Memphis,TN38103                          OPINIONFILED:____________________ AFFIRMED JOHNH.PEAY, Judge  7  XXdXXd7  Ӝ@ OPINIONX   Thedefendantwasindicted,charged,andconvictedofburglaryandsentencedasacareeroffendertotwelveyearsimprisonment.Inthisappealasofright,thedefendantarguestheevidencewasinsufficienttosupportaconvictionforburglarysincetheStatefailedtoproveintenttocommittheft.Findingnomeritinthedefendantsargument,weaffirm.  AroundnoononSeptember7,1995,DavidSugarekwasathishome.Hewalkedthroughhisdetachedgarage,whichhouseslawntools,aladder,andacar,andhedidnotnoticeanythingunusual.Bothdoorstothegaragewerelocked.Shortlythereafter,heleftforaworkrelatedservicecall.Whenhereturnedhomeatapproximately2:00p.m.,hiscatwasactingoddly.Hewenttothegarage,whichwasdark,toinvestigate.Whilehewasinsidethegarage,someoneranpasthimandexitedthegaragethroughaholeinthegaragewall.Theholehadnotbeenthereearlierintheday.  Mr.Sugarekchasedtheindividualonfootforthirtytofortyfiveminutes,neverlosingsightofhim.WhenoneofMr.Sugareksfriendssawthechase,hebeganpursuingtheindividual.Mr.Sugareksfriendeventuallycaughtanddetainedtheindividual,whomheidentifiedasthedefendant.Mr.Sugarekalsoidentifiedthedefendantastheindividualwhohadbeeninsidehisgarage.ApparentlynothingwastakenfromMr.Sugareksgarage.  Onappeal,thedefendantdoesnotdisputethatheenteredMr.Sugareks  garagewithoutpermission.Rather,thedefendantcontendsthattheevidencewasinsufficienttoprovehisintenttocommittheft.Whenanaccusedchallengesthesufficiencyoftheconvictingevidence,wemustreviewtheevidenceinthelightmostfavorabletotheprosecutionindeterminingwhether anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyondareasonabledoubt.Jacksonv.Virginia,443U.S.307(1979).WedonotreweighorreevaluatetheevidenceandarerequiredtoaffordtheStatethestrongestlegitimateviewoftheproofcontainedintherecordaswellasallreasonableandlegitimateinferenceswhichmaybedrawntherefrom.Statev.Cabbage,571S.W.2d832,835(Tenn.1978).  Intheabsenceofan acceptableexcuse,ajurymayreasonablyandlegitimatelyinferthatbybreakingandenteringabuildingcontainingvaluableproperty,adefendantintendstocommittheft.Hallv.State,490S.W.2d495,496(Tenn.1973);accordStatev.Avery,818S.W.2d365(Tenn.Crim.App.1991);Bennettv.State,530S.W.2d788(Tenn.Crim.App.1975).Althoughthisinferencehaspreviouslyonlybeenappliedtopre1989burglarylaw,weseenoreasonnottoapplythisinferencetothecurrentburglarystatute.SeeT.C.A.3914402.  Here,thedefendantwasindictedwithbreakingandenteringwiththeintenttocommittheft.TheevidenceshowedthatMr.Sugareksgaragecontainedvaluableproperty.ThedefendantadmittedheenteredMr.Sugareksgaragewithoutpermission,butheofferednoreasonfordoingso.Giventhesecircumstances,thejurycouldhavereasonablyinferredthatthedefendantintendedtocommittheftwhenhebrokeintoMr.Sugareksgarage.E.g.,Hall,490S.W.2dat496;Bennett,530S.W.2dat79091.Findingnoreversibleerror,weaffirmthedefendantsconviction.̜       _______________________________       JOHNH.PEAY,Judge̜  CONCUR:̜______________________________PAULG.SUMMERS,Judge______________________________THOMAST.WOODALL,Judge
