€the€sample€will€be€destroyed€sixty€days€after€testing.€ÏDr.€King€testified€that€she€tested€the€sample€in€question€on€July€18,€1996,€andÏplaced€the€results€in€the€computer€on€July€22,€1996.ÌÌà
